      See Houchins v. KQED, Inc. :: 438 U.S. 1 (1978) and Richmond Newspapers, Inc. v. Virginia :: 448 U.S. 555 (1980).
      If the press has no more right to access than the general public and the general public has no right to access then neither does the press.

      In fact, you believe this because your legal education consists of watching RUclips videos of criminals spouting nonsense about the law.
      The general public has no legal right to enter the building at all. Why? Because government office buildings are nonpublic forums. The US Supreme Court defined nonpublic fora in Perry Education Association v. Perry Local Educators’ Association, 460 U.S. 37 (1983).
      *Characteristics of a Nonpublic Forum*
      • The forum is created to serve a specific purpose.
      • Use of the forum may be reserved for that purpose.
      • First Amendment rights are restricted in the forum.
      • Only those with legal business in the forum are allowed access.
      So what does that mean for our state office building?
      1. The New Jersey Health and Human Services building was created to provide social services to the citizens of New Jersey that wanted them.
      2. Use of the New Jersey Health and Human Services building may be reserved for that purpose.
      3. There are no First Amendment rights available in the New Jersey Health and Human Services building.
      4. The only people with a legal right to access the New Jersey Health and Human Services building are citizens of the State of New Jersey who seek the social services on offer.
      Now we can discuss why the criminal with the camera had no legal right to enter the building.
      Per item #1 above, the NJHHS building was created to serve citizens of New Jersey who sought the legal services on offer. The criminal with the camera is NOT a citizen of the State of New Jersey and he was not seeking any of the services offered. Therefore he had no legal right to enter the building.
      Per item #2 above, the criminal with the camera was attempting to use the NJHHS building for his commercial filming enterprise. This is not why the building was created. Since use of the NJHHS building may be reserved for its intended purpose the criminal with the camera has no legal right to enter the building.
      Per item #3 above, there is no First Amendment right to film in the NJHHS building. Therefore the criminal with the camera has no legal right to enter the building.
      Per item #4 above, The only people with a legal right to enter the building are citizens of the State of New Jersey who seek the services on offer from NJHHS. The criminal with the camera is not a citizen of the State of New Jersey and he was not seeking any of the services offered by the NJHHS. Therefore he had no legal right to enter the building.
      I have demonstrated why the criminal with the camera had no legal right to enter the NJHHS building. But there is one more item to address.
      _then the press can be there too._
      The US Supreme Court has never ruled a criminal with a camera and a RUclips channel as “press”, and they are not likely to do so in our lifetime. (Seriously now. Have you looked at the make up of the court?)
      What the US Supreme Court has ruled, and they have done so repeatedly:
      The US Supreme Court has taken a narrow view of the “Press Clause” and has held in a line of cases that the First Amendment does not provide the press any greater right of access than that of the general public.

That filming is non-expressive speech and cannot be considered a disturbance. That anywhere the public is allowed the press is allowed. If they have *public* information or *public* notices (signs) in the *public lobby* then the general public has the right to come into the *public lobby* to view the *public* information and to ask questions about said *public* information, as the public is allowed to do this so is the press.
      As to you stating that LIA isn't press because he's a RUclipsr... the 1st Amendment clearly states that there is *Freedom of the Press* which means that every person on US Soil has the FREEDOM to act as Press, just as much as they have the other FREEDOMS guaranteed in the 1st Amendment. Namely: Speech, Religion, PRESS, Assembly, and Petition.
      See Brandenburg v. Hayes, Smith v. Cummings, Glik v. Cunniffe, & ACLU v. Alvarez

    As a public employee I couldn't be more disgusted by those people's actions. The only reason why this was an issue was the camera. They are supposed to be good stewards of the public funds. I don't see how that many employees tied up over this man with a camera is good stewardship. This lack of transparency says there is probably more issues there that they don't want seen by the public.

