    I'm pretty sure Ador will be suing a lot of people (including Omega watches) after the court determines their exclusive contract is still valid lol

      @merphul 3 дня назад +32

      If these events are under contracts negotiated before they left, then ADOR should still be getting paid by the brands. As long as the company gets their money for already agreed upon work with the artists, there's no reason to sue and no damages to recover.
      ADOR is probably even paying the members their share of the brand money, just to show that the company is abiding by the terms of the work contract.

      No way Ador would go after Omega. Why would they risk jeopardising future brand endorsements with them? Omega is owned by The Swatch group which includes other luxury brands like Blancpain, Breguet, Tissot, Longines, etc. It would be completely stupid of them to burn that bridge.

    This legal game of chicken is fascinating. The two parties have taken almost opposite strategies. I'm so curious about how the court proceedings will go.
    Personally, I think Ador will wait for the contract to be decided by the court before suing anyone else. If they win, then they have a basis to say what and who violated the contract and when. Having a solid foundation is everything.

      Lawyer of Seoul gives an analysis of the outcome of a potential case, and has advised the NJ girls to get independent legal advice, as no lawyer with any ethics working for the girls would recommend the actions they are taking. He stated Ador will win, and a penalty will be required to be paid if they want to be released.

    One of the more sensible approaches to the issues I've seen.
    So tired of people claiming New Jeans is somehow free when it's clear that there's a legal fight in the works and that no other label will deal with them until that's cleared.
    Also, apparently the rogue ADOR employee was reported to ADOR by the brand he was trying to pull in. It sounds like whatever brand that was values the ongoing ADOR/HYBE connection more than having a single brand deal with New Jeans. Personally I doubt it was Omega as agreeing on a brand ambassadorship takes more than a couple weeks.

    I feel like the visa situation should have been something they talked about during the conference or something, this was one of the first things i thought about when they talked about the contract being terminated. I hate that these girls are making these decisions and, unfortunately, giving the impression of spoiled young women who can't get what they want. All I want is for ador and NewJeans to separate officially, and stop giving them the publicity and empathy they are looking for because I'm over it.

    • @heykay5610
      @heykay5610 3 дня назад +11

      Yeah, I heard that a new album was in the works for them with another tour next year... Man, I hope they get none of that handed to them after all they've done. They're free to do as they like in the future, but hope Ador doesn't hand them anything else.

    • @TheHaniverse
      @TheHaniverse  3 дня назад +18

      The press conference they did was a whole lot of nothing to begin with, and they were probably hoping this issue would fly under the radar so I'm not surprised they didn't mention it. And at this point, I'm finding it harder to give them grace, I think they *are* becoming spoiled young women because they've been put into an echo chamber that is encouraging their self destruction. As much as I agree that I'd like this to be over sooner rather than later, I actually doubt leaving ADOR would ever be good for NJs, they've already branded themselves as trouble and everything they do moving forward would have to be self-managed, and a narcissist like MHJ will never put herself in harms way to help them.

    • @TheHaniverse
      @TheHaniverse  3 дня назад +10

      I think the album and stuff is more ADOR working for their own sake, at the end of the day, the profits are where their paychecks come from. Even if they let go of NJs in the end, they aren't going to do it unless it's in exchange for the huge termination penalty - they do not care about the girls.

    • @missbonnieyonnie
      @missbonnieyonnie 3 дня назад +3

      @@TheHaniverse that’s true, the conference did nothing but show us that the girls KNOW nothing. But the fact that they think things like this would go unquestioned makes me think that they don’t take Kpop fans or the public as thinking individuals?? Like do you actually think this situation wouldn’t come up at all? The journalists at the conference were immediately confronting the girls with their positions because it didn’t make sense from the beginning.
      This situation is far from over but my birthday is in June and I’m gonna need this to be significantly farther than it is right now so my birthday will be fun 😂but on a serious note I don’t believe they actually understand what leaving ador means and terminating their contract. I’ve seen them post on their ‘new’ account being at the HYBE building and such, so I’m hoping the reality check come sooner than later because I hate to see when people are obviously wrong, feel like they’re right because that comes with entitlement and arrogance and they’ll be in for a rude awakening when MHJ doesn’t show up for them

