There is no H4 approval notice as she directly went to stamping on H1B approval notice in India. She has latest I94 and Visa stamping. These two documents are good enough or do we need to submit any additional document in place H4 I 797 approval notice ?
My son is holding h4 visa under my wife's H1b. I am also holding a H1b. And my 140 got approved. Should my son apply for a new H4 as my dependent before filling his EAD? Thank you!

Hello Mandar, thank you for creating such informative videos on the various topics related to the immigration. I would like to know if a H4 dependent child (unmarried under 18) can be eligible for an EAD if the primary H1B visa holder fulfill the criteria (approved i-140).
I am a bit confused about the category with which I have to apply for my EAD. Is it C09 or C26? My wife will be getting her I-140 approved for the first time, in next 10+ days. And her H1 is valid for another 16 months. I have applied for H4 COS (5.5 months ago) but, don't have the approved notice I-797 yet for my H4. Can I go ahead with EAD application, with her I-797 and with my I-539 receipt?

Can we get H4 EAD without I140 ??
As per USCIS,
Certain H-4 dependent spouses of H-1B nonimmigrants can file Form I-765, Application for Employment Authorization, if the H-1B nonimmigrant:
Is the principal beneficiary of an approved Form I-140, Immigrant Petition for Alien Worker; or
Has been granted H-1B status under sections 106(a) and (b) of the American Competitiveness in the Twenty-first Century Act of 2000 as amended by the 21st Century Department of Justice Appropriations Authorization Act (AC21).
I wanted to check if Rule 2 is valir or not.

Sir, my H1B is approved, but my wife's H4 extension is still pending with USCIS. Can I apply for her H4 EAD now, or wait for her H4 approval and then only apply for H4 EAD. Please advice. Thanks
H4 EAD can be applied based on pending H4 which is based on approved H1b. So go ahead and apply.

Had one question. Currently application for I-140 has been submitted for approval under premium processing. My current 797 will expire in July 2021, so will apply for extension somewhere in Jan 2021. So kindly wanted to check once my I-140 gets approved so shall I apply for h4 rad or have to wait till next year to apply along with extension. Pls advice
You can immediately apply for your spouses H4 EAD after you get your I-140 approval

Not sure who is asking the question H1B holder (husband) or H4 EAD holder (spouse). Regardless I got your questions. H4 is dependent on valid H1B and EAD is dependent of valid H4. So even if your husband changes his job and does H1 transfer, you can also file H4 extension along with the transfer as well has apply for new extended EAD. Your current EAD extension may not be processed as you new H4 and EAD will be pending. It all depends on the timing.

I have a query on H4 EAD. I was with an Employer (Say A) where my H1B and H4 was valid till Aug 2023, but recently I joined a new employer (Say B) . Employer B filled my H1B transfer and it got approved till 2025, They also filed the H4, I received the receipt notice but yet to receive the Approval for H4. I this situation, can I go ahead and apply for H4 EAD? or I need to wait until my wife receives the H4 extension approval and then file the H4 EAD.
Hello Mandar, there are so many speculations around recent H1B saying it's gonna put all new applicants on hold for se time.. can you provide update on that please.. also what can happen if trump put new applicants on hold , till what time lottery results are valid, can this year lottery approvals apply for next year as well

Hi Jyothi, She should first try to get a job in California if she has an OPT with an employer who will file her H1b next year. I am assuming she is working in Boston on OPT. If she goes on H4, unless her husband has approved I-140 immigrant petition, she will not be eligible for H4 EAD.

Now if I go for emergency H4 stamping in India and travel back to US, will I be able to work on H4 EAD or will there be any restrictions as I travelled on emergency stamping.
