Why ‘no win, no fee’ solicitors are taking on councils over social housing

  • Council tenants in England whose homes are plagued by leaking roofs, subsidence, damp and mould are turning to legal firms for help.

    We’ve been investigating these disrepair claims.
    There’s 4 million estimated social homes in England.
    They’re getting old - many of built in the mid 20th century - and as councils struggle to keep up with repairs, ‘no-claims’ solicitors have been getting involved.
    Freedom of Information data obtained by Channel 4 News from 50 English Councils, shows since 2020, nearly 17 thousand legal claims have been made by social tenants, through solicitors, against their council because of the conditions they’re living in.

    It's not just councils, it's private landlords too. They don't want to spend the money on the upkeep of the properties.

      I looked at renting a flat. 750 pounds a month private. On first glance I could see what a state the plaster was on the walls. The price is bad enough. It's disgusting that they're able to get away with it.

      goverment used to own stuff, then it privitised everything. now it needs to rent everything including social housing. theres a layer of profit that never exsisted before. hence more council tax for less services and landlords ETC pocket the difference

    I worked with the council, and I have seen how corrupt they are. Here is what I suspect, and it should be investigated. They send their contractors to repair the work, but they never inspect the work the contractor completes. They even know the contractors are charging extremely high prices for a repair job, for example, replacing a vintage tap with a cheap £20 one, which works for a few months but charges over £150 for it and then the cost of labour etc etc. Councils pay high prices for simple jobs which could have been done properly at a much cheaper price.
    I suspect the staff will take a cut from the contractors. If you raise the issues of corrupt contractors, you are suppressed. Even the contractor labourers say they know the job they are instructed to do is shoddy, but that's what they were instructed. It's like syndicates where everyone makes money on the cost of the tenants. They particularly target single mums and older tenants.
    It's good that the wolfs are after them.

      I suspect you are right. Thankyou for raising your suspicions. I live in a council house. My boiler has been condemned. It would cost £150 in parts to repair, which I have offered to pay for myself. However, my council landlord and the heating contractors are insisting I have a whole new electric system fitted, at a cost of thousands. I've been without heating since January as I just want the £150 repair done on my boiler. I'm a council tax payer. I'm trying to save the council money! But, unfortunately, it seems I'm not allowed and the heating contractors will get the big job of a complete install as I cannot get permission to pay a local company to do the repair.
      My new roof also leaks and directs rainwater into the wall cavity so the internal kitchen wall is permanently wet. There was no inspection of my roof after the contractors got their money. My old roof didn't leak.
      I try to do most repairs myself because the contractors are awful but the roof and boiler I'm unable to do.

      Because what they do is evict the tenant has soon as they make the complaint. You have to give landlord reasonable time to fix it, which means that you can't sue until atleast 3-6 months is given. So to bridge this gap they evict you, remarket the property and the cycle continues.

    It’s the height of a chutzpah that these councils are bemoaning the fact that a lot of the tenants make a claim. They forget the destruction caused by the mould and damp to the health and personal properties of the tenants.

    Lawyers are obviously fine upstanding citizens who are deeply offended by the social injustice (or they're ambulance chasers), but without the threat of legal consequences nothing changes. Those legal letters that resolve inaction from rogue housing authorities, how much are they and who pays?

    I had a damp infested bathroom and the tub was corroded I’ve been reporting it for years…
    But recently they come out had a look and ripped the whole lot out and started again treated all the damp and now it looks like a completely different room! No damp , no mould , no smells and it’s all because of reports like this one that it finally got done they also fitted all new attic insulation and treated the mould by the front door so I can now finally carpet and paint my hallway after 10 years 🎉😊

    councils are kind of like a dollar store employees, criminally underfund by the overhead yet expect to perform all the duties, with the saving grace coming from volunarteers at times to ease their loads

    It's about time, for the past 2 decades, social housing providers have been ignoring the issues with unsafe housing. If councils think it is a waste of thier money paying legal fees, why not just repair their properties as the need arises, it owudl be much cheaper

    And this goes for housing association properties too. What about the private contractors they use to complete the repairs who are often owned or partly owned by the directors of the housing associations? They charge THOUSANDS for work on properties that should cost only a fraction. So these directors are using their own private companies to complete repairs at inflated prices meaning there's less money for work on other properties. They were sold properties from councils for £1 so they would invest in repairing old housing stock but all they have done is milk the system leaving tenants in homes that aren't fit for purpose.

