In 2005, Matthew Fisher who was the organist with Procol Harum, sued Gary Brooker who wrote the music for Whiter Shade of Pale. Fisher wanted 50% of the music copyright for the song because of his iconic, melodic organ playing which propelled the song. He won the lawsuit in 2006. The song was written in 1967. It just makes you wonder why there was a decades-long silence about the issue.
If you look at songs that go public domain - copywrited songs go public after 50-75 years after authors death - songs may go public domain sooner if there is no copyright - I think that her recording falls under this category - someone fact check me on this please

This makes me so sad, that phrase and voice is historic and a memory of so many that walk that iconic boardwalk. I immediately smile when I hear that phrase and wait to hear it while entering the boardwalk for the season. It’s not wildwood without it.
I think Wildwood peaked in the 70's. You still had the Fun Pier, Hunts Pier, a movie theater on the boardwalk, Zaberers, the Dracula's Castle was built. I believe the Punk Flamingo was still running. And now today we will be stripped of another memory. I am so glad I was in the Wildwoods in those days of gone I can cherish the memories of everything that once was. Even driving around was so cool because of all the neon signs from all the hotels that are also gone. Unfortunately this is probably the last year we have heard the tramcar signature. Leave it to merchandising to leave this behind in our memories.

I am not a lawyer but I always thought if something like a recording was never copyrighted after so many years it would be considered public domain. Just like many really old records that originally had copyrights become usable by anyone after so many years of copyright protection. Since she never asked for compensation from the original operators of the Tram Car so I do not feel she has any rights now against anyone using the voice. I am also surprised that the existing owners or some previous operator never copyrighted even the phrase “ Watch the Tram Car, Watch the Tram Car please!” That would protect Wildwood from any other possible tram car operator from using the phrase. You asked what the Tram car used years be for they used the voice. I am 71 years old and I believe when I was younger they just had a simple horn they used to get people out of the way.
Due to the length of time that the voice has been used, I'm wondering if it can be claimed under "adverse possession" such as in the case of real estate. If that is the case then her claim will be dismissed and the Tram Car owners will then have legal possession of the voice and phrase.

That is weird in the boardwalk movies she did not want to get paid and was happy to. She worked for a telephone company and she did it during her lunch hour. I think she has a case against the toy manufacturer for some compensation but she will get very little from the tram car owners. The tram car owners are not marketing the use of the tram car based on her voice. Her statement is used as a safety warning to the general public. Low probability outcome: She likes the offer for past compensation and future royalties and agrees to be an "ambassador" for the tram car and other parties using her voice.
She probably watched the 1987 film, "Wall Street," and she heard Michael Douglas say, "GREED is GOOD," and she took it personally. Plus, the voice is on the adorable tramcar stuffies and the seagull eating the tramcar plushies. Oh yeah, the cheap toy tramcar, too. Seconded. Her recording of "Watch the tram car, please" is a big part of what makes Wildwood, Wildwood. It has become something much bigger than what it was originally recorded for... and the city should pay her for its continued use in tram cars, advertising, toys, rides, etc. The city should make a one-time payment for perpetual rights to her recording -- along with the right to grant its usage to various merchandisers.

There were definitely outside forces involved in this. Is this a frivolous lawsuit? Could be construed as that. Then again, she hasn't been financially compensated for her voice usage that the city of Wildwood and it's merchants have profited from. Like someone else commented, she may be in financial distress and some well meaning acquaintances have been advising her.
I think that because she had no contract for compensation for doing the recording, she is just out of luck there. She has the right to enter into a contract going forward, but I suspect the owners to just go with an AI voice from here on out.

@@patburke1961 not at all. It costs a ton of money to keep those almost 100-year-old machines going. For example, each tramcar has about 10 of those Duralast batterys. They run about $250, For 10 trams. Those have to be replaced constantly. It takes 60 people to run those tramcars a year at $15 an hour. That is 900 an hour or about 9,000 a day. Then add in insurance, maintenance, and electric bills (which is a fortune as you know from all of the ACE bills this past summer). The one thing the lawsuit gets wrong is that they said they made 2.5 million a year. The lawyers based that on the avg that the tramcar sees 500,000 a year. But what that number didn't put into account is that everyone with a wristband rides the tramcar for free until 5pm. Which would mostly remove half of those numbers, so say 250K riders or $1.25 Mill. If you account for payroll alone, for 90 days (June, July, August) you are looking at a payroll of $810,000 a summer. Now add in insurance, maintenance, batteries...etc. So no my friend, pretty straight forward. We are lucky they are still running since back in 2003 the guy who owned them was going to sell them off and luckily someone stepped in to save them .

