PTSD is no joke I isolate myself, insomnia, mood swings, paranoia, anxiety irritability, people just don't know. TDIU is extremely hard to get. I work at night isolated and still cant get it. Don't trust your VA appointed doctor they don't do you any good when it comes to claims. If need be pay an outside doctor to do your evaluation. I still have mood swings but my wife has known me since we were kids she's a trooper. All Veterans fight for what you think you deserve!! Just like in the MARINES NEVER QUIT AND NEVER GIVE UP. God Speed

I have a 70% rating from PTSD and another 20% from a shoulder injury in the Marines. My Veterans Lawyer expressed he would like to get me the UI claim to 100% until the appeals go through for my other claims. I am currently awaiting the outcome of the UI status. I had my last QTC appointment on the 11th of June 2018 and I am still waiting. Mean while I requested my claims folder (C-File) in December of 2017, and the VA finally found the submittal in February of 2018. The Lawyer submitted a request for the C-File in March 2018 and this is the date the VA chose to use as my request date. It is now August and I still do not have the C-File but the case was closed as completed July 24th of 2018. I will give it to the VA, they spare no expense when it comes to trying to discourage Vets in getting a service connection rating.

OK. This is my situation.... I'm at 70%, with 100% unemloyability due to hearing loss.
I have been in the Philippines since December of 2019....as a result of my wife telling me to go to away. We're still married, but she has made it clear that I don't have a home to return to.
The pandemic lockdown stranded me from trying to get to the VA here, as inter-island travel was stopped. I need to go back to my doctors in the States for the usual check ups, but more specifically to address a failed surgery performed by the VA (Memphis) in November 2018. I live in pain I can only describe as an ever present headache in my groin.
If I return, I will be homeless and I am not equipped to navigate the necessary steps of reestablishing a new residence. I cannot abide the city... So I am living a remote, sparsely populated mountain community here.
Add to that a fear of returning to a country I love, but hate the direction it's taking.... The fear? I'm afraid of going to prison for murdering or being murdered. I simply can no longer watch social media for the anger that wells inside when I listen to the news.
I'm old... Vietnam combat veteran... Marine door gunner.
    Need advice.

I had the same thing happen to me, luckily about 2weeks after I got my rating a VA Claims clinic "one day" processing took place. I went and a rating examiner reviewed my evidence and the notes the C&P examiner wrote. She did the appeal paperwork and bumped my rating for PTSD from 40 to 70%. All done in less than 30 minutes, its ashamed how the c&p examiners lie on their write up. I even filed a complaint on the new complaint line, they called be back and stated the examiner will be looked into, about a week later I got a call from the local VA Patient Advocate asking a few questions about my exam and the length of it. Call the new complaint hot line.

I believe that some of these VA Drs are mandated to keep the ratings down which is a shame to me. I have not worked for over 5 years, I cannot because my PTSD and Physical service connections have made me unemployable. I have 80% in ratings but somehow they only pay me 60% which I cannot live on. It's all a scam that is killing many Veterans. You are not alone.

    • @Veterans_Lawyer
      @Veterans_Lawyer  7 лет назад +2

+Tim Hassan I agree that C&P exams are often less of a Rating than what is deserved based on the entirety of the evidence. That is why it is often important to have your own medical evidence in addition to what VA obtains. If you'd like us to review your situation, fell free to reach out to us on your website www.WinYourVetClaim.com. If you haven't already, you may want to look into filing for TDIU.

What I don't understand is how a Air Force guy can get permanent 100% PTSD but a front line combat Marine cannot get above 70%. No Air Force member has ever seen the level of trauma that I have but they are favored by the VA. Those Air Force guys are perfectly normal without any trauma but I am totally messed up living in isolation, seeing the dead, reliving that war everyday, can't sleep for night terrors and always hate people. I have to restraint myself and change my character just to go to the store or be in public without any crowds. My life has been miserable for 30 years but some perfectly normal Air Force guy can walk in and have everything handed to them. They are even suppose to get VA benefits where the Air Force opted not joining in the VA of paying their share.

It is always hard to make sense of how one veteran receives a certain outcome and others don't. Every situation is unique with its own set of facts. That said, our strategy is always to focus on the current case at hand. Otherwise, you will only get more discouraged and frustrated. It sounds like you some serious impacts to your life as a result of your service to our country. If you feel like you are due an increase in your rating or benefits, we'd encourage you to evaluate your various options. Best of luck to you as you pursue that; reach out to us on our website if you would like to see if we might be able to assist.

