Well, there is a very slim chance that the ship *unintentionally* let its anchor sink down to the seabed and then *unintentionally* pulled it out of the water while describing a loop in an area signaled as not suitable for anchoring due to submarine cables (as attested by Coast Guard surveys). Therefore, conditional could be still used, but this is nonetheless bottom fishing not allowed, at least I'd say. The same happened when two data cables were sectionned by a "wild" anchor from a chinese/russian ship, not so long ago.
