  • Insiders say it’s like something out of a thriller movie. The players in the "Cum-Ex" tax scandal are powerful bankers, executives, top-tier lawyers, and even, perhaps, German politicians...along with the state prosecutor who’s on their trail.
    When the case landed on Cologne prosecutor Anne Brorhilker’s desk, she had no idea she was dealing with the biggest tax heist in German history: Cum-Ex. At this point, no one suspected that over the next eight years, she and her team would plow through tens of thousands of files, conduct worldwide raids and investigate more than 1,000 suspects. Among them were powerful managers, executives at major banks and lawyers at renowned firms. The task seemed impossible, with suspects scattered all over the world and a looming statute of limitations creating a race against time. But in the course of her investigation, Brorhilker exposed how unscrupulous millionaires received billions in reimbursed taxes despite never having paid the taxes in the first place.
    Brorhilker's investigation culminated in a legal milestone. In 2020, a court found for the first time that Cum-Ex was illegal. The investigator and her team finally managed to get perpetrators to come clean -- the result of hundreds of hours of interviews with key witnesses. What came to light was something previously associated only with organized crime: an industry with so much power that its crimes could continue unchecked.
    The documentary shows the people behind the investigation of the biggest tax scandal in German history, and asks how states can protect public money from unscrupulous financial predators.

      Notability that DW acts as investigative reporters bringing matter to light for all to learn. I hope they find many good people to infiltrate these criminal institutions and expose there criminal activities. That said while millions of illegals stampeding into United States, the country in uproar on so many levels, Biden’s meetings with elites much more pressing. You got ask what is really going on.

    As a citizen of Germany, THANK YOU SO SO VERU VERY MUCH to all the Prosecutors & all the people on the Team who pulled this off. Every decent person on earth benefits from this, and I can't tell you have grateful I am that such people can & do bring down such large scale financial fraud. Hooray!!
    Especially my gratitude towards that man who exposed the truth about his employer.

    Congratulations to the investigating officer: I am amazed that she is still alive and working considering the scale of this crime. Her tenacity and organizational skill is wonderful. However, I have some questions: 1. why are the people in positions of power who effectively squashed the issues not investigated for bribery? It is clearly not a question of following procedure to file away evidence of crimes. 2. Why is the receipt of tax payouts for a tax that has not been paid, not flagged routinely? 3. Why was the initial delivery of documents in Frankfurt harbour not seen as an attempt to cover more incriminating evidence? 4. Will we ever be able to discriminate between legal and morally sound?

      Let's see. A narcistic female attained a law degree. She is not part of hierarchy. Nobody wants to work with quotafemale. A statejob as prosecutor is just fine. She finds cause and attempts to redefine comex as a criminal ring - its a regulatory loophole. A loophole that can be closed with legislative action. Her path of action is wrong because there is no crime and that means she is in it for her own good. What is unfolding is a crimesister trying to steal for the herd she pretends to represent...the bureaucracy. So..we need to simplify banking-, tax-, business-law. This reduces bureaucratic reach which the prosecutor perp trys to extend.
      Close the tax loophole and fire the female spending millions on a faulty premise. She is ready to jump ship for a million dollar bank job.

      Unreal but not surprising. Sorta like in the USA , 17.5 billion to date has been "borrowed" from inter-trust Social Security funds by the Fed's. WHY? Where did it go? Why aren't we the people privy to that? Why is SSA funds running low, so they say, not paying back loan? The big fat fund too tempting not to touch? Her moral stance and sense of what is right should be looked up at and taken as a sample. I will say once again - if Deutsche Welle thinks something fishy (esp. with Russia's influence in some politicians) might be going in my country - Latvia - I would gladly welcome them and provide my own apartment for the crew to stay... uhmmm... just to convince them I have nothing to hide :) Seriously - once again, a great piece by DW.       @@msr1116 There is moral law (conscience and ability to think) and there is "legal" law (moral relativism). Do you really think that taxes are "moral"? Look up when income taxes were first introduced (indeed not so long ago), or that you have to pay 20 % of taxes on everything what you eat or the products you buy. Do you know exactly what happens with the tax money, and do you have control over what it is spent for?

    Corruption is a grave human problem and it affects working and poor citizens the most, while the well connected get richer and richer at the expense of the majority of the population in a nation. It is clear that corruption in high places is not exclusive to Africa, but the whole of humanity and worse in other continents.

      And she was absolutely right for many reasons. That's not to say the rich get off scot-free, they just contribute to the economy differently than paying every two weeks like regular wage earners.They also, of course, pay tax attorneys and CPA's etc. to shelter what taxable income and property etc. they do have. Generally speaking, if you are rich and not Donald Trump, you will, over time, contribute a fair amount to the gov't for the benefit of all.

      Not only we CAN but we MUST BE honest and decent. That is, if we want to be part of the solution, you cannot be honest and decent if the only thing that matters to us is to be at the top or can only be satisfied by achieving what sociopaths have achieved at the expense of the rest of us and the environment.
      The prosecutor Anne Brorhilker and the journalists that made this documentary show us we can do the right thing by everyone. The alternative is to continue egoisticaly racing to 'the top' while we run the world to the ground.

