Nintendo becoming Black Hole of the Space of Emulation
Really this year’s been crazy for emulation in general. Especially with the DMCAs that are happening every few months.
And this all started with Yuzu and pretty much Nintendo is playing Whack a mole with tons of websites....
More like the year where all hope for the gaming industry dies.
Pirating Nintendo is starting to become a civic duty at this point.
I used to buy their games. Never Again. ONLY PIRACY.

Nintendo seems to have the money for law suits but couldn't build a beefy console.
That's a big part of why they have so much money. They don't loss leader the hardware, while keeping it the cheapest console, in addition to all the licensing.

Its their modus operandi. Since the Wii era the will develop their consoles using the cheapest, and least powerful hardware on the market - even if they have better options *just for a few extra dollars* (Never forget that they had the option to use a Tegra X1 plus edition or even the Tegra X2 was just a few weeks away, and both where offered by NVDIA) but nope! They'll use the weakest of the weakest, the cheapest hardware and since the end product MSRP will look like a bargain to their fans, they get away with it all the time.
Lets not forget that they also wanted to release the Switch with a miserable 2GB or RAM, and decelopers basically had to demand more ram. Insane levels of cheapness and greed.
As another example, selling the Switch OLED at the current price is highway robbery, but the thing is still selling well, and the fanboys defend its current price. Theres a reason why Nintendo fanboys are nearly a cult.
It was beefy for a handheld when it released, I don't really get this argument bc most stuff on a market back then could barely give you same level of performance while also working for less than an hour if pushed to a similar level. Of course after 8 years it's not the best, but they're working on the new one so what's the problem lol

Copyright used to expire after 14 years, and that was back when the world was a lot slower. In modern times, it should probably expire even faster, and the files Nintendo keeps suing over should have become public domain long ago.
It was never about the money with Nintendo. It is about control. They want you to only be able to play Nintendo games on the newest Nintendo console.
They don't sell them but that doesn't mean they'll never _try_ to again in the future. If they stopped doing so many DMCAs and takedowns their lawyers would have time to reacquire all the licenses that expired for the thousands of games they don't sell anymore so they _can_ resell them on the next eShop... that they'll inevitable close down in 7 years.

Time to get as many ROMs as possible before it's too late. It's not our fault we wanna experience their games at better quality. Meanwhile Sony hired the PCSX2 devs to help bring PS2 games to PS5.
So... We can expect PCSX2 to be hit with a DMCA in the near future? I mean, Sony has been making some bad decisions as of late. Why not DMCA the emulator of the people you just hired, and probably own now.
@@vicviper0017 Corpos can take down ROMs because they are copyrighted content. They cannot take down reverse-engineering code unless they can prove that the code was written with the help of internal documentation, which is considered trade secret. They can try to take down the screenshots of their games from the project's website and that's about it.

For anyone wondering about the DMCAs
This isn't the work of Nintendo fanboys, this is the work of Nintendo itself. Nintendo employed the services of MarkMonitor Inc., which is where the mm-nintendo email comes from. Basically, MarkMonitor specializes in protecting their clients' (Nintendo and others) intellectual property by utilizing AI driven software they've written to identify any content related to their clients that is being used against their clients' will.
TL;DR: Nintendo employed a company called MarkMonitor Inc., that made their own RUclips IP identification AI, but for the entire Internet (not just RUclips) that has been issuing all of these DMCAs.

Kit and Krysta stepped down when Nintendo was moving offices and they didn’t want to move themselves, has nothing to do with the whole copyright topic.
This kinda stuff was happening in Reggie and Iwata’s era too-they were charismatic leaders but it’s not like Nintendo just suddenly became anal about copyright out of nowhere when they left.

@@Fayt540 Yes, I'm well aware. Reggie and Iwata did not start a litigious culture at Nintendo, and neither did they do anything to stop it. In fact, the Nintendo Creators' Programme, a major blight on Nintendo's fan interactions, was introduced during Reggie and Iwata's times in office and only scrapped near the end of Reggie's period.
As for whether Nintendo is going to be made irrelevant by these decisions...I have my doubts. One area where Nintendo's usual strategy helps them here is that by targeting the most general and casual demographics, Nintendo actively reaches people who are less likely to follow gaming discourse or make decisions that are as informed as more "hardcore" gamers about Nintendo's decisions in the first place. These people are more likely to default to and support Nintendo simply on the basis of their games being fun and their name being good among the general public, while casting a less critical eye on some of their choices. And I don't really see that changing heavily even with the litigious choices they've made.
Of course it COULD change with a longer period of time and longer exposure to such decisions, but that remains to be seen and I don't think Nintendo has broached that point just yet.
The harder they fight us, the harder I gladly pirate, and fight to do so.