To me, there's two parts to this...The first part, just the use of her voice for the tram car, no one's making money off of that, so she's got no standing there. However, when they start using her voice as a way so sell toys and merchandise, and making a profit off of it, that's where I feel she has a case. It's similar to the NIL situation with college athletes. for years, their name, image and likeness were used for the schools to make millions with the athletes getting anything for it. The Supreme Court ruled in favor of the athletes. It may not be the same exact thing, but kind of related, so I think she's due a piece of the profits from the merchandise that's been sold.
Basically a lawyer got hold of an old woman & convinced her she needed to sue. NJ is a pure litigation state.

My voice lol! Anyway this is crazy. I have seen many videos of her being happy about her voice being used.
That is weird in the boardwalk movies she did not want to get paid and was happy to. She worked for a telephone company and she did it during her lunch hour. There is writer to the phrase that she read so she doesn't own the phrase that was written by someone else, only her voice was used.
I would love to have my voice to help.
Vincent Price only made a few thousand for his voice on Thriller, Phil Rizzuto got a little over $1,000 for being on Paradise By The Dashboard Light by Meatloaf. The boy singers on a Charlie Brown Christmas got less than $1,000 - this lady is not really due as much as she might think if she had signed a contract back in 1971 or so - family members must be putting her up to this. Vincent Price was given the choice of a flat voice-over fee or a percentage of the sales. Who could have known Thriller would be so popular.
I think she has a case against the toy manufacturer for some compensation but she will get very little from the tram car owners. Like Vincent Price, she would probably be entitled to compensation for the original recording, but not much after that. The tram car owners are not marketing the use of the tram car based on her voice. Her statement is used as a safety warning to the general public. Joey is correct in that based on the lawsuit being filed, anyone using her version will remove it and it will never be heard again except in people's videos where a tram car was passing by. It can be replaced by AI. But I will bet that it will be a female voice. Why do you think we have Siri and Alexa?

There's a concept in the common law called "laches" (pronounced "latches"), which states that a plaintiff can't recover if they wait too long to make their claim. And you can also give up your rights by making statements or actions contrary to your exclusive ownership ("waiver").
On the other hand, if I give you permission to use my driveway to get to your house, I am not also giving you the right to use my land to hold a circus.

A lot of people ask why she waited so long. It likely has to do with the recent increased use of her voice. First the Tram Car ride and more important all the tram car plush toys. I think that is what drove her to this. Probably would have let the Tram Car ride slide but voice in all the plush crap is going overboard. She’ll probably win this fairly easily.
Excellent reporting. Suing everyone is an unfortunate legal strategy. Each party will have to come forward and argue a reason to be removed from the suit. She should be compensated. Arriving at a dollar figure will be the tricky part. Ms. Stingel and her attorneys are most likely seeking a settlement. Her voice will be removed going forward if they cannot reach a licensing agreement. Low probability outcome: She likes the offer for past compensation and future royalties and agrees to be an "ambassador" for the tram car and other parties using her voice.
I hope they can agree together. This voice brings so much good memories every time I ear it. That is sad.

She probably watched the 1987 film, "Wall Street," and she heard Michael Douglas say, "GREED is GOOD," and she took it personally. Plus, the voice is on the adorable tramcar stuffies and the seagull eating the tramcar plushies. Oh yeah, the cheap toy tramcar, too. I know about it since I would go down there every year since my birth in 2003... (except for 2020 and 2021). The car itself is a copyrighted work, but not the voice or sound mark (jingles or logo themes, or fanfares in 20th's case). So, the girl LOST my bet. Greets from Salem.
Sorry for commenting again, but someone I was talking to about this point it out to me that she’s also getting up there in age… Maybe a family member or someone similarly close is doing this on her behalf, or possibly evencoercing her into this? It kind of sounds crazy, but also would make sense when you consider all the interviews. She’s done and stuff like that.

I think it’s sad. The tram car with any other voice won’t be the same. Why would she do this after all these years. It looks like someone influenced her. What a terrible example of the times that we live in. Nothing is sacred.
Who decided to file a lawsuit??? Was talked into it by someone else who can make a profit? Family? I can imagine that she is in her 80’s. Get a good judge to pull apart this lawsuit and then decide who or anyone is entitled to any of the money she could possibly garner from this lawsuit. Would miss the logo ‘ WATCH THE TRAMCAR PLEASE’

Seconded. Her recording of "Watch the tram car, please" is a big part of what makes Wildwood, Wildwood. It has become something much bigger than what it was originally recorded for... and the city should pay her for its continued use in tram cars, advertising, toys, rides, etc. The city should make a one-time payment for perpetual rights to her recording -- along with the right to grant its usage to various merchandisers.

