Buyer beware of Sany machines! Warranty is void by manufacturer if sold at auction. I lost $$$

  • Sany keeps this information hidden but I feel it need’s brought to the public’s attention. Any Sany machine currently as of May 2023 that is sold or has been sold through an auction in the past has no warranty even if it has remaining factory warranty! Sany will not cover anything under warranty even if the machine is new because it’s been sold at an auction. So don’t make the same mistake I did buying a 2022 Sany excavator with 300 hrs from an auction and try to get warranty work done on it. We reached out to Sany directly in Georgia and was denied several times, we even tried to buy an warranty from them to keep our customer happy that we sold the machine to. I feel that this is very bad business on Sanys part and everyone should know about this so they don’t get burnt like I did. Please share this video so we can make this public because they don’t want you to know about it!

    Finally got a copy of actual warranty from Sany they are hiding from everyone, Its pretty vague on what's covered and not covered. I just hope other people will see this and not get burned like me!
    We could not find anything on the internet and even Sany would not respond to an email about providing it to me, I got this from the local dealer that has been helpful so far in all of this.
    Here is the last paragraph from them.... let me know what you think
    Transferability: Upon selling a SANY Product still covered under this Limited Warranty,
    contact your authorized SANY Dealer or SANY America Inc. within 15 days of the sale
    date. Upon receipt of the above information, SANY will confirm the applicable remaining
    warranty coverage. A transfer of warranty coverage for machines purchased at auctions or
    machines obtained from or considered salvage is not possible.

      The Sany dealership that supplied the machine to the auction should have been well aware (or ought to be aware) of the warranty Transferability exclusion. They lied on the auction info and should therefore be liable for any repairs, including future repairs within the warranty timeframe!

      Hummm🤔looks like they are definitely looks like their covering their butt. Its not just them its pretty much everyone. My volvo semi started running funny. Stopped at dealer and he told me yeah theres a service bulletin on that repair. I asked why i wasnt notified so when i was home i could drop at my dealer for repairs. Flat out told me because it wasnt a safety issue they only repair trucks that come in with the symptoms. So i ended up flying home because of lack of parts. 3 weeks later flew back and went back to work😡

      Is this the warranty verbiage that was in effect when the original owner purchased the equipment? Or did they change it a later date?

      Several thoughts on this mess: although most auction sites have hold harmless language in their fliers and contracts, I would think that the auctions themselves have some liability in this matter, particularly if this issue has been in effect since 2018 or so. This is exactly what class action lawsuits are designed to seek redress.

    Looks like the resale value for Sany equipment just went down the toilet! On a different note, one again C & C does what it needs to do to make things right!       Very interesting. A low hour machine that goes from dealer to auction? They should be able to resell that machine easily and save the auction commission and potential lowball price. Makes me think that the dealers aren't happy with these machines if they can't sell them outright. And if the auction house just says, "Hey, we publish what we were told by the seller", then I have a real beef with a dealer pulling that kind of crap. They should know the T&C of the warranty better than anyone else. If the dealer is representing to the auction house that the machine has a warranty, then it better have a warranty. I'm going to agree with the above that I think someone is purposefully doing this.

      @@bigpatrck2 I agree the auction house should share some responsibility when they are told that the warranty is transferable. I would suspect that most auctions will strongly think about offering to have Sany machines on their lots. If Sany doesn't have a change of heart, they may find that selling new machines will be a lot more difficult. It is a shame, as I had heard that Sany made fairly good equipment, although I have also heard their wind generators are not very good.

    This is another example of a manufacturer not standing behind its product. I run into this all the time in my own field of work. It's one main reason my Dad and I never ever trust what we're told until we have the written paperwork and details in hand and have consulted a lawyer to know exactly where we stand. It sucks and is costly, and is extremely hard to express to your customer, and hurts your business. Keep the faith Clint your doing the right thing!

    I'm pretty sure this will eventually become a class action lawsuit because they are indiscriminately choosing coverages.
    I believe most states already have laws about these kinds of deliberate false advertising, whether it be the dealers, auction house, or private sale.
    It appears that Sany is going to end up out of business very quickly when people understand what's happening.
    Like you said Clint, most rental companies auction their used equipment for simplicity and efficiency, as well as many other equipment companies.
    My suggestion to you is check with Indiana Better Business Bureau and state warranty laws to see what possible options you and your customer may have in this situation.
    I understand trying to work with Sany, but it doesn't seem like they care about integrity or having a good reputation.

    Glad you put this out there Clint. People need to know. I've used a Sany before doing ditch work around our property. Was a rental and ran fine, but sure glad nothing happened now after seeing this. I'm sure it would cost me an arm and a leg to repair. Thank you for letting us be aware!!!! If there is one person I can trust about equipment like this it's going to be you.

