ha par judicial separation ke bhi grounds proof karne padenge.
Sir I n my husband have applied for mutual divorce under sec 13 ,court has given time of 6 months ,in jully decree will be passed ,so this period can be called judicial separation or not ,I can fill government form under category of judiciaaly separated or not
no this period will not be called judicial separation.
as you will see that divorce cover under section 13 for which you have applied, but judicial separation cover under section 10 of HMA.

Sir judicial separation is not that popular though it is a time bound process,like after the order of separation if cohabitation is not resumed after1 yr it gets converted into divorce.but divorce is a long drawn process. Still people don't go for judicial separation why?
Because they are not aware about it. and in fact few people who go for mutual divorce do not want to waste their one year.

Apne jo pahle bola ki is act ke pahle aur bad mein before or after the commencement of this act.. shaadi se pahle aur shaadi ke baad.. uska matlab kya hai
yani ki agar kisi ki shadi is Act se pehle hui hai to before the commencement of this Act,
or ese hi ki shadi is Act ke bad hui hai to after the commencement of this Act.

@@varunika2005 dekhiye court me jis section ke under case file kiya jata hai court sirf us par hi fensla sunati hai. agar parties ne divorce petition file ki hai to court apni marji se judicial separation ki decree nahi de sakti, judicial separation ke liye judicial separation ki petition file karni padti hai.

bilkul milta hai legally abhi bhi wo uska husband hota hai, or isi liye liable hota hai maintenance dene ke liye.maintenance ka case daliye or maintenance lena shuru kijiye.

maintenance wife ko or baccho ko milega, or rahi bat kam milta hai ya jyada milta hai to wo depend karta hai ki husband ki earning kitani hai.

Ek sawal hai Mera. When all religions are different and have different customs so why religion like Sikh Jain and Buddhism are included in this act sab alag riwaaz hai fir bhi included kyu h
because these religion like sikh jain and buddhism do not have their personal laws.
@@LawGuruOfficial per sir yeh ek Tarah se galat nai hai?? Agar har religion alag h and India has secularism where one religion's customs are not imposed on other . They should make personal laws of each religion right? If we see the marriage rituals of Sikhism and compare with Hinduism there's a huge gulf. Similarly is with buddism etc. So shouldn't be there personal laws?

You can go for judicial separation but not for divorce.

This Act is for Hindus as it is Hindu Marriage Act but same provisions are for muslims also in there personal laws.
