I used to get pulled over constantly in that area . Just like this, cop- "Why'd you pull over?" Me- "Because you were about to pull me over". Such a police state.
They do understand what is meant. However, they willfully ignore that and will never be held accountable for their misconduct. However, saying that you don’t answer questions is not the same as invoking your 5th Amendment right to remain silent. Case law has been strict about the need for a citizen to be clear by what they say to actually be protected. They must clearly state that they are invoking the right. I think that a better statement would be, “I hear-by invoke my civil right to have an attorney present during all questioning by law enforcement.” Even if the cops continue to ask questions after that point, your attorney is likely to have any incriminating evidence collected after that point as being inadmissible. I’ve only used this twice and it was effective at stopping police questioning. Which is the objective.

A local town in my area plays these games, 1 to 3 am, all year. Their MO is to let you pass then come up behind you at excessive speed, often with brights on, then tail gate you. Any flinch and they pull you over.

This happened to me 50 years ago. Pulled over during Christmas maximum enforcement by California HP. Field sobriety test; allegedly failed, arrested. Demanded blood test at jail. Blood test negative for any amount of alcohol. Still charged and at trial DA says CHP will testify to reckless driving . I represented myself and eventually pled guilty to illegal lane change. to prevent exposure to Reckless driving allegation. No fine. No court costs. the DA just wanted a conviction for his Resume . This is not justice being served. Jury nullification is your super power, Use it ! Thank you Jeff Gray for all you do.

600+ sober drivers being charged with DUI here in TN, my son was one of them. 12 hours in jail (lost day of work), bail, 4 court appearances (lost work) 5 1/2 months to get the blood work back (neg for drugs/alcohol), found not guilty, 2 weeks to get the bail money back after found not guilty, $1200 attorney fee, his employer said any more missing work due to trouble with the police he would be fired. Why was he pulled over to begin with? Per body cam, he accelerated next to a cop, how dare he not respect their authority.
In my community, checkpoints are required to be publicized before they happen. Law enforcement usually does a media release of around 8 locations and they’ll pick a couple to do the checkpoint. Even announced, they still catch a lot of suspected DUI deivers

In my community, checkpoints are required to be publicized before they happen. Law enforcement usually does a media release of around 8 locations and they’ll pick a couple to do the checkpoint. Even announced, they still catch a lot of suspected DUI deivers