Telling people to not give Nintendo any money is like telling apple fanboys to not spend money on apple. It's a noble gesture, but the people in most need to heed the message won't actually listen to it. Boycotts almost never work. To really fix it, we need to fix the laws, to regulate big corporations and hopefully overhaul the entire intellectual property system. DRM should be illegal, and copyrights should expire much, much faster.

I’m glad that I’m not the only person who fell in hate with Nintendo crappiness, I never like them and I hope they never win against these dmca nonsense, I love the emulations and I always do, long live the emulations!

I honestly think the reason why all these companies are jumping on the “DMCA” bandwagon is because if Apple. They now allow emulators. Now the rich people who spend over $1,500 on the latest & greatest iPhone doesn’t need to give their children a Switch or any Nintendo game period to their kids for birthdays or Xmas when they can either do the emulation themselves or pay someone to do it for them…
the rich people you're describing have no issues buying a switch and games for their kids though. They also probably wouldn't be willing to put in the time and effort to understand getting games and putting them in the correct place for the emulators to even use them.
Notice it's a lot of Japanese companies, their laws are different regarding mods and emulation. Also Switch 2 incoming so they are trying to disrupt the piracy communities as much as possible.
I don't think Apple emulation is really a big deal, anybody savvy enough to load roms and configure controllers etc. probably has an Android or gaming PC already. Problem with emulation is you need to fix problems as they crop up. You don't want to be fixing problems on people's devices all the time, explaining fps drops, most emulators crash pretty often too. Most kids can get more mileage out of a $200 Switch with Smash Bros, Mario Kart, Fortnite, Minecraft, not that expensive considering less hassle vs emulation

Yeah, i got to have Ultra-Shounen-Kai-Z's drawing of Vivian (and other nintendo characters) to archive. i got a few mockups from SupaStarFox on this computer, mainly for archival purposes, but i won't release them, becuase he now says that people shouldn't upload his works now that he's not active anymore and wants his work to be lost media and that nobody should upload them.

DMCAs for mods in single player games make absolutely no sense. And I really feel that Nintendo doesn't understand the purpose of sites like Vimm. The only ROMs I've ever downloaded are for games I already own or that aren't available for sale.
Unfortunately not everyone is that moral. That's why they call it "piracy" and not "lawful downloads of games you already own."

I get that everyone isn't that moral, and I was actually behind Nintendo in going after the people that were behind the TotK piracy, because that just hurts the industry. Vimm was fine but people started bringing it up. Now that people know its there sadly it wont last long. Very Upsetting. People just need to keep making new sites and keep it underground. These companies have no respect for creative freedom and game preservation. Most of these games havent been released in Decades and these companies just dont like that people have chosen to go back to when they made good games rather then deal with the modern garbage. It's funny how these companies expect people to pay hundreds of dollars to resellers rather then just letting them enjoy games via an emulator. Also no, I won't pay for a subscription service to play games I already own either, Nintendo.

Im sure this has been cooking for a while, but the sudden influx of newcomers to the emulation scene on the Fruit Phone and breaking the first rule of fight club on Twitter probably hasnt helped.

I'm really sad this happened to Vimm's Lair. All their hardwork went to nothing. Nintendo shouldn't have done that. Now, there are online sellers of their games, who are reaping the fruits of other's labor, and i mean the labor that ROMsites did, for money. 🤦

Everything about their rigid approach to IP management has been IP landlording for the longest time. The rigid restrictions on fans, the draconian approach to anything that could even be considered the slightest trespass, and the overall domineering attitudes to control and availability are all in line with what you’d see of an abusive landlord, albeit one dealing in intellectual and not real property.
Nintendo got far too comfortable when they managed to take down Yuzu and what is really annoying is they think that sending dmca notices to gamebannana for mods is way too far modding isn't going to harm the company so why try and take down mods
Nintendo is notorious for hating their fans and community. They take down roms, mods, free fan games, free fan remakes, tournaments they aren't directly involved in, youtube letsplays, streams, music. They're horrific as a company, they just got lucky in that their game devs are wonderful.
I can't believe they are going after game mods. Who cares!!?? A mod doesn't change their sales revenues. Sheesh!
Heres the real question. What can be done to stop Nintendo?
I've done my part by not buying anything from their products as of late, which does nothing in the longrun.
How do we as gamers salvage something they try so hard to destroy? Sure you can make other domains, but I feel they'll eventually catch up tear it all down.