    it would be stupid of vouge to make an enemy out of hybe because of all the artist they have who sell well. if they some day need another cover shoot of a group more popular than nj like BTS they could just deny it and go for another brand instead. to put all their money in one basket is stupid especially when we don´t know if mhj will be found guilty or not. it would affect all brands. so i hope for them that it was just an old agreement shoot they had already planned. and for it to still happen and not et a blank issue out, they where forced to only write the names of the members which caused the delay.
    they have covered other hybe artists before so i found it strange if they deliberately get on their bad side. but did ador make a statement about vouge? maybe they already knew and allowed them to print it anyway so that hybe artist could still get sponsorships with them. but idk how it works. hybe works slow but once they are ready they strike with a airtight blow. like they did with mhj and firering her.

      @TheHaniverse  3 дня назад +12

      I'm like 99% sure it was an existing schedule because ADOR shared the vogue tweet on the official NJs twitter account. I think the only thing to be confirmed is did they credit ADOR inside the magazine or not. I totally agree it would be stupid for them not to, I think this really became an issue because NJs shared the images first on their unofficial IG account, when normally the company would be the one to announce things like this first. I agree that Vogue wouldn't try to burn bridge over NJs, it would not be worth it.
      In ADOR's statement, they mentioned the IG account causing confusion rather than calling out Vogue directly, so I think it's more 'how things went down' that they're made about.
      Also yes, whatever the case may be, HYBE and ADOR will absolutely not shoot until they have a bullseye.

    3:52 does this mean that, by appearing independently alongside the other girls on Kim Hyun-jung's News Show on Sports Chosun, on 12/24/24, an appearance that ADOR has stated was done without discussing it with the company or notifying them in advance, Hanni has already broken the stipulations of her E-6 visa even though ADOR is still sponsoring her? Since she performed on a show without ADOR’s prior knowledge, that would count as working as an entertainer. Would whether or not they were paid for their independent appearance factor into that?
    And if so, what could the consequences of her defying her visa in this way be?

    • @TheHaniverse
      @TheHaniverse  3 дня назад +3

      Ooh great point and question! If she got paid, then yes, it would count as her breaking her visa and working illegally if there is not contract with ADOR, but someone would still need to report her for it to be recorded.
      The most likely punishment is just a fine though, and the amount of the fine would be dependant on if it was her first offense and how much she made. In the case of a huge fine, it could hinder her from getting an E6 visa again, but I doubt it would be that big. It also absolutely wouldnt stop her getting one of the investment visas!

  • @mayaradantas5763
    @mayaradantas5763 День назад +3

    I think that the main problem here is not even the possibility of getting another visa but instead her claims of contract termination. If she argues that her contract is terminated, she is already in violation of immigration laws. The fact that she’s still using her visa issued through ador is a direct contradiction of her own claims that her contract was terminated in November since the fact that without a valid contract, there’s no visa.
    This is something that only Hanni has to deal with it and there’s nothing requiring the court to rule in he same way for all NJ members. if the chances of them winning the lawsuit are very low already, Hanni chances are even lower than the others since the status and conditions of her foreign visa are very specific.

    • @TheHaniverse
      @TheHaniverse  День назад +2

      Yes, I agree with you except her original visa is valid until ADOR reports the contract termination - even if Hanni herself believes it terminated, it's the sponsor's (ie ADOR's) duty to report it to immigration which they obviously won't do.
      Also I disagree about the court not ruling the same way for all members, their contracts will have the same terms so if ador violated their duties, that would be the same for all the girls - but like you said, the chance of that is very low anyway. (That being said, them losing would mean the contract is still valid, hence her visa is also.)
      The reality is, while ADOR will not report the contract as terminated, Hanni's visa will run out long before the court ruling, and she will have to find another visa for the meantime. As discussed in my video, the best options for her are the F-series visas, that allow her to do any financial activities she wants, so she can continue being an idol.

