      From what I'm reading, they're not even actual police. They're pretty much just security guards paid with tax payer money; they're not even allowed to carry firearms at the airport.

And furthermore, they can even call the police to have you removed and placed on a No Trespassing notice, even when you have the library as your witness to prove the library was at fault and your course of actions was not....     Since airlines can not guarantee a seat, passengers should only pay at the conclusion of the travel. Because, even being seated does not ensure you would travel. Passengers still have a risk of wasting time, in case they don't fly. Who should pay for the loss of time.
    Why would someone pay in advance for something that is not guaranteed? When you go for shopping, do you pay for something not sure of getting for your money?

    I love this attorney, like everything he said, especially saving some seats for emergency, he is protecting passenger's right. As a frequent flyer, I hate to see airline has control to use force to passengers. I also hate other things, raise price on any opportunities they could get on any way. Wish Dao get well soon and Corboy & Demetrio continue successful.

      His opening statement is cohesive, very compelling and get to the point. "May be the airline industry have to expect the unexpected but not as a passenger expense.       Private property is handled differently than PUBLIC and COMMERCIAL property. The man's purchased ticket gave him a right to be on that plane. If you invite someone into your home, you also have a right to revoke that invitation at your discretion. If we're talking about a TENANT, then he has a legal rental contract giving him the right to be there and you must use the courts to get him out. This is pretty consistent.

    I hope all airlines learn from this. Treat passengers as clients! I always disliked every American airline for their extreme bad service and try to avoid them as much as I can. All airlines: we pay your salaries, costs and profits! Take this in mind every second you are in contact with a passenger!

    I take some joy in this event (although I wish it wasnt at Dr. Dao's harm), finally United is going to get what they deserve. This airline has been garbage for decades, I have refused to fly with them since 2007.

    I really hope that Dr. Dao will not settle out of court. Don't allow these guys to not be punished for their crimes.
    Dao will also be awarded more money by a jury than he will be able to get in a settlement.
    In any case, it is unacceptable and immoral that paying money can replace the punishment for a CRIME.

    If for example this case went to trial and I was one of the jurors, I would probably award at least $50 million in punitive damages for Dr. Dao. That's how much I, along with the majority of the public, would like to punish United Airlines for doing such an inhuman and horrific mistake.

    In all of my years in public safety, and that runs close to 34 years, I believe the way this passenger was dragged off the jet was wrong. You are dealing with an elderly man. The man bought a ticket and was seated in his seat waiting for take off. Had this man been causing a disturbance, yelling, screaming or otherwise bothering other passengers, the use of force is warranted. Now having said that, what amount of force? There are ways police officers can get a passenger off the plane without dragging him off like they did. Either these security police were not thinking, or more than likely, not sufficiently trained for this situation. There are more subtle ways to obtain compliance and if I were in that position as an airport officer, I would ascertain what the problem was before taking any action and if action was needed, it would not have gone down the way it did. The airlines do overbook and do have the right to force passengers off with compensation. I do not believe I or any partners I have had from '72 to '06 would have handled this situation this way unless there was violent behavior. I did not see anything like that on any video which has been shown to the public. This was overreaction on the part of the airline and certainly excessive force by the officers. Judge Napolitano is right in my opinion, this case really is indefensible. Bringing up his past regarding drugs and such has no bearing and at the time, who knew and how does that matter? I believe United Airlines is going to be writing a pretty big check and maybe even a bigger one if this goes to trial. I am close to David Dao's age and I sure as hell would not want to be treated in this manner for just sitting in my seat!

    the poor guy will have to undergo reconstructive surgery, because they officially beaten not bullied. I have never ever seen or heard this and trust me I have traveled to multiple countries. I hope it goes to trial against one of the best trial lawyers in the city. I hope he rips them apart. Settling this case will mean that other people will suffer the same abuse right after they write a little cheque to quiet this. Again I pray for this to go to trial, with all the evidence they might have gathered against these traveling bullies, I hope they dismantle them

    Simple solution....
    When airlines oversell seats and need to be able to get passengers to give them up, just do an auction.
    Offer increasing prices for seats until enough are given.
    Surely before they reach $5,000 per seat they will have plenty.
    And not oversell so much in future.

    Surely the obvious solution to this situation is for the airline to continue to up the compensation offered until somebody VOLUNTARILY gives up their seat. $1,000, $2,000 ... whatever it takes. This incident will wind up costing United millions in a settlement, hundreds of millions in bad publicity & possibly billions in stock losses.

      They were not police, but CDA (Chicago Department of Aviation) security guards. CDA has agreed to remove the word "police" from clothing and resources (cars, etc.)
      The guards are not trained in removing passengers.
      CDA is paid out of the profits of the airport, no taxpayer money is involved.

    The Judge is correct. Corboy & Demetrio is probably the best tort firm in Chicago and probably one of the best in the country.
    Tom Demetrio's press conference was very impressive. I can see why they are so good.

    Two things here 1. he took the offer left the plane,didn't like rebook options ran back onto plane. 2. by leaving the plane,he was no longer authorized to be on plane. A direct violation of FAA security directives.
    He'll get his money, but will also be fined and most likely jailed.