      Seems to me if a piece of Equipment is OWNED by a Rental company, THEY own the equipment warranty. If they SELL that equipment AT AUCTION, then what Clint is saying is likely true - and I can understand Sany's position - no one can confirm the maintenance on a machine when sold thru auction.

If they make the warranty a big point on their sales decks but would void them auctions **and** rental machines, that will severely limit their reach into the American market.

    You should speak to a lawyer. The Moss Magnuson act covers warranties in the US. It specifically says that the warranties cannot be limited to the original purchaser.
    I have run in to this several times with companies refusing to warranty parts that I install myself. That is also not legal. Luckily I have not had it bite me, but if it did, I would be talking to a lawyer.

    Thank you for the heads up. We were looking at Sany for another excavator for our company . I will buy one used at a (substantial ) reduction in price due to no warranty .The resale on these later model units will suffer if no warranty is available .It may turn out to be a very poor business decision on Sanys part.

      It will destroy them in the longer run.. Value of new is reflected in value of used. If a buyer will take a bath on used sale value, when its time to buy new again, they won’t. Its cheaper to buy a brand that holds value when sold into pre-owned market. Deere and Volvo just got a huge market boost. No financial officer will allow purchase of equipment that has lowest return.
      This stupid short thinking greed move could kill Sany in this market.

      So at the end of the day everything is sold as is where is through most auctions
      The auction company I bought it from got false info about it probably from the “dealer”that sent these to the auction. The consigner that sent these to the auction told them they had the warranty left more then likely
      I am not blaming the auction company nor hold them responsible.
      I could probably get this situation resolved for a one time deal on this one machine but I want everyone to know about this, because several auction companies have advertised machines this way and they probably don’t know about this either
      Information needs to be public and Sany needs to step up and make this situation public knowledge so more people don’t get burned
      I don’t want to hurt my reputation with auction companies because that’s my livelihood.
      At the end of the day it’s Sanys fault period

    Like you said, 99% of construction equipment will end up at auction at some point in its lifetime. So that tells me that basically the Sany 5y/5k warranty is a honey trap.

    Hope this video causes Sany to take a massive hit in the wallet. Ya straight up made an honest sale based off “known” facts. They want to crawfish now on their warranty. Hope that ya and the customer can come to terms and settle it out. Hope it don’t cost ya a repeat customer now. Don’t blame ya for not getting or offering anymore Sany machines. I would like to see the contract as to 2nd hand buyers not being covered if bought at auction.       I agree abstractly but the practicalities are that the auction house can not verify any claims about the dozens and dozens of machines they sell. I suspect when you sign up as a potential buyer at an auction the fine print says that all claims they publish are provided by the seller and any points of contention must be verified by the buyer. Still, Sany's no coverage policy stinks!!

    It's good for someone like you to bring this to light. Sany has a chance to compete with the big guys with the high prices of equipment right now. But not with this policy. The warranty would be the only selling point to me from a off brand company. Thanks Clint!

      Sany is one of the biggest manufacturers of construction equipment in China. Liougong is another as well as komatsu and Cat and some other western companies. But China has probably 20 different manufacturers. The machines cost 1/5 the cost in China as a US Built Cat or John Deere new machine in the US. So selling in the US is a gold mine for these companies.
      At cat, we took a chinese manufactured wheel loader apart. All of the bolts and hardware were not hardened grade 8 hardware like Cat uses. With that you can expect joints to loosen and machines just won't last. Not sure about Sany, but I would definitely look over the machines checking bolt heads. Chinese machines competing on price in the chinese market are not built to last. We cut apart chinese ROPS structures from wheel loaders and found really crappy welds covered by bondo. Excavators have Fops not Rops, but still you really want a track record of following the laws and passing the ROPS tests if you put somebody in the seat.

    Yeah this isn’t a good look for that company. Sounds ridiculous that a machine with 200 hours that’s a year old is no longer under warranted because it was sold at an auction. Now if they cut the length of the warranty in half, fine, that’s compromising, but that still would suck.

      How is it not common knowledge Sany have been operating in the USA since 2006!!, If a company doesn't want to allow their warranty to be transferred through auction then fair enough IMHO, but how do the auction houses not know this by now. I agree that Sany is making the decision to not honor their own warranty for a pretty flimsy reason imo but I also think these auction companies could do better at vetting the information, after all it is the Buisness they are in right? Once the auction company has been notified of this issue Sany adds should no longer include warranty info as there is none!