    Given all the instability in Korea and the state of the won, I would imagine the country wants to project the image of 'business as usual.' You cannot have havoc unfolding with respect to fundamentals of contract law as well as political drama at the same time - it's very unsettling for investors both within and outside the country. I just read headlines in the NYTimes about the president not cooperating with investigators, so it's getting messier and messier. I don't know if any of this would finally impact NJ's case (and MHJ's - remember her?) but I do think anyone who's not a stan and is actually putting money on the line is looking for signs of normalcy. We'll see.
    Also, I really appreciate the detail with which you've laid out the visa types and application processes. Maybe her residency visa application process is underway, maybe it isn't. But if she's hanging around on an Ador visa (she's technically within her rights to do so) while terminating a contract via press conference and saying 'no obligations apply!,' that just isn't a good look.

    • @TheHaniverse
      @TheHaniverse  День назад +1

      Oh I completely agree with you, mind you investor confidence in Korea (not just kpop) has BEEN low throughout 2024, and add the possibility of conflict between China-Taiwan before 2030 and the fact Korea would almost definitely have to get involved, literally EVERYTHING is a mess in Korea right now.
      I agree that maintaining status quo is very important, and in this case, HYBE is an industry leader, so anything ADOR does reflects on the company which reflects on the whole industry - I think that's why they're not being as aggressive as they could be.
      In regards to the residency visas, F-2 processes pretty fast - I got mine in just 2 weeks and received my ID card a week later, but I know the average processing time is 1 month. In the case of an F-5, it's supposed to take about twice as long, but regardless, she has a legally binding contract she has to honour even if ADOR isn't her visa sponsor.

    It would be amazing if once Ador wins on the fact the contract is valid, NJ returns. What will Ador do then since the members have openly declared war on them, made their contempt for the new CEO clear, and openly despise the non-MHJ staff? If they shut down jeanzforfree, NJ can say they have been silenced. If they made new music/world tour (as promised by Ador in its public statements) the NJ members would make it clear to the world its under duress. If Hybe dungeons them for the remainder of their contract, then NJ can say that was their plan all along.

    • @TheHaniverse
      @TheHaniverse  3 дня назад +8

      Great question, but I think the main things to consider is sympathy and perception.
      If the court rules that ADOR was right, that also means NewJeans never had any reason to complain to begin with and that they weren't mistreated, they were just acting out. This would paint them as ungrateful brats who threw a legal tantrum because they didn't get their way, and some people already see them like that.
      Rather than a victim being silenced, it's a brat being disciplined. Rather than oppressed idols fighting their oppressive company, its a company taking the necessary measures to put them in check, so there's no duress.
      Basically the court ruling would change the optics bc its not longer a he-said she-said, its just business. At that point, NJs can either suck it up and do their job, continue throwing tantrums and get sued for misconduct, or pay the termination fee and just leave ador all together.

    • @J_Benn
      @J_Benn 3 дня назад +5

      @@TheHaniverse Their fanbase though will always see them as victims no matter the courts. I've always said if NJ was smart they would force Hybe/Ador to live up to the many promises they've made - including albums/tour/A-list producers etc. - and wait it out for 5 years while building up their personal brand, and THEN walk away. MHJ is a brilliant marketer (give her that) and NJ was built for a global audience in a way Illit/Les Serrafim/IVE are not so they could dominate the charts still, BUT they've clearly been brainwashed and I really believe these girls would rather pay the penalty and have their music careers go the way of the ex-50/50 members rather than "betray" MHJ (who could care less about them).

In the grand scheme of their careers, it's a small price to pay!
      Edit: I also agree with everything you said about MHJ, i respect her work/skill, but I highly doubt she cares for these girls at all.