    We all know how rich individuals and large corporations find and exploit every loopholes to avoid paying taxes and governments turn a blind eye, while the rest of us are forced in every-way to pay federal taxes failure to which they slap hefty fines and sanctions, i wonder if a time will come when governments will create a level playing field.

    There are programs that consulting firms like PwC KPMG and others „working“ directly inside the ministries and state offices to help. What do you think happens when big companies, banks or super rich hire them for consulting.
    At the other hand who would have guessed Money+Banksters+Politicians = Corruption
    In Germany one guy went to prison for 3 month because he didn’t want to pay the fee for state media, it summed up to around 700€ over a few years (he didn’t even have a tv or radio) At the end he got a bill over 10.000€ for expenses at the prison too.
    They got to love law abiding citizens, otherwise it wouldn’t work out

    7:50 that is a failure of the architecture used in Germany to collect taxes, this is the reason why tax systems should be simple and avoid having "rebates" just lower the taxes instead of having a system where you overtax and then return the excess... Its literally economic karma applied to the greedy countries that abuse their taxation powers and create a complicated bureaucratic system that not even the tax authorities really understand entirely.

    Decades...really. If this was you and I we'd be in jail already, accounts raided, and everything we owned gone. It's going to take decades so these men can die and there will be no one left to blame. "The measure was controversial amongst her department" and why is that exactly. These are questions that the taxpayers should be asking. What's controversial about it they are guilty!

    It's very quaint that the German prosecutors are concerned about ordinary citizens losing trust in the system. Here in US, it is already a given that the public has no trust in the system. It's a given.

    I admire this woman and her teams . For those that say the rich contribute to the economy in different ways than pay taxes the way the masses to ( weekly for the rest of their working lives). Loopholes shouldn’t be one of those ways . Nor should subsidies . They’re going to create a product, that profit is their reward , why should they get so many leg-ups than the ordinary citizen ? But this was a crime and it’s rampant among the richest and most influential, globally. Reducing ordinary people to slaves to a tax system the others never feel the yoke- but treat it like a joke to them. Then actually taking it AWAY from the coffers of the public who paid for that government yoke, for safety, security and services. Via Bankers, who should be scrutinized at all times. And tax laws that should not have loop holes. Tax accountants say the rules change too much- I think that’s to keep us all too confused and just accept it as is. -keep law and taxes simple and clear. So fraud is obvious to all. I admire this lady for her keen intelligence. Shame on those “ buisness men”, tax lawyers, and legislators who clearly allowed this treasonous behavior

    presumption of innocence shouldn't apply to tax evasion especially for the riches, if you are rich, and you are suspected of tax evasion, the assumption should be you are guilty unless you prove otherwise.

    My local politician has over 100 million dollar net worth and he was always just an MLA from my state
    ALL of us in the town know about his riches but he has all the officers and civil servants in his hands.
    No one can even touch him.
    He stole that money from the people.

    This case has become EU wide and it is estimated that the EU states have combined lost around 150 billion euros of tax money to this fraud. And major foreing firms and banks such as the American JP Morgan have also been a part of it.

    DW, this is a great subiect presented in a way that makes it difficult to watch: voiceovers (plus the original voice too loud) - subtitles would be much better, tons of random out-of-focus imagery, meaningless closeups. And copy that was asking for the trailer guy to voice it: "blinded by greed".
    I would have preferred to see some graphics if you don't have original footage, instead of this bad attempt at reenacting.
    Either way, thanks for bringing the subject to public attention.

    The payment was a reimbursement, so they knew they were committing fraud. Fraud is illegal, so the question of whether or not what they were doing was illegal is silly. It's vastly different than exploiting a loophole.

    Honestly i think the more wealth you have the more surveillance should be aimed at you from the state - If the rich was under surveillance 24/7 how should they be corrupt? and it will work as a safety for them as well. And if they don't like to be under surveillance then they should donate all their wealth to Charity

    Good for her.. amazing strength to stick with this. I wish we could accomplish that type of success within every government system.. but it's exhausting work.. her work is very impressive.
    I'm president of my condo board and just kicked out the old property management company because they'd been screwing thr owners for over 30 yrs. Went through all the files myself (took a full month) and found so much shit they pull but the trouble of taking them to court and fighting against those assholes.. as pissed as I am it's not worth my mental energy to fight them. Rich assholes who steal to gain wealth SUCK 😡🤯

    A major bank in my country was heavily implicated in this. Makes a lot of sense why the individuals who bank with them always seem so happy… turns out. The general public really don’t care. Documentaries like this are among the few reasons I still use RUclips. I love it but I can’t help but wonder… why? These documentaries attract people who already know how rotten the elites are. Perhaps the general public doesn’t want to know… maybe they’ve made peace with the fact that no matter how much dirt is uncovered, there’s still dirt underneath that dirt. The people that write financial codes and laws put these loopholes in on purpose… they know there’s a time limit to exploit the system. By the time we find out the true extent of the corruption, they’ll probably be doing they’re banking off planet somewhere…
