First off, for those who say there is no law that you have to pay income tax please see this video: • Do you REALLY have to ...
I created it because so many people want to (rightly) believe the income tax is unconstitutional. Yes, the income tax in unconstitutional, but IT IS THE LAW. Trust me, I represent people in actual criminal court and have seen what a grand jury does and what the courts do to people who try to claim the IRS has no power. It does not end well when the IRS catches up after 10+ years.

O.k. to answer some common questions and pointed criticisms:
(1) the side burns are now gone. They were even bigger in my wedding pictures. They were referred to as those "d.b. sideburns." It why we have no wedding pictures in frames (and to think, I'd ruin the day by being drunk).
(2) the scary lady was not in the room when I was interviewed. I never met her in my life. You could imagine my surprise when I watched this for the first time.
(3) This was filmed in February of 2008. I am a bit fatter and a lot grayer now.
(4) There was a TelePrompTer present, but I did not use it! I actually ad-libbed off the script. I was going for sincerity.
(5) But I think the content, while a bit too salesy, is kind of true. People do not know how to talk to the IRS. They tell them stupid things all the time that totally hangs them. Or they hire one of those cheapo JK Tax jerks (or whatever they're calling themselves today) who rip them off and sell them down the river to the IRS.
(6) My mom thinks I did a great job.
(7) Also, my wife, who went to USC Drama (and like so she knows people who are famous) also says "that's certainly a youtube video. I really think you hit your potential."

Its true tho. They will use anything they can against u. Its sad. We didnt do anything wrong, but lost our stuff from someone stealing our stuff from our storage unit. We tried just doing it ourselves, and just fucked ourselves. Its so messed up. After that, they ended up auditing the next two years as well. Its messed our whole lives up. Dont even really know what to do at this point. Truly breaks a person down. Smh.
It's even worse now ten years later. Add 700 more people to that total.

Libertytree Tv Here's the *actual* law behind the IRS levy authority, in which the Constitutional _prima facie_ law at 26 U.S.C. 6331(a) is merely the current, and somewhat distorted, codification. This is in Volume 53 of the Statutes at Large.
_Part II-Assessment, Collection, and Refund_
_SEC. 3310. RETURNS AND PAYMENT OF TAX._
_(a) MONTHLY RETURNS.-All returns required to be made monthly by any person liable to tax shall be made on or before the 10th day of each month, and the tax assessed or due thereon shall be returned by the Commissioner to the collector on or before the last day of each month._
_(b) OTHER RETURNS.-All returns for which no provision is otherwise made shall be made on or before the 10th day of the month succeeding the time when the tax is due and liable to be assessed, and the tax thereon shall be returned as herein provided for monthly returns, and shall be due and payable on or before the last day of the month in which the assessment is so made._
_(c) ADDITION TO TAX IN CASE OF NONPAYMENT.-When the said tax is not paid on or before the last day of the month, as aforesaid, the collector shall add a penalty of 5 per centum, together with interest at the rate of 6 per centum per annum, upon such tax from the time the same became due; but no interest for a fraction of a month shall be demanded: Provided, That notice of the time when such tax becomes due and payable is given in such manner as may be prescribed by the Commissioner._
_(d) DEMAND FOR TAX, PENALTY, AND INTEREST.-It shall then be the duty of the collector, in case of the nonpayment of said tax on or before the last day of the month, as aforesaid, to demand payment thereof, with 5 per centum added thereto, and interest at the rate of 6 per centum per annum, as aforesaid, in the manner prescribed by law; and_
_(e) DISTRAINT.-If said tax, penalty, and interest, are not paid within ten days after such demand, it shall be lawful for the collector or his deputy to make distraint therefor, as provided by law._
Note that the above actual law makes mention of "monthly returns," and "returns for which no provision is otherwise made." This *does not* include simple annual filers.

Dont hire a joker that gets paid to help the government(IRS) get more money out of you. If you want to have a better understanding of the ACTUAL LAW and not just their code, read Income Tax Shattering the Myths by Dave Champion. It's long but worth it.
This guy doesnt want you to talk to them at all because he wants a cut of what the IRS wants to steal from you.
I would venture to say that theres a decent chance i know more about income tax law than this lawyers advert. If he knows more, then based on the video, ima say hes a con man stealing your money just like the IRS.
The basics of the law isnt super complex. It becomes complex when court cases and the IRS want to try and add "clarity" to some parts and then use certain language(that sounds like plain English, but is actually legalese(legal speak) instead) to describe who needs to pay and how to file returns.