What if your CDR was firing on locals hoping to get return fire to get a Purple Heart, and you called him out. Then he doesn’t let you take a PT, which forces you out, since you can’t re-enlist. Then you see him getting promoted after the Army Board of Corrections rules that was against regs. If that causes you grief and depression, would that be worth showing the VA rating board, where the Army Board of Corrections ruled that you were wrongfully discharges by an acting Warrant Officer Commander, yet he is continuously being promoted without any reprimand.

Do you have to be a war veteran to suffer PTSD? I served during peacetime, but am 80% service-connected with the injuries and ailments i suffered through during my time of service. One attorney told me i should claim somatic stress disorder, because of the long-term effects of my disabilities.....i cannot work because of my back problems, i have Graves' Disease resulting from contracting radiation poisoning, tinnitus, sleep apnea....i currently live in Thailand, so most attorneys who specialize in VA claims will not help me.....i should absolutely be granted 100% disability benefits, and more.....i had major psychological problems when i separated from the Army and returned to the civilian sector. Every high-paid position i held working for hospital organizations resulted in me quitting because my Graves' Disease and degenerative back condition make me irritable, angry, not able to control my emotions much of the time.....

I'm sorry my friend. You need to go to the VA and try getting in a PTSD group and if you are using drugs/ alcohol to deal with stuff, they can help you (SUDS-substance use disorder). Get a consult through your care provider for TBI- Traumatic Brain Injury. That IED shockwaves could've rattled your brain. Try to remember anytime you went to the doctor when you were active duty. If you decide to file for Individual Unemployability then request a representative or even a lawyer. The DAV can help you but I personally avoided a VA Rep. Google lawyers that specialize in it. You may deserve 100% rating or at least IUE. Get help because the VA wants to see that you are trying to get medical attention. Good luck my friend. Reply to this and we can try communicating more info.

I'm currently rated at 70% for PTSD alone after fighting with the va since 2010. At one point I had a 10% rating for my hearing loss which I still have, yet they took it off for whatever reason after my last rating increase. I'm not sure what's going on with these people, but I don't feel like I should have to fight this hard to get 100% which I really feel like I deserve. I'm currently just working part time at a dollar general only getting 1 or 2 days a week which simply doesn't pay the bills. If it wasn't for my wife, I'd probably be homeless right now. The only reason I even have this job in my opinion is because the people I work with understand my conditions and really work with me, but I feel like I'm doing more harm than good because of them cutting my hours so much. I just feel worthless sometimes and it seems like they only keep me out of pity or something. I'm going to try to give it another go today, but I just don't know what to do anymore.

Go for TDIU, it's near impossible to get combined scheduler ratings to add up to 100% disability with the 'Crooked VA Math'! If you look at your VA Decision Letter for 70% (I have the same), it lists a lot of things that make you unemployable. Don't forget people you know can write Lay Statements indicating your issues and how you can't function in a workplace...I am doing that right now. Wife, son's/daughters, peers I've worked with can all tell my story and how it's impossible to work with me...

I'm currently at 70% for PTSD. I'm still working at the moment but due to my PTSD I miss work often. I make myself go to work, so I have enough money to pay my bills. How do I go about getting TDIU? Can I file for an increase and maybe use my work history as evidence?

You could file for TDIU, although VA will look closely at your current work. We would need more information about your current situation and your work to see if there is still an argument for TDIU. We’d be happy to take a look at it for you and see if you want to reach out to us on our website, www.winyourvetclaim.com.

A doctor can comment on your ability to work, but many times it is helpful to have a vocational assessment done in your case. That is done by a non-medical professional who looks at how your disabilities affect your ability to work. We will try to do some videos in the future on this topic. In the meantime, feel free to reach out to us on our website www.winyourvetclaim.com for more info.

Yeah don't do what I did and try to work and try to go to school first. Swallow your pride and don't try to integrate yourself if TDIU or a higher rating is what you think is best for you, it is unfortunately what needs to happen for the VA to give a shit. I tried to work and found employers very unforgiving about my medical schedule and conditions and eventually I just stopped being able to even get the jobs entirely. Tried to go to a few different schools and it was brutal, anxiety attacks, complete lack of proper support for veterans despite preaching how well they serve them, all kinds bullshit. So my VFW rep told me since I already have 70% PTSD rating to file for the TDIU and they denied me based on the fact that I had previous time in school and working -_-. They are encouraging people not to even try, its ridiculous. A job is a job and I get it can be tough and that everyone makes mistakes, but I am at the point where you probably should never tell me you work for the VA in the claims department because I have no respect for you whatsoever, deserving or not.

