Thank you for differentiating these two things po, because of this lesson we clearly understood what are the differences of preliminary investigation to inquest proceeding. Even though these two are the same in terms of investigating still there are a lot of differences just like in the preliminary investigation, this is conducted on a person who is not yet arrested and detained therefor there will be a regular filing and the warrant of arrest is not yet issued, its purpose is to look for a probable cause to proceed and file an information letter to the court. On the other hand, inquest proceeding is for those who are already arrested and detained that's why there is no regular filing to this situation. Its purpose is to determine if there is a valid cause for the continued detention. On this part, warrant of arrest is not needed, here, they will go back to the three basic rules of warrantless arrest and find out if it is valid. I've learned that they were both mandate and duty of a prosecutor. Their differences defines their purpose. Fundamental Investigaion and investigation continuing are the two positions of an examiner. In starter examination, the individual isn't yet captured and not yet kept, it will have a standard documenting, if there is reasonable justification to record a data, and there is no warrant of capture yet. The Preliminary investigation will take a longer path. This allows both the complainant and the respondent to refute each other. When the complaint, via an affidavit, is filed, respondent is given an opportunity to file his counter-affidavit. While in the Inquest proceeding, the respondent is already in custody. With the affidavit of the person who personally witnessed the crime, chances are the fiscal will find probable cause. This no longer entails any exchange of affidavits. The prosecutor files the complaint with the court. The court proceeds to trial.

I gained more additional knowledge today about the differences of Preliminary Investigation and Inquest Proceeding actually the number one and two of them is just a vice versa and the number of three when it comes to Preliminary Investigation is Regular filing then the purpose of PI is to determine if there is Probable Cause to file an information while the Inquest Proceeding the purpose of it is to determine if their is valid cause for the continued detention and the summary of nature, in Inquest Proceeding enter's the three basic when it comes to Arrest the In Flagrante, Hot Pursuit and the Prisoner Arrest.

If a person is NOT YET arrested, detained, no warrant arrest, there is regular filing and determining if there is probable cause to file an information. Therefore, the preliminary investigation is proper while if the person is ALREADY arrested, detained, the conduct of inquest proceeding with a summary in nature, determining the valid cause for continued detention and lastly the warrant of arrest is not needed hence the inquest proceeding is proper.

Thank you for differentiating these two things po, because of this lesson we clearly understood what are the differences of preliminary investigation to inquest proceeding. Even though these two are the same in terms of investigating still there are a lot of differences just like in the preliminary investigation, this is conducted on a person who is not yet arrested and detained therefor there will be a regular filing and the warrant of arrest is not yet issued, its purpose is to look for a probable cause to proceed and file an information letter to the court. On the other hand, inquest proceeding is for those who are already arrested and detained that's why there is no regular filing to this situation. Its purpose is to determine if there is a valid cause for the continued detention. On this part, warrant of arrest is not needed, here, they will go back to the three basic rules of warrantless arrest and find out if it is valid. This is just a simple explanation yet an informative one, thank you for this Attorney.

Great evening Atty. Much thanks to you for the all around clarified video exercise. I found out about the distinctions of primer examination and investigation continuing. Fundamental Investigaion and investigation continuing are the two positions of an examiner. In starter examination, the individual isn't yet captured and not yet kept, it will have a standard documenting, if there is reasonable justification to record a data, and there is no warrant of capture yet. Difference between Preliminary Investigations and Inquest Proceeding.
- Preliminary Investigations
A person is not yet arrested, detained and there is no warrant of arrest yet. And the purpose is to undergo regular filling and tk determine a probable cause.
- Inquest Proceeding
the person is already arrested and detained, no need for warrant of arrest or it is a warrant less arrest , and the purpose is to determine if there is a valid cause to continue the detention or not.

I have learned the main duty of Preliminary Investigstion which is to determine if there is probable cause to file an information for the accused, while the duty of Inquest Proceeding is to determine if there is valid cause for the continued detention of the deprived of liberty.
