    In my opinion, he just had the wrong attorney. Imagine this, what if you get hired to take a picture portray of yourself, just your face, and the contract explicitly says your photo will only be displayed in grocery stores and haircut magazines only, for a hair salon ad only. But then, you see that same picture, your own face on tv, movies, toy stores, fashion magazines, and even newspapers. This goes against the signed contract. Regardless of how your imagine is used and portrayed as (being good or bad depending of publicity) the person who hired you is breaching the contract by not mentioning how your imagine is ultimately going to be used and\or deceiving you into thinking it is not going to be used for more than one purpose. It is not about getting a monetary compensation, it is the contract. If the contract said only an arcade game, then so be it. They should have used their authorization to use their images into a different product. Midway saw their sprites as assets to their software, which is right, but the contract apparently only mentioned one specific product, the arcade version, not a line of products, like console ports. Going for that approach could have just make him win. The "I want more money because you are making more money'' claim has no solid ground to win in a court. For that reason, kids: MAKE SURE your contract explicitly indicates your role and the extend of your role as well as the assets you produce for your company and how the company can disclose/use it. If you allow them that discretion, you are just a worker, a director, not a creator or an author.

      pandaumk3 this is wrong. the right comparison would be like this: you get hired to have your picture taken to be in a haircut magazine for a particular hair salon. then that salon releases the same magazine for people at houses who want to compare haircuts at home. its still the same product. its similar with the video game, unless the contract indeed stated that its going to be released on srcade machines and on those only. it was just called an arcade video game. the could call the home versions an arcade video game too, just ported.

      We can agree to disagree. Because the contract must say the work is going to be used for one specific product (or publication for the comparison we are making now) only, the moment you deviate the original publication into another product (TV or movie ad), you are breaching the contract anyway. I allowed you to put my face on hair saloons and magazines, but my face on TV and movies without my consent is not right. I think pointing that distinction certainly could have won the court in favor of Mr. Pesina. Unfortunately if there was just one vague paragraph, it could have been interpreted many ways, but again the approach made at the time was not the right direction.

    I used to call Johnny Cage in the first MK "Yo ni Cagué" (spanish for "I didn't even took a shit"). And the original arcade cabinet with Pesina at the sides was badass.

    Seems to me like they did him wrong. The series suffered for it too, base MK3 left a ton to be desired. The missing ninjas, cage and Raiden are a huge let down. It was clear to me even as a young child that something was wrong. Crazy to hear this is what went down. Can only imagine what MK3 would have been like if he was there all along...

    Well, I guess this goes like this.
    Pesina advertising for the wrong game. They fire him.
    Pesina sues Midway, it backfires at him.
    Midway removes all Pesina's images, which sucks.
    In the Kombat Kon, he seems to be in good terms with the original staff, except Boon, since Midway was bought by WB Games.
    So... We cool?
    Ps.: You forgot the cabinet in MK vs. DC. But everybody hates that game even when are worse games as Special Forces or MK Advance.

    Mk 1 had the best game my 2 didn't do it as well because of the first time you saw a fatality it wasn't as shocking. By the way sub zero and Raiden had the best fatalities in the first one and is still better than anything they had done afterwards for all of mk games mk 1 looked realer than the rest mk 2 look a little bit more cartoonish compare to the first and done even get me going on the 4th game SHITE

    This is just what happens when you have a bad contract, sometimes when your working hard you need to say there and then, “I want to renegotiate my contract”, if you offer work or help outside of your contract you can’t go back or get ask for money after the fact

    That is not the whole story.. According to information you find out there, Midway had cut ties with him after he participated in marketing material for BloodStorm, another fighting arcade game from a competitor. Daniel Pesina denies this story but there are a bunch of photos of it out there.. It came out in the EGM magazine even. He got pissed for being "fired" from the MK series and not coming back for MK3 and decided to sue them for whatever reason he could find.
    Besides, his complaint is just childish and that is not how the world works. Actors and voice actors often demand extra payment when the product they are in gets re release or ported over other formats.. this pitch never flies. He was paid for his time and work done in the game.. doesn't matter how many versions or iterations the game received... He can take it to court all he wants. Will never win.
    Imagine if every actor would demand extra payment for a film every time the film gets released in a new format.. VHS, DVD, BluRay.. lol no! They did their job, got paid upfront.. the material belongs to the publisher period. What a dickhead. Want more money? Go do some more work.

      Nope. At the time the game was being made I bet the contracted said something like "arcade video game"... which was late saw by Daniel as a loop whole to try to squeeze some money from them by being like: "Oh it said arcade... they didn't mention anything about console video game"... Come on.. he was just mad and trying to get back at Midway. Everyone has the right to sue anyone for any reason.. but you will lose time and money by doing so if you don't have a case.. he didn't and he lost.. obviously.

      Fact is.. he sued Midway and he lost in court.. which means Midway did things legally. What you mean they didn't give him credits for console version? They did... you beat MK on SNES and you see Daniel Pesina's name all over the place when showing the characters he played.

    johnny cage used to be an o.k character at best . ever since mk9 he´s like the very best ( at least to me ) top tier and over all cool .

      I think MK was based on VanDamme and he was suppose to play the lead who later became Johnny Cage because they couldn't use VanDamme. it's on RUclips somewhere.

      Daniel was the one who sued Midway, not the other way around. They promised him they were going to pay him a bonus if Mortal Kombat was successful, but they never did. Basically the game made money, but Pesina didn't and that's what led to the lawsuit.