      You didn't ask me but I think that if/once the court declares the contract still valid they'll go on a big apology tour behind the scene and maybe in the public eye too to appease the growing annoyance towards them, then lay low and maybe be seen with other hybe groups to redeem themselves.
      If they don't want to (finally) be professional, they're probably going to continue to act the way they do, get in debt to leave ADOR (I wouldn't advise to do that but who knows how deep the codependency/obsession for mhj goes).

      I kinda agree with you here! I think MHJ intentionally planned to remove NJs from HYBE from the very beginning - but I don't think she thought she would get caught (the April audit) and have to ruin her asset (ie destroy NJs' career) in the process of protecting herself and spiting HYBE. 2) If hanni accepts visa renewal through ador, thus confirming her contract is valid, wouldn't that also confirm the other 4 members contracts since they unilaterally "terminated".
    3) I saw Bunnies on Twt/X saying that Ador violated the "Personal Information Protection Act" but Ador simply responded to rumors. Does PIPA cover Idols?
    4) I also some Bunnies claim Ador violated the "JYJ" law but I don't know too much about it.
    Sorry for the long comment, just things that have been on my mind since the issue was brought up.

      @TheHaniverse  День назад +2

      Hello! 🥰
      1) Thank you for watching! I'm glad you enjoyed 🥹 and happy new year to you too!
      2) Yes! If she accepts the visa from them, it's going to hurt NJs case a lot since all their contracts are likely identical - but I highly doubt she will.
      3) They'd be wrong, ADOR didnt reveal anything beyond 'we are working on her visa application', that statement is far too vague to be considered personal information, and everything else around it has been public knowledge - the only visa it could be is an E-6 because that's the only visa for idols that need the company's support. (But yes, everyone is covered by PIPA)
      4) It wasn't ADOR but another organization (I believe KMA/KMF, Korea Management Association/Federation) who demanded that NJs be banned from making any public appearance on music and tv shows. But the JYJ law says that idols who leave their company should not have their appearance limited by any broadcaster unless there is 'substantial reason' - that 'substantial reason' is the problem tho, as it's somewhat subjective.
      Even in JYJ's case, Junsu was only able to appear on EBS (an educational channel in Korea), and Jaejung hadn't appeared on TV until this year, despite settling the dispute with SM 10 years ago. Also, Yoochun hasn't been on tv bc he ruined his career with a drug scandal lol 😅 so even for JYJ, their law didnt do much to help them.
      ADOR hasnt requested that NJs not be allowed on TV, just that anyone working with them confirmed with the company first, which CBS already didn't do - so in short, no ADOR has not violated the JYJ law as of yet.
      5) Please never apologise for a long comment! I appreciate it so much, and I'm more than happy to answer any time 🥰

    I don’t understand how Ador can wait until the case goes to court, if it does indeed take a couple of years. I know they will keep a tally of all the contract breaches which will likely occur during this period.
    However, didn’t several Korean entertainment industries say that new investors will not invest in the K-pop industry because of this. Therefore, surely if Ador don’t do something now/soon, the industry will suffer greatly over the coming years.
    Why can’t Ador gather more evidence and then take NJ to court for breach of contract?

    • @TheHaniverse
      @TheHaniverse  День назад +3

      Honestly I'd say check my last two videos, I explained why ador doesnt want to take them to court to terminate the contract and why they are trying to keep them instead.
      But if I were to add some thoughts: Losing/throwing away an asset like njs because they threw a tantrum is not going to restore investor confidence in the industry, especially when this is happening so close to 5050 and hybe/ador is such a big company. If the no.1 entertainment company can't maintain/restore order, it doesnt look good for the whole industry and makes them all not worth investing in. Investors dont just want their money back, they want a return on their investment and even with the contravt penalty, theres a high chance the girls will never be able to pay it even if the court rules that they should - theyre worth more (money wise) if they keep working.
      Also the low investor confidence thing is not just a kpop issue but a korean economy issue, foreign investment is the main type of investment in korea and it has been down across the board over the last few years - it's actually one of the reasons people hated Prez Yoon before the martial law move. It's a very nuanced situation in Korea rn unfortunately, this is why this case has such a huge impact on the industry.