      I fixed my mum's council house when stuff broke. They don't forbid you repairing stuff. They often are willing to help you fix stuff or even do it themselves

    The issue here is simple, there are too many people and not enough facilities and services to go around. Regards to camp and mould, there gets to a point where contractors and the council can do no more, because that house needs tearing down and rebuilding, there’s not enough homes due to the housing crisis and so they cannot tear down and rebuild the property because then the tenant has nowhere to go. I don’t think suing the council is the right way forward and it certainly is counterproductive. Councils are already going bankrupt as it is. We need more homes, and more apprenticeships available with attractive wages to train up an in house repairs team for the council.

    Council housing like that brings on social service agencies at the door with respect to the children that live in such conditions. I wonder if this video has had people call on the mother of her daughters profiled in this video to social services because of the conditions. Conditions like that here in the states would put a child in care over a neglect reason. Doesn't matter if it was a landlord's responsibility or not. Parents are expected to be perfect to keep social service workers out of their lives.

      Honestly this isn’t talked about enough, the amount of useless middle management positions in councils and the NHS is ridiculous. Some made up apparatchik positions that only exist to make decision making longer while receiving £25k+ a year!

    Couldn't have put any of your own money into your housing situation no?
    The mum who's been given a home for greatly reduced price per month vs private renting and a mortgaged property, most of which she probably wont pay herself. Then had a kid in the property even though she spent four years arguing that it wasn't 'up to scratch' and needed fixing.
    Then brings a legal battle into the mix...
    Just another little flame to fire that is broken councils...

      @@thebeesnuts777 tried that (have photos and videos since 2013) and I was threatened with eviction as you (the tenant) are not allowed to make any alterations or improvements to the property,
      I offered to pay for the roof but no, not allowed…
      I’m trying to help my community by stopping Sheffield council from wasting money,
      my flat isn’t the only one, we’ve had 15 scaffolds up around here in 3 months and it looks like they are going to waste more money by doing the same on them roofs that they did to mine,
      approx £80-90k wasted on this in 10 years,
      I’m trying to stop them doing the same on all the other properties around here but it’s hard when everyone involved with the council can’t admit there is a problem and are that pathetic when they do come to fix things, they can’t

    That floorboard could be fixed for £2, wood and a coule of screws, simple really, the fact that she expects it all to be done for free is astounding! People need to maintain there homes regardless if they own it or not. Common sence and a little pride goes a long way! 😉 Id be more concerned that her child has no carpet or paintes walls, she is absolutely mad to raise a child if she cant run a house!

Also jail them for reckless endangerment of children ,, councils squander money on stupid decisions and ego projects too much.       I moved in, had a mold problem so I went around targeting all the walls and since then haven't had any problems.
      I think the councils aren't the only problem the tenants are for not cleaning and letting it get so bad their kids are hospitalised

    Simply means councils will now reduce housing stock levels even further. Agreed the standards need to be acceptable, but this will simply increase street homelessness 😢, and encourage profiteering - I wonder why PRS landlords are not persued…. 🤔 . Councils in the UK have been underfunded in the Housing sector for decades. Its about time Central Government took this issue seriously 🤦‍♂️

    Its not just council houses it is private iswell. They don't want to repair the houses. These places are not fit for animals let alone humans. Vulnerable children are diying . There needs to be more protection for tenants. A Docter will explain the severe health implications its no joke . The council and landlords need to do better

      You will also find repairs are just a quick cover up when indeed there are major costly problems,like needing a new roof ,subsidence to old buildings,rising damp one thing leads to another costly repair ! The problem sometimes lies in the cost of maintaining these very old buildings especially if you privately own one and having no funds for major repairs!

    Councils need to charge a full rent as the government is no longer paying the subsidy which keeps social housing cheap. This is why councils and HAs cant maintain the housing stock. Suing them takes money away from other services.

      Free flat?
      Even offered to pay for the roof repair myself to get it fixed correctly but was told by the council that was against regulations, so they continued wasting tens of thousands.

    What is it with people, expecting other people to provide them with housing etc. Residents need to accept that more is expected of them to manage their lives. There is just not the money around as before. Broken Britain is the new reality.

      If there’s not enough homes to buy or way too expensive why not rent?
      And if you can rent off the council why not? Still has to be paid for by the tenant, not everyone is out of work in council properties.
      Part of the reason Britain is broke is because of the likes of councils wasting so much fixing THEIR own properties that are being rented from them

    these 'no win no fee' are vultures vast majority of mould/damp is from tenant lifestyle, i know i was a disrepair surveying manager for 2x London councils, of 124 cases that I worked on only 4 were legitimate and went anywhere near a court or compensation payments due to structural, landlord neglect, etc, not a bad record if I do say so myself..!
