What’s funny is Latosha initially thought she was hurting the other group members when they wanted to go on tour but she kept saying she’s focusing on a solo career. The 5 original members were granted the use(trademark) and neither could stop any of the 5 from using the name The Temptations. You’re the sole owner of your brand(trademark) Justin so you could stop anyone else from infringing on your trademark.
The temptations are exactly who came to my mind when listening to this.... I never knew much about it, but I think they had to get specific when doing shows like " The temptations Review" featuring Dennis Edward's so u knew exactly which members u were going to see..... No one is checking for Latocha in any shape fashion or form. No promoter with a brain would book her and some randoms as Xscape. She wanted to go solo and not commit to anything with the group and she got her wish, live with it.
I don't think it's a big deal that Tiny and Kandi weren't added to the trademark at filing (early 2017) because they weren't fooling with the group for YEARS while the Scotts were showing up to do things like the So So Def 20 Anniversary that the other 2 refused to do. I understand that Tiny and Kandi are independently wealthy sans Xscape so they don't care about the ™️ because they can walk away and be fine but I think once the group got back together (later in 2017), the proper thing would've been to update the ™️. I do side eye the timing of the original trademark filing in respect to when they started at the rehearsal for the BET awards in 2017.
This is an interesting legal issue. While a co-owner of a trademark can't give exclusive license permission without the other owners, they *CAN* give non-exclusive license individually, which is what Tamika has granted Mona and LiveNation. So, as long as Tamika hasn't given exclusive license, LaTocha doesn't have legal ground, as both owners must agree about infringement for an infringement action to proceed. Now, that said, trademarks are a bit more precarious than other IP issues, because trademarks *can* be ruled to be abandoned by a court if issues between the co-owners arise. LaTocha could, theoretically, raise the issue in a court that the co-ownership isn't sound, which could result in the trademark being abandoned (basically canceled) or awarded to one person. But I don't think that would work, because, again, this isn't exclusive license. However, because trademarks have a bit more of a requirement for cooperation and unity between the owners, this could raise some issues. Ultimately, they probably should've just called her to get to agree beforehand, but maybe they did and she was being uncooperative. Either way, sad. I hope their tour goes on and I hope she gets the help she needs.
I definitely believe there's a season 2 of their reality show on the way. That news dropped before the mention of the tour. Besides, when did they start making skits to promote a tour? Kandi said that there was a project that she couldn't speak on coming up while she explained her reason for not returning to RHOA. It all definitely makes sense now.
The news of the show being renewed for a second season came weeks before the announcement of the tour. Although they denied it later, I'm convinced that didn't just come out of nowhere. Plus, Kandi kinda hinted at it when she announced her departure from RHOA.

I may not be fully correct, but of what I know of trademarks. It would have to be sold then re-bought by all four. It takes a long time to even get a trademark. By one of the members being a co-owner gives them a little bit more leeway to use the trademark. And as long as the other co-owner is getting a portion of sales and pay bc they both pay taxes and other expenses for being owner of the trademark, they really should not be a problem in the court of law..

I think what's good for the goose is good for the gander! And I'm saying this because when the girls were performing during the time that Kandi refused to be apart of whatever Xscape was doing they weren't allowed to use the name so it's only fair that the same criteria should apply while LaTocha is absent from the group. @lush_rush32 actually they didn't use the name. If you go back and look at some of the videos you will see that they changed it to xscap3. If you go back and watch the reality show that xscape did because they did address it in that show as well as it being brought up on the reality show they did with SWV. So there definitely was some issues about the name. And Kandi also talked about it on RHOA with Todd. Pull up the music videos for Xscap3 and you'll see the name isn't Xscape. Now there issues with LaTocha are valid but irregardless they still shouldn't be allowed to use the name of its not all 4 especially if one of the parties is absolutely opposed. They made the change when it was Tocha, Tamika and Tiny therefore it should apply when it's Tiny, Kandi and Tamika. At the end of the day, right is right and fair is fair. Also, Kandi signed that contract for them to use the name well after they were using the other name. She pitched a fit at first and it was crazy cause she was pretty adamant about no longer wanting to be apart of the group. Now, they did eventually go back to using Xscape but that wasn't the case initially. She made a huge deal about them using the group name which is what started the mess in the first place. I don't think alot of ppl were aware of the fact that they had changed it tho.

But that last time when it was just Tiny LaTocha and Tamika, they changed the name to Xscap3 because they recorded new music. It had nothing to do with them touring with just 3 members. It had everything to do with them putting out a new album with on 3 of the 4 members.