    I read that having dual citizenship can put you in a conundrum eg if you have both British and another country's citizenship in situations like evacuations, the British can choose to put you aside until those singularly British are evaluated. I don't know whether Hanni will have any allegiance with the two embassies she is associated with. What is said here has nothing to do with her visa.
    PS. People should stop getting wound up about her status in SK. That is not the biggest problem. The problem here is the violation of the contract. Any immigration issues have no value compared to what she and her favourite boss are doing to the Kpop world.

      I have dual citizenship actually! XD British and Nigerian, and both countries have embassies here. Isn't Hyannis residency Hybe? Would hype confirm they supply her residency if she is denying a contract with them. Also, operating within legal limits but skirting the spirit of regulations, seems to be another m.o of Njs and Mhj, this could go against their character witness history.

    • @whk3120
      @whk3120 3 дня назад +7

      Also, unless Mhj has been fully reimbursed her shares money, doesn't her original contract still hold certain stipulations regarding non-compete clauses. These stipulations often remain active until all financial ties are fully severed, so surely they include any "free-lance" roles?

      ADOR is very much 'they are our employees and we are filling the employer role' so I'm not sure they *need* to confirm anything, especially their private addresses - but technically any of the girls can buy their own places if they really wanted to, I don't think the company can legally force them to have to stay in the dorm.
      Also yes, they are drawing a Venn Diagram of 'contract valid' and 'contract not valid' and doing anything they can in that little overlap section so they aren't penalized later no matter the income, but they are playing dangerously close to the lines.

    • @TheHaniverse
      @TheHaniverse  3 дня назад

      Okay the contract situation is a bit complex.
      Starting with not non-compete - this would only stop her from starting her own entertainment business where she would be directly competing with ADOR, they can't block her from all work in the industry as a whole or she literally wouldn't be able to make money. MHJ being the creative director of a vogue photoshoot is not in competition with ADOR at all.
      Also, technically the non-compete clause might not be valid because her shareholder agreement was cancelled from ADOR's end, not MHJ voluntarily leaving that contract (the job she quit after is a separate employment contract for a different position.)
      Finally, they reimbursed her shares, but not with the 13x valuation she would have got as a shareholder, that's why she said she was going to sue them (not sure if she ever filed that suit or now though.) The fact that she didn't get the 13x from the shareholder agreement supports the idea that the non-compete was also not valid because the shareholder agreement was dismissed.

      Okay, you pointed out the thing that I've BEEN saying! MHJ has always shown up with lawyers, but the girls never have at any of their appearances - isn't that strange?? Especially when they are liable for much more damage than she is.
      I personally believe that all the lawyers NJs are using are supplied by MHJ, which means the lawyers technically only have MHJs benefits at heart. Until now, she has faced zero risk. I spoke about this more in my previous video (I believe the dispatch one) - MHJ is smart and she has unwavering trust from NJs, and she's using that to manipulate them while protecting herself. MHJ is not delulu, but I think NJs are.
      edit: Oh also, remember at MHJs first conference, her lawyers were also facepalming and walking off the stage. While she does have good legal representation, they can only do so much if she herself sticks her foot in her mouth - I think that's why all her statements since then have been through her lawyers and press agency, but NJs? All their statements have been their own.