You could sue them, but it would take years and a ton of money and they'll most likely win. You could stop buying Nintendo games but that's not going to stop everyone from buying them and Nintendo would just do all this even more. The only thing I can think of that would actually make a difference is a change in leadership with someone younger who could actually see the benefits of things like game preservation and RUclips and mods. Everyone in leadership positions over at Nintendo right now are dinosaurs.

Thing about Nintendo and Apple is that the consumer base they appeal to already affords them a great advantage. Both of them target a wider, “lay” demographic who are less savvy with the market for their respective products and the discourse surrounding them, and are easier to sway into buying the products more because of their good name among the public as a result. This lack of wider awareness also means Nintendo and Apple can get away with more among their communities, who lack an informed basis of comparison for many of their decisions.
Ultimately I can’t really say it’s the fans’ fault for exercising their free choice to buy whatever they like, and I think it’s not reasonable to expect people to research the market thoroughly for EVERY purchase they make, but this particular factor explains why Nintendo and Apple are able to get away with a lot that other companies with more “savvy” consumer bases might not be able to sneak past their own consumers as effectively.
I can see Nintendo would dmca people who using Nintendo instruments in their songs. Because "It's not your property". Nintendo is like that kid who say "It's all mine! Not yours!!"

If you had the original media they were on and dumped them yourself then yeah it's your game. Getting them from a third party site does not make them yours (unless it was something that was FOSS then 100% yeah it's yours)
@@doniarts bought original media for these games multiple times over. Never dumped anything myself. But its semantics at this point because Nintendo doesn’t want a way for the games to be “yours”
@@doniarts the problem is that it doesn’t matter to Nintendo whether you originally dumped the copy yourself or not, they still view emulation, of any kind, as piracy even after the courts in America have told them otherwise

Besides Nintendo, Sega and ESA, what has to do with Lego anyways? Besides their games from TT Games and WB, I pretty assuming it also includes games before the TT Games era and many of their games before 2005 were not available for so long on something like Steam and GOG for the most part.
It doesn't include their pre-TT games or Bionicle Heroes, though it does include later games that also aren't being sold anywhere, including the first two LSW games, the GBA and DS TT games, Lego Battles, Lego Rock Band, etc.

Nintendo really needs to chillax, it's getting ridiculous or better yet, set some real guidelines (no emulation is not acceptable), for what is acceptable to emulate and what isn't (a year range should be set for what is okay and what is a no go).
They'd just say it's all bad, period. why would they give a range of acceptable use when they can just bully their way through it all?

I think its time for class action lawsuits. We as consumers need to be protected. Game companies can take away games at any time. Not cool bro. This is for preservation purposes. Not for illegally distributing. We need back ups. I think back ups should be legal.

I wouln't have considered buying a switch if it were not for the retro games out and about. Leaving places like Vimms alone I believe actually drives sales of current and future tech.

I think these waves of Nintendo DMCAs are definitely indicative of not only the company swinging wild and free at potential infringements in the wake of the Yuzu lawsuit (“cleaning up” the job) but also a newfound willingness to rely on AI takedowns (through their third-party contractor MarkMonitor) to systematically sweep the Internet of fanmade content, preserved ROMs and emulation at a far greater capacity and scope than ever before. All of which ultimately serves to strengthen their own aggressive stance on copyright and make their IP-landlording approach even more restrictive.
All this should be a portent of trouble brewing on the horizon for fans. With the tools now at their disposal, Nintendo can and likely will carry out attacks on fan work and emulation much more widely and frequently than they’ve ever done in the past. Time will tell if this crusade of theirs ultimately finally breaks through critical mass and garners enough fan attention to cause a true rebellion, or if Nintendo’s focus on casual audiences is robust enough to allow them to sneak through waves of draconian takedowns without so much as drawing the eye of the majority of their consumers.