    The problem was not with the airline, it was with the way security handled it. If anyone thinks the airline doesn't have ways around freeing up seats for down-line deadheads, you got some surprises and delays coming. Next time they can't get anyone to volunteer to give up their seat for compensation like this, they will just deplane everyone back to departure, and select the people from there.

    People should get it straight that the guy who removed the doctor was NOT a policeman, even though he wore a jacket with the word "police" on the back. I just watched a RUclips video of a meeting of the Chicago City Council where a United Airlines agent explained that it was one of their private security guards who removed the passenger. The security guard wrongly wore that jacket because he was not a cop. United gave their security people money to buy security uniforms and that guard went against United's directive and bought the Police jacket. He was in civilian clothes but wearing a jacket that was inappropriate, and the passenger, who could not see the back of the jacket, had no way of knowing who the man was who was threatening to remove him. So the city of Chicago was not involved in the injustice. United simply screwed up and now will have to face the consequences. The security guard will be lucky to work at McDonald's for the foreseeable future.

    At 3:00 Judge Napolitano says that it's legal to remove a troublemaker from the plane using "a reasonable amount of force". Reasonable force is not the issue; UNreasonable force is.

      but refuseing a offer to sell ticket back is not grounds to be asked to leave a plane on the ground and not moving only a unruly or harmfull or life threathening passenger for the convience of the airline is not a breach of the customers obligation to travel orderly therfore no grounds to be thrown off the order has to be a lawfull command also when in flight

    As far as I am concerned, once you have been allowed to board and you are seated, if as in this case and you have done absolutely nothing wrong, then you should not have to give your seat up. This should of been done by United Airlines before anyone had boarded. It should be written in Law, that your seat is secure after they have allowed you to board.

    The removed passenger was offered and accepted a fee for selling back his seat to United and he reboarded and took the seat.

      They were not police, but CDA (Chicago Department of Aviation) security guards. CDA has agreed to remove the word "police" from clothing and resources (cars, etc.)
      Two resigned, 1 was fired. Their supervisor, who told them to do this, was placed on paid leave; I can't find any more info about what happened to him.
      1 security office is suing United now, says he wasn't trained for this so not his fault.

    The world is going crazy it seems. How can a commercial enterprise even consider behavior like this and hope to stay in business? It boggles the mind. They must be out of money completely. If not, why not raise the compensation until a volunteer stepped up? Some managers are going to get a pink slip now, because the company saved the dime only to pour out the dollar in an expensive settlement - and on top of that bought itself the worst possible reputation. It's crazy...

      He reports he used to run wo or more marathons a year, but can't do that anymore. Still has trouble with balance and walking, problems with concentration and depression.
      He was on suicide watch at the hospital.
      So sad.

      Thomas Jones No way gets settled for less than $10 million. I say $20 million minimum. I wouldn't be surprised if the final payout is over $50 million.
      Dr Dao is also a professional poker player so he knows all about leverage, momentum and stuff like that. He knows he has United by the balls. Dr Dao wants United to pay up big (to the extent that his grandchildren are set for life) or be embarrassed. United picked the wrong guy to fuck with.

      xuimod If it isn't settled before it is heard before a jury. If other defendants are also sued. If a jury hands out a winner to Dao, then perhaps you could be correct. However, this is a different game than Poker with many variables that may have been overlooked. May Justice be served and the doctor recover completely. Namaste TJ. 🌅

    Badly reported:
    1.) Boarding can be denied. Boarding. That's what your ticket says. Boarding is when they scan your ticket before you walk into the airplane. Once you're in the airplane there's nothing in law or in the ticket / contract that allows you to be unwillingly removed. Only BEFORE you enter. (True, as they said, you can be removed if you're a danger or acting illegally. Dr. Dao was peaceful; as he explained, he had patients the next day.)
    *2.) They WERE NOT POLICE.* The Chicago Department of Aviation, which runs all Chicago airports, have their own SECURITY. They are untrained. The 3 security people were folliwng the directions of their supervisor. (The show did say once that these were security, but neverrtheless kept using the word "police".)
    CDA has agreed to remove the word "police" from clothing, vehicles, etc.
    Two of the security people resigned, 1 was fired. The supervisor was placed on paid leave. I can't find out what happened to the supervisor. One of the security guys is suing United Airlines because he was not trained for this work.
    3.) Dr. Dao is Vietnamese-American. Can anyone say "racism"?
    4.) This was not overbooking. United suddenly decided to add 4 employees to the airplane to go somewhere, and this was the cheapest way to send them.

    The solution is simple. Airlines should be prohibited from overbooking. Second, the common carrier contract should explicit state that once a passenger had been ticketed and allowed to board, the airline has no right to remove the passenger unless he presents a clear danger to the crew or other passengers or is disruptive.

    I would not blame any airline where a passenger is unruly, disruptive, causing chaos, being disrespectful, or any other obnoxious behavior, nobody would tolerate such a passenger - Entitled passengers can certainly be a nuisance. And, the airline would have good cause to remove such passenger using some reasonable force. This case with United is neither. I heard that this passenger was going to be accused of trespassing, how ridiculous is that? Businesses have the right to refuse service, there is no law that can force a company to offer services or sell something to someone they happen not to like, however, you better have a good argument for that in court.
