    Hello, everybody out there in social media land, it's your personal injury, family law attorney, Derek Bernstein here to answer more legal questions today in the area of car accidents. So we're going hit you up with this question. What happens if someone else driving my car gets in an accident? So I'm going approach to this two ways. What happens if someone else driving my car gets into an accident. So one thing is, your friend hit somebody, and then there's your friend got hit by somebody. So first your friend gets hit by somebody they could go after you as the car under, under your insurance, depending what their insurance and things look like and depending on what your insurance looks like. So they could go after your insurance or go after you, depending on the car, the make the model, and how operational was, they could sue you as well as they're going to sue the person who hit them. So don't be surprised to that.
    Now, if they hit somebody, you're going to probably get, not probably, you're going to get sued if the person was obviously injured because under dangerous instrumentality, there's vicarious liability. Meaning if you lend your car to your friend, you already know this dangerous thing could hurt somebody, so you are liable if your friend goes out there and hits somebody, they are going to sue the owner of the vehicle. That sucks. That sucks. Your friend drove like an idiot. What are you talking about? I told him not, he was drunk. Unless they stole your car. If you gave them the keys to go and drive you, you can be on the hook if they get into an accident so don't lend your car to people, make them Uber, pay their Uber. It's way better than letting them do that.
    And things get complicated in this arena, but you would put your insurance on notice of this happening and they will provide an attorney for you and hopefully, it's not your friend's fault, hopefully, the person they injured, isn't very hurt. So it's the same kind of thing if you've ever been a car crash in reverse, you're defending it, and it sucks because you didn't do anything wrong, except don't lend your car out to people because vicarious liability, dangerous sense mentality will catch you and it sucks.     I got a question my mom got ina 3 way accident here in Georgia in my vehicle and it’s totaled so she did end up getting a ticket idk the police report because she got hit supposedly they ran a light when the lights wasn’t working she stopped and was treating it like a 4 way stop sign. But she got and they got her with fail to yield but what happens with my insurance ? Will they pay my car off ?

      I do not know Georgia law. You can fight the ticket (which will help your claim) that the other car was at fault and can open a claim against the vehicle who hit her.

    What if my friend takes my vehicle to a dmv test drive and hit someone or if someone rear end him? I’m I still reliable for the damages or my insurance and would my insurance goes up in price?

      Yes, if you make available or give them the use of your car you are liable for the damages they created. Both of you would be on the hook separately and equally. Would it go up is more than likely.

    I was in a hit and run in my daughters car. They fled the scene. My daughter reported it but not making a claim due to her deductible. Will my insurance go after her if I make a claim for bodily injury? Oh I don’t have uninsured motorist coverage

      If you don;t have UM coverage where are you trying to make a claim? your daughters insurance? Are you saying it was her fault? Does she have UM/?

    What if there wasn’t much damage and no one was hurt let’s say in traffic a small rear end this just happened to me in my girls car that’s insured under her

    So quick question. If someone is under my car insurance and they crash a vehicle that's under my insurance to someone else's car. Can I get sued too even though I wasn't inside the vehicle? Or only the person that was in the vehicle?. Here in Michigan?

      I do not know Michigan law but in Florida the owner of the vehicle is vicariously liable for what others do with their car. Meaning if they crash your car, you’re on the hook. Get more insurwnce .

      @The Social Media Lawyer well what if you aren't the owner of that vehicle but that person is just on your insurance with you. And crashed into someone else's car and you wasnt in the vehicle. Will only the person that own the vehicle be responsible even though they are under my insurance.

    So i had my wife on my insurance she got in a accident cause 2 adults ride in ambulance and cuts and bruises. So I’m gonna get sued from those individuals correct? They have an attorney. Will an attorney help my case if I get one?

      Did you own the car? In Florida if you did you would be vicariously liable for that. Your insurance would provide counsel for you and they would know the laws of your state.

    What if I’m the owner and the friend didn’t have insurance neither did I have insurance? I’m taking my friend to court but I don’t know if I’ll get anything

      Im assuming they only caused property damage to your car and didn't cause any personal injury to someone?
      If that is the case, does your friend have assets and monies to be recoverable. Also suing a friend ends that relationship for sure. So whats the friendship worth?

      It’s my ex husband and he totaled the car out it flipped three times 3 minutes from my house. The driver in the other car was not hurt and her car was barely touched. Crash report states he was driving wreckless and hit her, but I’m on disability I thought I had the car added to SR22 they have me down as a none owner for three years when I own 2 vehicles smh that’s Chicago for you. Anyways the accident is in Indiana. So he’s running not answering the phone and I just submitted a civil case on him yesterday but I’m nervous that the judge will throw it out because I didn’t even own insurance neither

    Is it possible that the person that took someone's car and the owner told them no.Can the person get sued for taking the car even if you told them no ?

      In most policies that I have seen there is an exclusion for this type of action where the person doesn't have "permission" It is complicated but a defense for sure. You will still get sued and have to defend it. Your insurance should provide an attorney for that. Thanks for watching.

    I really need help here !! I was driving my friends car that’s under her moms name and all with permission except the mom and we crashed into trees and flipped and one of the passengers are trying to get money to pay for their med bills because she has no Medicare or insurance

      I don’t want any time or a lot of charges :(( the car has full coverage and the passenger is trying to get the insurance to pay it but I know I’m ducked and I have no license and I’m 17

      @@serenityadame3203 Best part about being 17 , no license is I highly doubt you have a giant net worth of money for them to sue you for. I don't know where this happened so contact a local attorney there about the ability to sue parents for actions of minors. They will go after the owner of the vehicle and their insurance.

    I just got my license 2 days ago the car I have has insurance but only my girlfriends name is on it I tried calling her insurance to add me as a secondary driver but their closed today. Would I get in trouble if I drive it to work today would I get in trouble if something happens if not on it yet?

      So as far as driving, as long as your license is good then there is no law I know for that in Florida. Could be different in your state. Its not smart to do as they could deny any claim for you driving it. Id have her give you a ride until your added just to be safe. Appreciate the watch.

    I got into a accident almost 3 years ago i was driving my sister car no one got hurt and the vehicle wasn't that bad... I call the cops they said it's wasn't my fault and now after that long they try to sue me please what should I do please?

      did you personally have auto insurance or your sister have insurance? If yes to both, call both. If just your sister, get that info. We saw a big wave of filings as part of Desantis new laws.

      I did not have insurance buy that time because i was living in NY, but my sister does because and they said they will not covet it because my name was not under the insurance

    So my friend let me drive his my mom car and I crash since I didn’t have a license he gave a statement to police saying he did in I liable to pay anything (also live in Canada)

    I'm in this exact situation my b!tch I mean my girlfriend..was driving my car & hit somebody's car (her fault) & their insurance is filling a lawsuit..I'm in Connecticut so I don't kno the laws I hv to call the Co. to find out if they suing me or her 🤔 but from what you say then it's me or is it? Thanks I really need your advice...

      I am not sure exactly the laws of Connecticut, however in Florida they would sue her (Driver) and you (the owner) of the dangerous instrumentality> What are your policy limits?