    • @TheHaniverse
      @TheHaniverse  2 дня назад +1

      That depends on the type of F-2. For my F-2-7, I need to have a certain length of financial stability at the time of application, this can be a job or savings. Then at the time of extension, it can also be a personal business or freelance income.
      For the F-2-12 mentioned in the video, if you have 500 mil won to invest, it's assumed you also have enough to support yourself. Even if they needed proof, personal savings would be enough.
      After you've been granted an F-2, you can do whatever economic activity you want, work a regular job, freelance, start a business, not work at all - visa wise, there's no restriction. However Hanni still has an businesses agreement with ADOR she needs to honor, regardless of her visa.
      Edit: also, in every case, you dont need a sponsor, your company have no input on your F-2 visa. You just need to ahow you are economically stable, and you can use an employment contract to do that, but that employer has no relationship to your visa status, and you can quit that job right after the visa is granted xD

      It is rumoured heavily by reliable sources it was Omega who approached Ador to advise of the NJ Manager try to set up advertising outside of Ador.
      Also the Vogue shoot was an already scheduled activity.
      The only activity that Ador has pointed out to be unsanctioned is the interview they did with CBS Korea. It was also CBS Korea that had the only interview with MHJ post that train wreck of press conference she called. Ador has sent the warning shot to CBS Korea they have them in their sights.

      Yes exactly, I think the main question is did Vogue credit ADOR or not inside the magazine - I think no mention of ADOR at all would be weird, but I don't think it needs to be on the front cover.
      And yes, someone else pointed out that the Omega deal was likely official because of how long it would take to set up such a deal.

      Yes! Technically each of them would have their own individual contract, but the contents should be identical, so if one clause was broken, that clause would exist in all of their contracts.

    • @pamelakrause9311
      @pamelakrause9311 3 дня назад +2

      Legal actions take time, Ador has lodged its first case the validation of the contract. Lawyer of Seoul gives an analysis of the outcome of a potential case, and has advised the NJ girls to get independent legal advice, as no lawyer with any ethics working for the girls (key point) would recommend the actions they are taking. He stated Ador will win, and a penalty will be required to be paid if they want to be released. He implied the legal team/advice appears to be for a third party interest, so tampering.

    • @TheHaniverse
      @TheHaniverse  3 дня назад +2

      Oh absolutely, that's why they filed the lawsuit to prove the contract validity - it's just that the existence of the lawsuit calls into question the contract itself, so everyone is kinda making their own rules until the courts decide something - unfortunately that case is just going to take a long ass time.

      No, not really, the visa is granted at moment she invests, and is valid for the full 5 years as long as she doesn't withdraw her investment. After the 5 years she can change to an F5 without any additional investment.
      The real issue is that her exclusive contract with ADOR would still be valid, so she still needs to dispute that to do any other work

    Why all astimeted time us so long, simply law things i. Korea are this lonf ir what , bc in theory it us simple question "is tge contract valid?", they look into it and give the verdict and xase can move, why people think it will take 2 years, when MHJ did this injunction things it was all so fast...
    I understand that later case woukd ve long like this old case with sm and tvxq(?forgot name?), but simply give opinion if contract is legal, really thry need so much time.

    • @TheHaniverse
      @TheHaniverse  3 дня назад +2

      The 2 year period is coming from actual lawyers in Korea monitoring the case, but it's just an estimation.
      On ADOR’s side, it's quite an easy case as you said, they show the contract, show they've been working well and still are, done.
      But NJs will do everything they can to try and present evidence of being neglected, causing there to be multiple hearings and investigation and witnesses, and then ADOR will have to present evidence to the contrary - this is what will make the case take so long.
      For the TVXQ/JYJ situation, they reached a settlement after 5 years - ie, no verdict was actually met. In 5050 case, the court sided with the comoany after about a year, but they were mainly claiming lack of payment which was shown to be wrong. NJs case is more nuanced because mistreatment could be a lot of things and will take more effort to prove/disprove

      Hostile? Hanni nor any of the other members have filed a lawsuit to show proof of any mistreatment by Ador. Saying something is true needs to be backed up with proof. I feel bad these girls chose loyalty to 🧢 rather than working hard and becoming incredibly successful! It could take years for the courts to sort this out. Sadly they don't have years unless they have someone to pay their penalty. I wish them the best but it doesn't look promising.