@@JohnSmith-qr4vt thank you for that information. And can you get that from Amazon? Also thank you for your opinion on this matter regarding the IRS. I can assume you had some bad experiences. (Not knowing your situation, I couldn’t really place an appropriate adjective for that. ) I still would like to know where to get a pdf of the tax code for informational purposes. I don’t aspire to be a lawyer but it is fascinating.
Easy fix; do away with the IRS and goto a federal sales tax. It will work similar to FairTax proposal. EVERYBODY pays, it's not complex at all. Everything u buy will be taxed at a pre-determined amount for everyone except for maybe necessary food items and prescriptions. The people that write the tax code are rich members of congress that help big business/their buds by passing tax laws for them. The federal sales tax will make all of this crappy code and the crooks that make the laws go away. Keep maybe 10% of the IRS employees to collect the money from the states and deposit it into the proper accounts like; general fund and Social Security. Give the rest a ticket to the unemployment line! The government is way to big for the good of WE THE PEOPLE!
I would add a fourth thing. Be polite when communicating with the IRS. They have a bad attitude to begin with. So don't make it more difficult for yourself by being rude.

But seriously, yes, this is a promotional video that tries to at least hint that the "friendly" IRS agent or officer who wants some info from you may be just about as well-intentioned as a police officer who wants to have a few words back at the station, to "clean up a few things." With a further points that maybe having having a tax lawyer on your side is not the worst thing. Now otherwise in re: ambulance chasing, perhaps you have a fair point. This does come off heavy handed. I my defense, I recorded this in February of 2008, when we were all a bit more naive, and I concur that this video is not all that content-heavy. They don't understand it, especially section 83. They never teach employees about section 83. If people apply sec 83 first, they will discover they have no taxable gross income from personal labor.

He does go over some of the code and other rules and regulations as well. He then explains different false(illegal) methods people try to do to get out of paying and end up with big fimes and jail time. He said most he knows of arent wrong about not being liable for the tax, they were just wrong in the method used. He explains why some of the most popular methods are wrong and illegal. Its a good, informative read.

I accidentally check the someone can claim you as a dependent box in non filers tool on April 17th 2020 than it delayed my stimulus check. I called the IRS than told a representative I accidentally check the someone can claim me as a dependent box in non filers tool on April 17th, I'm getting just an SSI and I had not get the stimulus check. He told me I had to fill out the 1040-X Amended form in order to receive the stimulus check this year. I fill it out along with a SSI award letter and the letter I wrote them than mail it to the IRS in Kansas, MO on June 22nd.
Would the IRS improve my 1040-X Amended form if they see i'm just getting SSI which it is not taxable and can a person on SSI be required to fill out the 1040X form if they made a mistake and would it help me get the stimulus check this year ? because I wonder why I am still getting an error message in where is my amendment and in the number 1(866) 464-2050. It keeps on saying: No information available yet in the application, please check again later. But it has been 4 weeks since I mailed it on June 22nd 😞 Now I am thinking they rejected it because I am getting SSI 😢
And what should I do ? because I tried my best to be very nice to the IRS and it's becoming very confusing and very frustrating to me 😢

No, what you say to the IRS is? I do not volunteer for the tax program. I do not wish to participate, and anything that you may have gotten from me? I wish to have returned.. You do NOT owe them ANYTHING. And learn who does. It isn't a worker. Your labor cannot be taxed. PERIOD. So simply tell them you are not participating, and they will leave you alone. I wouldn't worry about what to say to the IRS. I would instead worry about knowing the laws and my rights which clearly states that paying income taxes is completely voluntary! There is no law or statute that requires payment of this bogus tax created by greedy privately owned organizations! The Constitution in this case is your greatest asset, and of course informing as many people as possible helps a lot to.........there truly is strength in numbers!

There are many CPAs who specialise in Federal income tax, and they are cheaper than lawyers. If the IRS asks to talk to you in person, or sends you a written request for documents, you are entitled to have a CPA speak and write on your behalf. Hire a lawyer who specialises in tax only if your CPA advises you to do so. I would advise all self-employed persons, and all business owners, to have their taxes done by a CPA. The CPA who signs your tax return has a professional duty to be your advocate should the IRS dispute your return in any way.
Never volunteering information to the IRS is comparable to being a witness in a trial. When answering a question, just directly respond to the question and be honest.

Everything that Hitler did there was completely legal, passed by the government and upheld by the courts. Also, you said the income tax code is so complex no one understands it. But should that be legal? Should the government be able to pass laws that they don't read (such as the Patriot Act and Affordable Health Care Act) or that are so complex no one can understand? Does that facilitate freedom or tyranny?

Is this correct: If you made your money on - like - investments then you own tax to the United States Government constitutionally. Normally you don't pay taxes on your wages; your employer does (Withholding) and you have a chance to recover any over-payment they made (Tax Return). And then filing for a Return constitutes some sort of contractual obligation considered voluntary? I'm just learning about all of this and am trying to get it to make sense. Is this anywhere close?

The IRS is not federal. Its a private company. You also do not owe money to a 3rd party bill collector, but do owe a debt to the 2nd party you contracted with. So technically the United States of America has to take you to court to sue you for taxes owed to them and not the IRS. No 3rd party bill collector can legally collect, no contract with them.

