Filing an I-130 and an I-485 Separately?

- Those in the know that for many green card cases, you file the I-130 Petition for Alien Relative right along with your I-485 Adjustment of Status application. But there are some times where you need to file the I-130 first, wait for it to be approved and then file the I-485 at a later date. Jim discusses these scenarios in today’s video.

Thank you so much Attr.Jim Hackin,youre so inspired,i really dont know how on earth you speak Basically what people need to know..a Fruend is on this very Status..the difference is just that his Spouse keeps abusing,kicks her out of the house about 7diffrent occasions,and they both have a Child..the 8th time he kicks her out,she got injuries and she had no choice than to call the police,she thinking of filing for Vawa..is that an advice..theyve been married for almost 2years..but her i-130 is still pending and for about a year now..whats your advice?..can one still wait on the i130 and still file for vawa at the same time?

Hello, I’m a U.S citizen and I’m fixing my moms status and I didn’t know that I was supposed to file them both at the same time so I sent my I-130 online. What can I do now? I’m ready to send the I-485 with all the other forms but how do I prove that I already send the I-130? I know that I don’t have to wait till the I-130 is approved cause I’m over 21, I’m a U.S citizen and my mom is inside the country. Can you please help me with that? Thank you!

I filled i130 for my parents and i uploaded all the records documents online.Then, they ask me to fill the I 485 form. Do i have to send any document along with it, including the affidavit of support and the court record for them or not.

USCIS approved my I 130 but they denial my I 751 because my husband was about the country for more than one year& a half for work Can I refill my case for my own I 751 by my own. And start over an get a divorce.

Does a green card holder can file the I 130 and the I 485 at the same time ? While the beneficiary had already the permit work and ssc ?

In may2021, my son (us citizen,21yo) applied for my I-130 online but we I didn’t know we were supposed to file I-130 and I-485 both at the same time. As of September 2021, they are actively reviewing the case. May we send the I-485? Do you think it's a good idea? Thank you.

I did I -130 and I-485 after searching a lot. So I ended sending both of them at the same time for my parents. However, I have a friend that her mom is not in USA and I am not sure about that, since my parents were in USA when I did all the paperwork. The only thing they did was to give us specific times to send extra information. I sent everything really fast, because I didn't want for my parents to leave the country.

I submitted both forms together. I received an evidence request for both forms. Do I have to send in 2 copies of the evidence or will one be sufficient?

Can I send first the I-130 and then a the end of month I-485 I am married us citizen the reason it’s cause we have no money for the I-485 until the end of the month ? Would we have problem?

What if you're doing the 601A and then get legal entry and switching to adjustment of status? The i130 is already approved.

Hi so I filled for i-130 for my daughter and she got a receipt but it’s been more than 90 days and her case hasn’t been approved also I want to know if the I-130 comes with a green card

I did receive the receipt for i130 and i included it in the i485 packet. It was accepted as concurrent filing.

Is it possible for I-131 to be approved for a person under VAWA, but the VAWA itself is not approved?
Asking for a friend, her advance parole was produced, she travelled outside the country and came back. But her VAWA, EAD, I-485 are all still pending?? 29 months and no approval notice after they received RFE. Is that normal?

Hi Darian, for Canadian spouse of a landed US immigrant (PR holder)with a visit visa applying to adjust status in US , is one eligible to apply for I 130 separately? Coz we got rejection when we did and are asked to apply for both I130 and I 485 together ? Can the Canadian spouse remain in US while applying concurrently as well. Thnx

My question is if the sibling came in the us with a legal entry with DACA do these two forms have to be filed together? As both applications are taking long due to backlog with USCIS.

Thank you for the information. My husband has filed I-130 in March 2020 he is a green card holder. I have valid B1/B2 visa. We are waiting for I-130 approval. In visa bulletin PD is current for F2A category. Can I file for status adjustment.

What about applying for employment based I-140 and I-485 concurrently with visa is currently available? Does it expedite the processing of my case? I’ve done the concurrent application with premium I-140 processing. and medical included. The I-140 was approved in one day after an RFE submission. Waiting for 3 months and a half for now for the I-485 to get approved

Filing concurrently won’t expedite the processing of the I-485. You still have a few months to wait for that to be adjudicated.

You can travel when you get your card and will need to show that when you come back to the US. All the best.
I believe once you got your card you can travel right away. But I am not sure about that. The only thing I am sure is that you can't be outside of USA for more than 6 months. I'll say 5 1/2. To be safe.
