Honey i think you should get a 38 because the cotton yarns in a denim composition for this heavy denim get more dense after washing which makes it even tighter and get this loose after wearing 2-3 times. Usually denims of Zara & H&M are heavy GSM so make sure to always have some room in them when they are new so later they aren't tight after washing. This seems like you won't be able to sit in it even so 38 would be a better fit indeed.

I usually solve the problem by making my own clothes or for jeans I take metal hooks to apply to the waist to tighten them by at least 20 cm, because by having a seamstress tighten them then they no longer fit over my hips

h&m sizing is different. Size 40-42 is 30-32. If she is 36-38 in h&m then she is 28-30 in Indian size. but even i feel she is laying about her sizing.