People not paying taxes blows my mind. My parents drilled that into me and my brother's skulls. PAY TAXES. If you're broke, file. If you're doing alright, file. If you're rich file.
How about ask for a warrant. You have a right to be silent don't you?. You have a right to be secure in your person houses papers and effects against unreasonable searches and seizures don't you? You have a right not to be a witness against yourself and by complying without a warrant you are giving them information that they can use against you in a court of law, are you not?
Did you just get out of prison? You were gone for almost a year, no posts at all for 10 months. Have any withdrawal symptoms?
However, if you think that in the next 10 years, you will be making more money (or come into money) then it may be worth it to attempt an Offer in Compromise --- soon. Because if you do come into money, or start doing better, the IRS is going to be there with their hands in your pockets, sending your right back down. Oh yes Rod. I know you're not spamming. I appreciate your sincere comments. The law gets to define what the law is. People have little voice. That's the sad truth. I think there there is a total moral, intellectual, and legal basis to claim that the income tax is a grotesque monstrosity. For some one to take that route, it means they must rely on jury nullification -- which is actually one of the reasons the founders demanded jury trials. Juries are to be the last protection. Be careful.

UCC 1-207 and UCC 1-308 provide remedy and recourse from any state or federal corporation, and also reserve your God given rights as opposed to the rights exchanged when you became a citizen. These were contracts you were tricked into and never consented to, so this british agent here is full of dung. Go educate yourselves on your strawman, (the one this guy gets paid to keep you in the dark about), and the natural man, that has rights that get you out of all their traps and schemes. without prejudice people, you really need to learn about your true rights and where they come from.

Partial credit. The relationship between the IRS and the Fed is quite suspect...both coming into existence within a few weeks of each other. And yes, you don't actually have to file a form 1040. but you do have to file some sort of return with all the information that goes on a form 1040. The 1040 isn't for a 1.1-1 income tax, because the Code Of Federal Regulations parrell table of authorities cross reference form 2555 with OMB No.1545-0067 according to the OMB # ? The 1040 with OMB No.1545-0074 is the wrong form for the income tax.
Privacy Act Statement and Paperwork Reduction Act Notice says "no person shall be subject to any penalty for failing to comply with a collection of information if it does not display a valid OMB control number."

The IRS cant even come up with a appropriation showing you have to pay income taxes.
God, that would be the greatest thing to happen to man-kind in centuries! We are not truly free people if we can't opt-out of income tax on our labor (and not be punished for it). Also, we should be allowed to choose our currency and not be forced to use a debt-based currency issued by a private bank.
How about the STOCK act? It limits congressman's ability to trade on inside information. You would think that this would never pass through since it hurts the lawmakers directly. HOWEVER, it did pass because the people were educated and demanded it pass through or they would hold the congressmen accountable in the election. Paul's budget is exactly what we need. If people are educated on the risks of debt they will demand that it pass. Dr Paul is educating people. He earned my vote, too.

Somehow with penalties and interest my IRS bill went from around $44,000.00 to over $60,000. They were garnishing wages and the bill still wasnt going down. Seems like the IRS is doing something crooked here.
FYI, though that was the prevailing legal thought at the time, both cases above have since been overruled for over 50+ years.
I'm glad to hear a lawyer tell people shut up and answer only what they ask. It is so hard for these business owners to just shut up and stop bragging about their business especially when they don't have all their documentation legible for anyone else to just find a simple answer. Explaining your business plan and growth and how organized is doing nothing but hurting you when you can't answer direct questions or show that you love to answer a million more.

He is right when he says do not give the IRS any information they do not ask for. The purpose of asking the information is to obtain ways to collect the money. Once you reveal unsolicited information the IRS will use it as leverage to collect.

If someone like the IRS employee can lie to me without penalty but I would be guilty of a crime if I were to tell them a falsehood I have a great sense of mistrust in those people. The bad news is that the debt is getting bigger and bigger. But then there's good news as well, because, for the most part, the IRS loses its ability to collect after 10 years (provided you don't file bankruptcy, file an offer in compromise or leave the country). CNC is a great temporary solution that can lead to a permanent solution. However, one thing you need to ask yourself is : is you lower earning capacity permanent? If so, CNC won't be so bad.

There is a distinction between being unconstitutional and being legal. Is the IRS unconstitutional? Probably. Is it the law? Absolutely. As intellectually fulfilling it would be to tell the IRS to go pound sand, there are horrible consequences for being doing so. I would love to see someone mount a constitutional challenge..it's got to be done right...(1) comply with Code (2) then file suit in district court for refund then (3)???...start w/ small novel issues to pry open public perception.
No need to go to court if the corrections are done and a proper filing of the 1040 is done. What happens is a payer sends in an incorrect info return which goes uncorrected and "what law" is brought up thus resulting in a mess. The law is the uncorrected info returns someone made in ones stead.
If you have the right to remain silent, surely you don't have to submit a tax return. They are demanding potentially incriminating information. In law, you have the right to withhold information that MIGHT incriminate you.

26 USC 7805 says that the secretary shall prescribe all "needful" rules and regulations for the enforcement of the title. That is to say that the code is not self executing. It must be promulgated be regulation. ( The fact that the code is not the law but must be executed by regulations is supported by US vs Dodd and Murphy vs US ). Be careful.