    There will be many Sany owners reading their warranty documentation very carefully. Low hours equipment often moves through the auctions before ending up on an another dealers lot, I wonder what would happen to the warranty then?

    That is one stinking awful situation! The auction companies don't come out of this mess exactly smelling of roses either especially if they don't pick up on this issue straight away.
    There is absolutely no doubt in my mind that this warranty issue has been used by vendors to raise sale prices to ignorant prospective buyers with this miss-information.

    It's said every Chinese business ( a la Sany)... is 100% controlled by the CCP... shows us again what type of people they are. A 5yr, 5000 hr warranty is highlighted in their sales literature - but like most sales claims...they're easier said and harder to fulfill. Bet users experience other holes. Good for you Clint for standing with your customer...and for sharing this with others.

    Thank You for letting us know this about this very unethical way of Sany conducting business. These machines just entered our market here in Ohio and they are really pushing them, but after this practice I will think twice about buying one. This does say a lot about you standing behind what you sold, you will get repaid by being a stand-up company.

    Fantastic that you shared this information! The auction house should have disclosed that information!! The dealer that sent those machines to auction should have made that know!! Sany shooting themselves in the foot…terrible business practice!

    This is quite a development and I’m not familiar with many precedents for warranties not transferring to new owners.
    I was very cautious about SANY machines (to be honest, any machinery coming out of China makes me skeptical) and had seen one of the local rental yards putting a lot more SANY equipment in their yard. Thanks for putting this information out, sorry that you got burned but it will definitely help a lot of people going forward.

    Sure glad you brought this to light. The auction companies need to know so they aren’t false advertising that they are covered under warranty. Definitely not a good move for sany, they should stand behind their equipment no matter what for the 5 year 5,000 hour warranty. I can understand a flooded machine, but to stop covering because of those experiences is not a good business move. Like you said this is definitely going to hurt sany.

    That's appaling from Sany, I guess all second sales will immediately stop, machines will be worthless. Oh Sany doesn't care - best they go back on the boat. Cat, JD, Volvo, JCB will take their customers. So it will turn out in the end Sany does participate in auctions - of their customers to a new seller...ho-hum. 😊

    I guess there’s a small chance that the “dealer” that placed all those off lease machines in the auction may not have known the no warranty clause Sany has.
    The dealer you took the machine to didn’t know about it since they initially okayed the repairs before finding out from Sany.

    Auctioneers and dealers are now on notice and not if but when they knowingly put false information on their advertisements they are now liable for legal actions. The other point that is going to happen is the value of these machines is going to drop. In today's market most buyers do their research and this video will pop-up in their search for information. You pointed out that it was hard for you to have to post this video but this is exactly the type of honest information buyers are looking for. Thanks for sharing.

    Beware of all Chinese branded products. Any Tom Dick or Harry can import them and the importer is on their own because there is zero back-up or loyalty from the Chinese mainland manufacturer. This stands whether it is an industrial or domestic product, small or large. Avoid!

    Thank you for showing this. They should learn the 10 and 10 rule. 10 years to build your name and reputation but only 10 minutes to loose it. I think you should also make the auction companies aware of this as well. Their reputation is on the line as well. No one ever goes to an auction that is known for only selling junk. Sorry bud.     Man Sany will take a hit on resale value for sure , the warranty is always very prominently displayed and has done a really good job at getting them in the equipment market as an off brand machine.

    Sany is not very business savvy here. The auction prices for these are going to be peanuts compared to what they were. Dealers are going to take a huge hit from this as they will have to dump used / leased / rented equipment at a loss as nobody will buy them at auction. Resale values being crap will deter new equipment buyers from purchasing Sany equipment.

    Oh man.
    About a year ago on one of your videos, I commented one of my good friends purchased one from a ranch that the owner passed away, and the estate sold everything, it had 48 hours on it, and it was two years old and had never spent the night outside it stayed inside the Haybarn, so it looked immaculate
    He purchased it from the original owner or his estate, and then had a fuel problem at 55hrs and they did just like you, they performed the work, and then told them it was not covered under warranty because they were not the original purchaser of the machine, and that the five-year 5000 hour warranty Was not transferable unless it was purchased secondhand from a dealership. I have quite a few hours in the minis and they are probably about faith down the list as far as quality.
    John, Deere and cat are at the top of the list, followed extremely closely by a Kabota then Takeuchi.
    I’ve always wanted this to get out, because basically there’s no use in every purchasing one second hand, or at an auction.

    Great to see your company stepping up for your customers Clint. I was outbid thankfully on a Sany machine at an auction and I am so glad this happened. Opted for a Yanmar 4 year 4000 warranty that they stand behind.

    Semi new machines at a auction we have seen this before.