I think after 54 years she doesn’t have a case to be compensated. However, she can probably get them to no longer use her message. They can simply make a new recording with a different person.
Why did it take her FIFTY years plus to all of a sudden decide this playing of her voice was wrong and offensive to her? I think some lawyer gave her this idea so that she can be assured of a financially comfortable future. This is the most absurd situation I have ever heard!
I would guess that this is not really a decision she is making on her own. Influenced or manipulated by others seems likely to me. At least I sure hope so.

There were definitely outside forces involved in this. Is this a frivolous lawsuit? Could be construed as that. Then again, she hasn't been financially compensated for her voice usage that the city of Wildwood and it's merchants have profited from. Like someone else commented, she may be in financial distress and some well meaning acquaintances have been advising her.

I think that because she had no contract for compensation for doing the recording, she is just out of luck there. She has the right to enter into a contract going forward, but I suspect the owners to just go with an AI voice from here on out.

You also made a great point in that trying to get money going all the way back to the 1970s is going to be extremely difficult or in my words nearly impossible. I just hope they keep her voice on the train cars and that the whole thing is thrown out but I understand that’s probably not very likely at this point.

Sad, but I understand suing for the merchandise and Morey ride. I was disappointed as a kid when I got my toy tram and it wasn’t her voice but turns out there’s a big reason for it.

I used to work with personal injury lawyers in Brooklyn, NY. Believe you me, some lawyer was probably eyeing this potential lawsuit for years. From their Machiavellian viewpoint, this lawsuit is a no-brainer slam dunk, guaranteed! But so sad to see another Wildwood tradition bite the dust.
All depends on whether there was a contract, even short one, and what was in it. No contract would be a different matter...

We shall see. I don't begrudge her being paid or pursuing a suit if she is in fact owed money.
Frivolous lawsuit. A judge needs to throw this out. Waiting 54 years? Seriously? If she wanted to be compensated for the message, she should've said something years ago. She was talked into this by someone looking for financial gain. The new tram car owners wouldn't have known anything about her or her voice being used. Waiting this many years after the use began, to file a lawsuit wasn't doing her due diligence, and at this point, I'd say the intent is malicious. Her voice will be removed, if it hasnt already. Her lawyers are casting a wide net, in the hopes of scoring a major settlement. At this point, I'd say the only compensation she should be entitled to is from whatever toys atre using her voice. Period.

Yea, no. They aren’t making money there my friend. They have 60 employees working at 15 min wage. Between rent, insurance and maintenance on 90 year old gear, they aren’t making much

@@patburke1961 not at all. It costs a ton of money to keep those almost 100-year-old machines going. For example, each tramcar has about 10 of those Duralast batterys. They run about $250, For 10 trams. Those have to be replaced constantly. It takes 60 people to run those tramcars a year at $15 an hour. That is 900 an hour or about 9,000 a day. Then add in insurance, maintenance, and electric bills (which is a fortune as you know from all of the ACE bills this past summer).
The one thing the lawsuit gets wrong is that they said they made 2.5 million a year. The lawyers based that on the avg that the tramcar sees 500,000 a year. But what that number didn't put into account is that everyone with a wristband rides the tramcar for free until 5pm. Which would mostly remove half of those numbers, so say 250K riders or $1.25 Mill.
If you account for payroll alone, for 90 days (June, July, August) you are looking at a payroll of $810,000 a summer. Now add in insurance, maintenance, batteries...etc.

I never liked the voice anyway. It always sounded like she said TRAIN car. If I listen hard I can hear TRAIM Car. I can never hear that short A sound. I hope the next lady has better pronunciation
To me, there's two parts to this...The first part, just the use of her voice for the tram car, no one's making money off of that, so she's got no standing there.
However, when they start using her voice as a way so sell toys and merchandise, and making a profit off of it, that's where I feel she has a case.
It's similar to the NIL situation with college athletes. for years, their name, image and likeness were used for the schools to make millions with the athletes getting anything for it. The Supreme Court ruled in favor of the athletes. It may not be the same exact thing, but kind of related, so I think she's due a piece of the profits from the merchandise that's been sold.
