Hey man as someone that’s currently in law school, it wouldn’t take much to send a cease and desist letter to toast given he is a public figure. You can create this yourself without a lawyer, and while it itself isn’t legally binding, if he refuses to comply and continued to send you false DMCA notices after receiving the cease and desist, you would have tangible grounds to sue for damages, even inside the UK/EU. Once actual legal arbitration is started, he would either be forced to settle/stop, forced to show up in court, or forced to have his own legal representation show up in court on his behalf. Most of the time this isn’t possible because the people sending DMCA’s are either shell companies or LLC’s with no identifiable individual behind them, but since he’s brazen enough to send them himself he can be held liable legally. If he kept sending them after the cease and desist and after official legal course is taken, it would turn the legal standing of what he’s doing from ‘dubiously legal’ to ‘intentional malice’ and would ensure any court of law would side with you. Obligatory I am not a lawyer and this is not legal advice, but I just think you oughta know that what he might not see as all that serious could get pretty serious if you were willing to put in the effort. Sending a cease and desist would take minimal effort on your part, and would ensure that if he continues to file false DMCA takedowns you have a standard set of when you officially informed him that what he’s doing is an intentional abuse of the system and that you’re requesting he stop else you will seek legal action.

Can't you just gather evidence that he's doing that and sue him back? Pretty sure you have a lot of potential documents at this point that could get him in serious trouble, not only for false allegations against you, but defamation and damaging your business. Toast is already up for 12 months of live streams in damages, a year of abusive messages talking about children and close to 10K in channel earnings that he has stripped away to the point 10IQ has done this for free. I know because I've been a moderator on this channel since he had 500 subs and his impact is virtually completely handicapping this channel daily and costing 10IQ over 10K in personal damages from the earnings he WOULD have made making content that he has had to made for free because this is what he stands for. If you moderated this channel and saw half the stuff I have over the last 12 months, it would blow your mind.

I mean, you have an entire history that you can use as proof of no-fair-use that "user(s)" can abuse from this youtube's system and it can be very detrimental if an streamer relies on youtube to "survive" or be he/she's image. From my perspective, it could be a good case for you and for all the youtubers/streamers to make sure google create a "rule" for using the DMCA thing just to troll or for taking someone down without proper cause.

You may have to come off a retainer.. But my lawyer didn't make money until we won my lawsuit.

You can create this yourself without a lawyer, and while it itself isn’t legally binding, if he refuses to comply and continued to send you false DMCA notices after receiving the cease and desist, you would have tangible grounds to sue for damages, even inside the UK/EU. Once actual legal arbitration is started, he would either be forced to settle/stop, forced to show up in court, or forced to have his own legal representation show up in court on his behalf. Most of the time this isn’t possible because the people sending DMCA’s are either shell companies or LLC’s with no identifiable individual behind them, but since he’s brazen enough to send them himself he can be held liable legally. If he kept sending them after the cease and desist and after official legal course is taken, it would turn the legal standing of what he’s doing from ‘dubiously legal’ to ‘intentional malice’ and would ensure any court of law would side with you.
Obligatory I am not a lawyer and this is not legal advice, but I just think you oughta know that what he might not see as all that serious could get pretty serious if you were willing to put in the effort.
Sending a cease and desist would take minimal effort on your part, and would ensure that if he continues to file false DMCA takedowns you have a standard set of when you officially informed him that what he’s doing is an intentional abuse of the system and that you’re requesting he stop else you will seek legal action.

You may have to come off a retainer.. But my lawyer didn't make money until we won my lawsuit.

Dmca rules have always been the same I'm not sure what you mean by what they changed on youtube? Dmca is going to work on kick the same way it does on youtube / twitch. Kicks been ignoring alot of dmca stuff but that doesn't mean it'll be different. Only a matter of time till kick does the same as youtube once some big lawsuits come through.
some big lawsuits? did u not watch the video? Toast doesn't sue he just sends pretend paperwork that he is over and over and never does then YT puts the live streams back up a week later. On kick that doesn't happen. They demand paperwork first and proof. That's how it should be.
@jasonbeard-fp9pc I'm referring to kick ignoring dmca not 10iq. Toast doesn't need to sue to claim copyright infringement. If toast dmca's him on kick the same thing will happen. The only recourse would be to file a lawsuit against toast for false dmca. Reading comprehension pls. Kick has been ignoring dmca requests, and is rampant with copyright material being streamed I'm saying kick can only ignore it until a big lawsuit happens then there will be a crackdown. It'll end up and as youtube