You’re the sole owner of your brand(trademark) Justin so you could stop anyone else from infringing on your trademark.

I don't think it's a big deal that Tiny and Kandi weren't added to the trademark at filing (early 2017) because they weren't fooling with the group for YEARS while the Scotts were showing up to do things like the So So Def 20 Anniversary that the other 2 refused to do. I understand that Tiny and Kandi are independently wealthy sans Xscape so they don't care about the ™️ because they can walk away and be fine but I think once the group got back together (later in 2017), the proper thing would've been to update the ™️. I do side eye the timing of the original trademark filing in respect to when they started at the rehearsal for the BET awards in 2017.
This is an interesting legal issue. While a co-owner of a trademark can't give exclusive license permission without the other owners, they *CAN* give non-exclusive license individually, which is what Tamika has granted Mona and LiveNation. So, as long as Tamika hasn't given exclusive license, LaTocha doesn't have legal ground, as both owners must agree about infringement for an infringement action to proceed. Now, that said, trademarks are a bit more precarious than other IP issues, because trademarks *can* be ruled to be abandoned by a court if issues between the co-owners arise. LaTocha could, theoretically, raise the issue in a court that the co-ownership isn't sound, which could result in the trademark being abandoned (basically canceled) or awarded to one person. But I don't think that would work, because, again, this isn't exclusive license. However, because trademarks have a bit more of a requirement for cooperation and unity between the owners, this could raise some issues. Ultimately, they probably should've just called her to get to agree beforehand, but maybe they did and she was being uncooperative. Either way, sad. I hope their tour goes on and I hope she gets the help she needs.

I definitely believe there's a season 2 of their reality show on the way. That news dropped before the mention of the tour. Besides, when did they start making skits to promote a tour? Kandi said that there was a project that she couldn't speak on coming up while she explained her reason for not returning to RHOA. It all definitely makes sense now.

The news of the show being renewed for a second season came weeks before the announcement of the tour. Although they denied it later, I'm convinced that didn't just come out of nowhere. Plus, Kandi kinda hinted at it when she announced her departure from RHOA.

I may not be fully correct, but of what I know of trademarks. It would have to be sold then re-bought by all four. It takes a long time to even get a trademark. By one of the members being a co-owner gives them a little bit more leeway to use the trademark. And as long as the other co-owner is getting a portion of sales and pay bc they both pay taxes and other expenses for being owner of the trademark, they really should not be a problem in the court of law..

I think what's good for the goose is good for the gander! And I'm saying this because when the girls were performing during the time that Kandi refused to be apart of whatever Xscape was doing they weren't allowed to use the name so it's only fair that the same criteria should apply while LaTocha is absent from the group. It's sad to see the division between them. I just hope that they will get to a place of resolve sooner than later!

@lush_rush32 actually they didn't use the name. If you go back and look at some of the videos you will see that they changed it to xscap3. If you go back and watch the reality show that xscape did because they did address it in that show as well as it being brought up on the reality show they did with SWV. So there definitely was some issues about the name. And Kandi also talked about it on RHOA with Todd. Pull up the music videos for Xscap3 and you'll see the name isn't Xscape. Now there issues with LaTocha are valid but irregardless they still shouldn't be allowed to use the name of its not all 4 especially if one of the parties is absolutely opposed. They made the change when it was Tocha, Tamika and Tiny therefore it should apply when it's Tiny, Kandi and Tamika. At the end of the day, right is right and fair is fair. Also, Kandi signed that contract for them to use the name well after they were using the other name. She pitched a fit at first and it was crazy cause she was pretty adamant about no longer wanting to be apart of the group. Now, they did eventually go back to using Xscape but that wasn't the case initially. She made a huge deal about them using the group name which is what started the mess in the first place. I don't think alot of ppl were aware of the fact that they had changed it tho.

The 1st time she left the group, yes Kandi signed some papers so they could bring in a 4th member under the Xscape name. But that last time when it was just Tiny LaTocha and Tamika, they changed the name to Xscap3 because they recorded new music. It had nothing to do with them touring with just 3 members. It had everything to do with them putting out a new album with on 3 of the 4 members.

Kandi mentioned to them that people were upset that they were using Xscape but was without Kandi and promoters were using that to strong arm them into lower pay as the public was expecting 4 women. Excluding Tocha should garner a similar respnse from the public, but we all are well aware as to WHY Tocha is missing and we have no sympathy for it. It is similar (using the name with 3 women instead of 4) but the difference in the public's response is why it's succeeding in one case and not succeeding in the other.
