Because he (or a shard of him) was freed in the Ultramarines novels and is no longer bound/enslaved by the Necrons. (There is also a "C'tan Shard of the Nightbringer" figure sold by GW and while that might not be an answer which is very lore friendly it is the ultimate answer after which the lore will be built; at least till a new edition of the game says otherwise )

So, since chatan were broken into pieces and pieces locked in seperate vaults, im guessing its a shard rather than whole, therefore theres Also a lego god head looking for rest of its parts, which is honestly intresting development.
