In Detroit, apparently the authority to take property apparently requires almost no justification. Good luck with your lawsuit. I hope you can make those individual officers who falsified records pay if you can, not just the city of Detroit. Falsifying records, using their authority for financial gain, damaging private property, defamation, altering legal records, and using police authority for personal, professional or financial gain.
that's in pretty much every single state and city. civil forfeitures are a thing. they just say they suspect you of a crime and can say you used x property or you're about to commit a crime with x property. In some states they can force you to give them your debit card and they can take all of your money out of your bank claiming you were going to use it to commit a crime... that's just cops. some banks will seize your funds if they suspect you..
If this outrages you, please consider supporting the nonprofit Institute For Justice. They are just about the only law firm fighting civil asset forfeiture abuse.
More than having an organization of lawyers to battle for the reclamation of seized property, there needs to be lawyers willing to challenge and sue against the legislature, PD in Federal Court. 😣 The law and implementation by the PD are clearly Unconstitutional; Violations of The Fourth Amendment which states explicitly that a warrant is required for search and seizure according to the specifications stated and includes "probable cause". 🤓 There is NO permission to threaten, arrest, search or seize property, persons, belongings, affects based upon potential or association, especially just upon presence which is legal. 😏 We clearly get the basis of the law, which is Authoritative and intends to threaten those that are passive or just present, but not actually participating, but the claim is intended to allow the police of accuse, arrest, etc. those that are passive and not actually in violation of any law. 😑 However, the US Constitution, explicitly, strictly prohibits such invasion of individual rights and include all such legislation, rules, laws, orders, 😒etc. at every level from the Federal, State, County, City through local. Simple. 🤓 Period. 🤓 Sincerely 😄
@@newtonfirefly3584 I agree 100%. The law needs to be challenged at the highest levels, instead of just on a case by case individual level. Qualified immunity is another issue that needs to be challenged. I'm not anti-police at all, by the way. But the statute as it stands is clearly not only unconstitutional but illogical. Right now a rogue LEO can violate your rights with impunity so long as they do it in a way that has not been previously adjudicated in another case. I don't really have the vocabulary to convey the problem concisely, so I will use an analogy: suppose a district court has previously ruled that some officer A was in the wrong for entering a citizen's house while in uniform and taking all the cookies from the pantry. Qualified immunity as it is being applied now means that when officer B enters a citizen's house in uniform and takes all the breakfast cereal from the pantry, the precedent from the first case can not be applied. Even though anyone with common sense knows there's fundamentally no difference between taking the cookies and taking the breakfast cereal.
@@ShadowWizard123 yes, am glad You comprehend the illegality and unconstitutionality of the law. You described the the concept of "qualified immunity" well. However, from where did You get this legal concept from? Also, it would not apply to any law or violation of the constitution, clearly. There does not need to be a precedent, since the law is clear, therefore there can not be any immunity. This concept must only apply to specific type of laws or cases, but am not yet familiar with it. Will search about it. Sincerely

Sadly I don’t think he’d win a lawsuit, civil asset forfeiture law is very sided with the government. No crimes or convictions need to be placed for them to take cash, cars, homes, etc
@@n.ademak5842 but this was not suspected to have been the proceeds of criminal activity, nor was the criminal activity proven to have happened in detriot, (a matter of venue). The government can take anything they reasonably suspect is ill gotten from illegal activity (cash, property) but they would have a hard time proving this case, in the end, however long it would take. I remember someone had their truck taken for 5 years. He filed a lawsuit and when it was gaining traction they gave him the truck back to have the lawsuit dismissed as "moot". So yeah they can play lots of games but if it's unconstitutional without due process it will eventually be settled through a lawsuit.