Many public servants including a Mayor even have lost their jobs or resigned because of these first amendment audits so again they have their job for now but that may not be the case once the public addresses their grievances and demands change.
      You say "nothing will change" however it already is. Many public servants have been educated of our rights through these audits. Many public buildings have been forced to change their unconstitutional policies because of these audits. Many of these public buildings have even removed those unconstitutional signs.
      These public servants are learning that those buildings do not belong to only them. They are now aware that we all (including them because they pay taxes too even if it is our money they are using to do so) own these buildings and they are learning they can't just make up their own rules that go against the constitution.
      Have you not seen the hundreds of follow up videos where a different auditor goes into a building that previously failed with that previous auditor and see all the vast changes that have taken place? Things are definitely changing and we all need to be documenting our interactions with these public servants so they not only know but understand we have the right to do so and we are gonna use that right.
      If you're paying your water bill in person document it. If you're checking out a book at the library document it. If you're renewing your driver's license document it. The government is definitely doing it to us. They are filming and documenting every single interaction they have with a member of the public for "their safety" and they do it without our permission so we have every right to also do that. We have every right to document our interactions with public servants for OUR SAFETY and we do not need their permission to do so.
      If they weren't so crooked, shady and didn't treat the public so poorly with their nasty attitudes we wouldn't feel the need to document our interactions with them. It has to be documented because the camera is a non biased 3rd party witness that CANNOT lie and since we can't trust them we NEED that 3rd party witness.
      As long as our government has the right to film us in public without our permission I'll peacefully fight for our rights to do the same thing and I hope and pray others choose to do that also. ❤❤❤

It is the auditor’s responsibility to find a legal venue for his commercial filming enterprise. The auditor had no legal business in the building and was rightly refused entry.

      You don't need more security or police. You need to better the country so you can do with 80% less. You got police in schools, dmv, town halls etc. and security in just about every public building. Still the numbers for shootings, violence and crime (drugs!) are out of proportion. Here in Berlin less than 1% of schools have private security and even in public buildings there is almost no police at all. In the town hall of Schöneberg, where JFK said his famous words "I am a Berliner", there is one (1) private security guard doing front desk. With hundreds of visitors each day. No metal detector screening. Nothing. My bank has one security guy and he's not even armed - like 99% of private security in Germany. And our crime rate is still way (!) lower than in the US. So try fixing the country without pouring more money into covering up the failure. You already got the highest incarceration rate of all western countries. Start with not giving low intellect people badges after 4 months of "training".😮

      Yes, incidentally, the case of Entick v Carrington (1765) was instrumental in bringing about a lot of what is detailed in the fourth amendment . That was about the most egregious and what turned out to be warrantless raid on John Enticks house/newspaper business by servants of the crown you are ever likely to read about. Nathan Carrington who was the Kings messenger (and his mates) got their comeuppance, Lord Camden soon put them right. He was the one that said “if it is law it will be found in our books, if it not to be found there it is not law.” That was the essence of it anyway.

    This is so sad it shows how ignorant law-enforcement can be. He offered to sign in. They wouldn’t let him they all want to stand around and collect with all paychecks but they want to be tyrants. This is just sad these two cops need to go back to school and inform these people that he can come in there and take pictures if he wants to go to mass

      @@Lboogie703 yea, they don't have much work to do, just pushing papers. Not even papers anymore but their computer mouse. Now everything is online, have you ever heard them talk about reducing the amount of money allocated to their department as there no longer exist employees for face to face interactions? No. So the money saved must be going into their pockets- the managers.

      How so???
      We don't have an absolute right to film in a gov building. Never did. There are different types of fora - traditional public forum, limited public forum, & nonpublic forum.
      This would be a nonpublic forum.
      The only place a person can protest, record/film, etc almost any time they want is in a traditional public forum, such as a public sidewalk or public park for example.
      Then there are also time,place, & manner restrictions.
      Several places LIA has visited have passed new ordinances against filming in their buildings...laws that didn't exist before (though the case law has) until now.
      So how exactly does that do anything FOR our rights????