I was granted 70% right off the back for ptsd in 2014, I was rated unfairly. When I filed for TDIU I got denied. They said it hasn't been proven that I couldn't do Sedentary or Physical work. Even though my file said chronic sleep impairment , impaired judgement, depressed mood, irritability, trouble concentrating etc. etc..... You can't win your TDIU claim w/out a vocational letter denial or a vocational expert stating that your mental disabilities hinder you from performing, being present at work, successfully communicating w/ co-workers and supervisors.. and its going to cost you at least $600-$1000 to get such a letter

Antonio, I hear what you are saying. I worked for the VA at Vet Centers. I filed over 100 claims for PTSD and fought hard to get vets their due. I am also a Vietnam Vet and am at 70% with TDIU since I retired. Based on what you stated it seems the C&P examiner did not do a thorough job. The question is if you are still working. If you are you won't get TDIU unless you cannot work. A suggestion if you are not working is to find an outside psychologist or Psychiatrist that is familiar with PTSD and bring a copy of your C&P so he can review it and explain or write his opinion about you being unemployable. Good Luck.

Under certain circumstances, VA could try to reduce your rating. However, if the current rating has been in effect for 5+ years that will be more difficult for VA to do according to their own regulations. And, if the rating reduction would negatively impact your overall rating, there is a process they must follow to give you advance of their proposal to reduce and allow time for you to respond. If you are reduced, you should certainly have the decision reviewed by an accredited attorney.

Unless you have service connected disabilities other than PTSD and GERD, it will be impossible. You're better off filing for TDIU using the PTSD, get letters from associates/friends/wife/kids and your Doctor. The more evidence the better. Emphasize your inability to work with others, use the PTSD letter for the things wrong with you that apply to a workplace.

@@miltonturner2977 Well I have 70% and 10% for GERD. I'm service connected says right on my veterans ID card. Furthermore I truly don't know why the VA hospital hasn't given me 100% already due to the first fact that I have already had two brain tumors removed from my pituitary gland. And furthermore I suffer from TBI and PTSD as well as grandmal seziures. I often can go 5 or 6 days without any sleep. And furthermore when I was told by the Dr at the VA hospital about my first tumor. I will say this the Dr said to me if I didn't have it removed from my brain, within a month possibly two tops I would be dead. Schedule a appointment with the doctor for surgery and furthermore this was in November. And we'll the surgery Dr said they couldn't operate on the tumor, until like July which would mean I would be dead. And what is so sad is my appointment with this Dr was on Nov towards the end of the month right before I was to get paid. Pay day shows up and I didn't get paid, so I called the VA hospital spoke to someone who told me that same Dr went to veterans hospital payee or something like this. She tells them to stop my VA benefits check because I wouldn't make it is her exact words. And furthermore I got treatment outside of the VA hospital at UCSF hospital San Francisco CA had my surgery on Dec 16th and furthermore they have a UCSF hospital in Fresno California as well and the Dr who did my surgery has me go to this hospital for a shot and furthermore this same Dr said to me and my mom and the nurse! What shot Mr LaMattina hasn't had surgery yet I looked at her and said ya I did furthermore why are you here seriously ma'am the Dr ordered me to get the shot and furthermore he signed off on it to so ma'am please if you would get me the shot. The Dr takes the form from my hands, well she snatched them out of my hand and furthermore she had nothing more than the cafeteria lunch menu. I handed it to the RN who says to this Dr. Ok so you had surgery in the pituitary at UCSF hospital San Francisco CA , and furthermore you need this shot or it could kill you without it. Dr Kelly this is the shot he needs and furthermore can I speak to you outside no tell me here. Okay do you not care for the Life around you how long have you been a Dr? Well you better pray that young man doesn't want to file a report on your behavior and she said he wouldn't be able to cause he has TBI and can't remember my name I'm sure of it. This is when this RN said you must think I don't care about my veterans? Well I will give you your shot sweetie and take you to the hospital staff to report this Dr. Okay no problem I would love to report Dr Kelly for this and for stopping my VA pay last month thank God I was able to get it reinstated before they did finalize her paperwork. She looked at the Dr and said she did what well, well nothing get the hell out of the patience room and furthermore I will never ask you for anything again. And furthermore only thing that Dr said to me my mom and the nurse is he was supposed to be dead cause the VA hospital in Fresno California can't afford this type of surgery! This is why I did this to his pay. And furthermore for her I did write a report everyone did and she still has a job sad thing huh nothing has happened no apology for her actions nothing at all so. Fresno CA VA hospital is by far the biggest nightmare for any veteran I came from Texas to California and was in the TBI clinic getting help there when I got to Fresno CA. Oh you don't need that cane sir you don't need your tens unit so turn those over and we don't think you need to be in our TBI clinic anymore so you don't have to come back and furthermore I told Texas VA this and they were so mad they bought me a laptop and had me Skype in and they continued to teach me how to walk again from a laptop and furthermore they said without their help I would still be home going potty on myself and furthermore I would probably have drowned in my pee sad huh so I should be at 100% why I'm not I can't even tell you why but if you want to give me a email address I can email you to get me established for 100% I'd love to get started on the paperwork!