They're so stupid. Film and tv studios wanted to film all over Detroit (due to the state of many areas) and the city said they wouldn't give them any tax breaks, so they kept on going to Georgia.
This is unfortunately also happening in Denmark. Back in 2021 a new law was passed, giving police the right to impound your car, if you do double the speed limit or go over 200 km/h. The worst thing is, they don't necessarily need to have measurement of your exact speed, meaning that they can claim that you have been speeding, streetracing etc. Your car will then get impounded by the police and you will "maybe" get it back.
As a fellow native from Kalamazoo I’m glad to hear that you at least got the cars back. It just sucks that you had to go through all of that and spend a bunch of money for your cars that never should have been taken to begin with.
I never heard of this page until RUclips recommended it a few minutes ago after I watched a Lehto video. Between cars, Michigan, and asset seizure, it totally sounds Lehto-appropriate.
Was thinking the same thing. Something needs to be done about stuff like this. It's an outrageous abuse of power by law enforcement and a disgrace to the good police out there. Some people need to lose their jobs and ability to be hired as law enforcement for life.
This is the same city that was illegally selling people's homes for a couple thousand dollars of back property taxes. The state Supreme Court eventually forced Detroit to stop, but since they had stolen so many homes and it faced such massive liability, they didn't face any repercussions... Only would if they did so going forward.
@@BabyJesus66 correct, but the surplus goes to the homeowner. Detroit was likely keeping all the proceeds, leaving the homeowners with nothing but a mortgage liability.
@@SuperVeeZee and they were also artificially inflating the assessed value of the home to squeeze more tax revenue. On top of that, they were doing it very quickly as opposed to the owner having a bit of time to rectify the situation. Literally stealing houses out from under people. This individual had been incarcerated and had charges pending and had a fatal accident in the midst of that. Marion County, Oregon does this sort of thing too. I'm unfortunately VERY aware that they would claim they smell pot from a sports car, take it, and gamble that the 17 year old kid can't afford the storage so the sheriff can keep the cars and use them as unmarked cop cars.
Mustangs, Subarus, a Hellcat, all are or have been used in this county. No Lamborghinis that I'm aware of, but the kind of kid who is going to have a hard time pushing back isn't going to have much more valuable a car than a Mustang or WRX.
Which is why they target kids, not youtubers.
Gee, what do Detroit and every county in Oregon have in common?

In Detroit, apparently the authority to take property apparently requires almost no justification. Good luck with your lawsuit. I hope you can make those individual officers who falsified records pay if you can, not just the city of Detroit. Falsifying records, using their authority for financial gain, damaging private property, defamation, altering legal records, and using police authority for personal, professional or financial gain.
Rico suave, AKA RICO
@Jesse Garcia Detroit operates under its own laws. It is like the law of the jungle.
that's in pretty much every single state and city. civil forfeitures are a thing. they just say they suspect you of a crime and can say you used x property or you're about to commit a crime with x property. In some states they can force you to give them your debit card and they can take all of your money out of your bank claiming you were going to use it to commit a crime... that's just cops. some banks will seize your funds if they suspect you..

More than having an organization of lawyers to battle for the reclamation of seized property, there needs to be lawyers willing to challenge and sue against the legislature, PD in Federal Court. 😣
The law and implementation by the PD are clearly Unconstitutional; Violations of The Fourth Amendment which states explicitly that a warrant is required for search and seizure according to the specifications stated and includes "probable cause". 🤓
There is NO permission to threaten, arrest, search or seize property, persons, belongings, affects based upon potential or association, especially just upon presence which is legal. 😏
We clearly get the basis of the law, which is Authoritative and intends to threaten those that are passive or just present, but not actually participating, but the claim is intended to allow the police of accuse, arrest, etc. those that are passive and not actually in violation of any law. 😑
However, the US Constitution, explicitly, strictly prohibits such invasion of individual rights and include all such legislation, rules, laws, orders, 😒etc. at every level from the Federal, State, County, City through local.
Simple. 🤓
Period. 🤓
Sincerely 😄

This is unfortunately also happening in Denmark. Back in 2021 a new law was passed, giving police the right to impound your car, if you do double the speed limit or go over 200 km/h. @David Field Ummm, okay and....????
This is the same city that was illegally selling people's homes for a couple thousand dollars of back property taxes. The state Supreme Court eventually forced Detroit to stop, but since they had stolen so many homes and it faced such massive liability, they didn't face any repercussions... Only would if they did so going forward.
You can buy people's homes on tax lien sales if they don't pay property taxes that's not illegal
@@BabyJesus66 correct, but the surplus goes to the homeowner. Detroit was likely keeping all the proceeds, leaving the homeowners with nothing but a mortgage liability.

This individual had been incarcerated and had charges pending and had a fatal accident in the midst of that. Anyway I am thankful for the local drag strip if more of us who enjoy high performance supported tracks and road courses then we could scratch that itch legally where it wouldn't be a problem.