@@miltonturner2977 well obviously you don't know what a putitary tumor is. Cause if you did know what it was, then you would know that I should be rated at 100%! For whatever reason my VA Hospital won't give me 100% I have PTSD 70% and 10% for GERD. However I have the veterans hospital giving me kerpra for grandmal seziures and furthermore I have TBI and I have a plate in my head and furthermore I go to the urologist for testosterone shots each month because my tumor wasn't supposed to grow back like it did. However my tumor was partially removed, they couldn't remove all of it. And 1 year later it grew back to being almost two times it size. Not only just that but the putitary gland regulates your body and it's temperature it tells you to cool down it tells you when you are cold or to hot. It tells your body to sweat if you get too hot. Also I am not able to do this cause of my tumor on top of it I can pick up dry ice with my left hand and furthermore it not even burn me at all. As well as I have sleep disturbances all the time I am very visual with my surroundings in places I go to I count exists and people and furthermore I have trained all of our dogs to attack if they think we are being threatened by someone who doesn't belong that ain't normal dude. Furthermore I don't think someone who was in my unit and didn't deploy as much as I had to truly would understand what type of issues I have. Granted you may have served overseas and there's not what I am saying but me I was in for 13 years and deployed 8 times overseas as a US Army Ranger and furthermore we were attached to seals sometimes and marsoc and furthermore majority of the time we wouldn't come back to the fob we would stay in a village blend in and skyhook out and furthermore I was in 27th engineer battalion and 82nd airborne unit. So forgive me when I say to you your not like me we are two different types of people I don't take orders from anyone that would get me killed or my guys! I call in air support they come to me fast and hot furthermore majority of the time its from a raptor out at sea cause every single minute waiting for a slow ass warthog to get there won't work for us and I get people there to get us the heck out of there so we can move to the next objective. And furthermore I have been in a IED or VBIED. That is still known as being one of the biggest VBIEDS to hit a convoy and furthermore if you got a chance to watch a TV show I believe it happened three or four years ago called enemy within or anybody at the gate or something like that I can't remember but the introduction to the documentary or TV show had a big ID going off and they're very beginning of the credits check out the helicopter signal that's 5 miles away. This is the convoy that I was hit in and Furthermore I have watched my finance who was pregnant at the time die on a battlefield and furthermore I was told to go home to be with her sister and mother and father and furthermore when they found out she was pregnant and taking her RR the only people that knew was her mom and me and her sister. So you see I have a lot of PTSD and furthermore I never truly recovered from seeing that. Not only just that but I was blown up once again and this time sharpnel made me unable to have kids and since I have been 28 years old I have been suffering from ED. So you see what I mean I should be 100% I can't work in society I can't even stand people half the time and furthermore I have severe levels of PTSD and mild to serve levels of TBI!!! And furthermore I would truly do anything to get my life back together and be normal again but it will never happen so I am taking it day by day the whole dive in first figure it out later routine doesn't work for me anymore because to top it all off I am starting to go blind in my right eye due to the optical nerve detaching from my brain and turning pale white in color so you see what I mean. You seeved great not saying I did better than you!! No not what I am saying I'm just saying that until you have done what I have done and are that Broken down in life we're you have to fight the urge to make it out of bed to go to the bathroom or to get up cause you can't due to the pain of bulging disc in your back and neck you still try to anyways cause you know if you stop your going to die and furthermore I don't want this to be it for me not this! Not this so please take your negativity and go somewhere else with that shit man cause I have been through such a nasty life that I don't want to bump heads with you. I think maybe you know what you are doing but truthfully maybe you are a good attorney after all cause I think you would know what I was telling you is enough to get me approved for unimployablity through VA hospital especially if I already have 80% service connected and am getting SSI. So maybe you think you truly know but I don't think you truly do anyone can read notes and furthermore maybe you aren't the right answer for me or anyone else cause you don't know that I should be rated at 100% but you don't see me so you don't know well and that is the problem you don't connect with your clients like you truly should i have given you some information on my health that anyone who has a clue would understand that I should have my 100% why I don't one will never know. Cause okay VA hospital even has given me two phonak hearing aids cause I have moderate to severe hearing loss in my right ear and profound hearing loss in my left ear.... So once again why am I not rated at 100%????
