The statement that he never lost his filipino citizenship is a motherhood statement. Before one asserts his right to filipino citizenship, one must demonstrate allegiance(means dedication or loyalty) to the country and submit proof that he performed his duties as a filipino.
Did he fulfill his duties as a filipino citizen?
(1) Did he fulfill his duty to participate in democratic processes by
voting in Philippines election?
(2) Did he fulfill his duty by
paying taxes religiously under Philippine laws on income derived from all
sources from its inception?
(3) Did he fulfill his duty to support and depend
the CONSTITUTION by consenting to the issuance of PDR to foreign nationals and
entities?
(4) Did he fulfill his duty to OBEY the laws by paying correct taxes and
operating broadcasting facilities strictly in compliance with his franchise?
Citizenship is conferred upon birth. If citizenship were to be earned in the Philippines, what is one's citizenship, of Filipino parents, prior to earning it?
Archie Meneses don’t you realize that Eugenio ‘Gabby’ Lopez was born in 1952 which means that the prevailing Constitution when he was born in 1952 based on the 1935 Constitution of the Philippines promulgated during the Commonwealth Period and because Gabby has two parents that are Filipino basically Gabby Lopez is a Filipino. Moreover, Gabby Lopez was born in the United States, however, he did not grew up in the US because he never sworn nor pledge the allegiance to the flag of the United States and the Constitution of the United States. Furthermore, Gabby Lopez came to the US later in his life to study at the University for undergraduate and postgraduate which they do not require all students to sworn nor fledge allegiance to the United States. In talks of renunciation of his American citizenship is rather baseless, farcical and too nationalistic in my liking. I understand if you’re running or elected in a position in local, provincial and national level of politics then u can’t have dual citizenship. But if the talk is to renounce Gabby Lopez’s American citizenship because he’s the head of the largest media network I think it’s getting far too much. Do you really think that it’s easy to renounced your American citizenship, which all the unalienable rights and privileges of being an American is given to you by birth, no because renunciation of you’re American citizen is difficult and complex.
@@Thatsstraightup Let me scrutinize your premise that Gabby Lopez " never sworn nor pledge allegiance to the flag and Constitution of the United States" when in fact applying or renewing American passport includes documents you need to fill up states your allegiance to the United States Govt and its Constitution and one of its mandate is to renounce all other citizenship you acquired. See ACTS AND CONDITIONS of passport renewal and applications that can be downloaded. It is also stated in U.S. Constitution. It is very clear that Gabby Lopez is a 100% Fil-Am. And let me give you a simple LOGIC here. Given that Gabby Lopez is a Filipino that can own and manage Phil. Mass media therefore American can also own and manage the same because Gabby Lopez is also an American.

@@jamesbong844 That is certainly a good question. Just to be clear, I am not defending Gabby Lopez. I am just giving my reaction to the view of retired SC Justice Tijam that citizenship is earned. For me, it is not earned. As far as Philippine laws are concerned, you received it from the time you were born. You do not have to do anything to perfect your Philippine citizenship except if you were born under the 1935 Constitution of Filipino mother and a foreigner father. Gabby Lopez did not need to do anything to perfect his Filipino citizenship because both of his parents are Filipino. He is not a Fil-Am. Asking for recognition maybe considered superfluous. But then again, he wants a Philippine passport. You cannot have a Philippine passport if you did not have a Philippine Birth Certificate. He did not have one because he was born in the US.

It really has got nothing to do with allegiance, but the citizenship. Citizenship and allegiance are two different things.
As a dual citizen, is he a Filipino citizen? The answer to that is yes. Is he an American citizen? The answer to that is also yes. The rest of the arguments, is he faithful to the Philippines or USA, are his parents Filipinos or Americans, those are irrelevant. What is relevant is his citizenship.
It's now up to the congress to decide if his dual citizenship is an issue. As of loyalty to the Philippines, did he do in any capacity, to renounce Philippine citizenship? And his answer was no. But similarly, did he do in any capacity, made any effort to renounce his US citizenship, and the answer is also no. So he also has every bit of intention to remain a US citizen. He was doing it, so that in case something goes terribly wrong, he can always hide in the US, and he will be beyond reach of Philippine government's prosecution as an American Citizen.

If you apply US passport and you have US birth certificate , they will not asks if you are Pilipino, you will just fill up all the requirement and the send it thru post office. And after two month you will get already your passport. If you are Pilipino, and if you want to be US citizen, you need to take interview and if you pass the interview , you will take an oath. But if you have a US birth certificate you don’t need to file to be a US citizen, because you have already a US birth certificate and don’t need to take an oath to become US citizens. I believe mr. Gabby Lopez the he didn’t took an oath to US gov’t. and did not recited the pledge of the legion of US cause he studied his Grades school and high school in the Philippines .

I think the percentage pertains to blood or ancestry. So Mr. Lopez is a 100%Filipino by virtue of his Filipino parents. With such parentage, he is a Filipino citizen by right according to our Constitution. But can he also be an American citizen? Apparently, yes.

@@donaldsonparas8924 Both Gabby Lopez's parents are Filipinos, so indeed Gabby Lopez is a 100% Filipino by blood, hence he is a Filipino citizen. I think what needs to be accepted is that one's citizenship cannot be expressed in percentage because of the possibility of being a dual citizen. Questions of citizenship should be worded as, "Is he a Filipino citizen or not?" or, "Is he both a Filipino and American citizen?" with no wording of percentage thrown in. So if we want to be really strict with that requirement in the constitution, it should be worded, "must be a Filipino citizen ONLY" (and not a "100% Filipino") in order to disqualify Dual citizens from owning Filipino corporations.

Yeah the question sound stupid but the little question very important cause I been through the same thing went I became American citizen 20yrs ago I have to be same question for me being Filipino and proving that I'm American citizenship now
Congresswoman Batista did a good job and revealed Lopez perjured with the U.S. when he renewed his passport in 2015! Because he filled for his Filipino citizenship in 2001!. He should be charged by the U.S. government for that.. Lopez evaded a direct question when asked if was holding a Philippine passport when he took control of the station by saying it was not "required" at the time.
The fact that he still uses his US citizenship and voted in 2016 US election therefore he is still a US citizen and is not 100% filipino, if there will be conflict between US and the Philippines sang bansa sya makikipaglaban? The best question is to ask the wisdom of the proponents who finalized the constitution. Why they used 100% Filipino citizenship? Why not natural born citizenship? Because a natural born Filipino might be borne to other countries. Just like what happened to Mr. Lopez, he was an American citizen because he was borne in America even though his parents are both Filipinos. Why not just Filipino citizenship? Because Foreigner by process can acquires Filipino citizenship. In the case of Mr. Lopez, he has a dual citizenships . Thus he is 50% American and 50% Filipino . Mr. Lopez with his age did not withdraw or renounce either one of these citizenships because he enjoyed and benefitted of having both of these. The wisdom why the constitution requires 100% Filipino citizenship, this will highlight its difference to a natural born, a dual or just a Filipino citizenship. This assures that the only entitled to have an ownership to a mass media company has no divided loyalty to the Philippines as his sole country. In case of conflict with other countries, he will not be influenced, pressured and divided .This will guarantee that he will stand without hesitation for the betterment of the Philippine flag. Using US passport is for the benefit of travelling without the stress of applying for travel visa for travelling to countries requesting for visas. Also ano yang 50/50 na paulitulit na tanong. Filipino citizenship is by virtue of being born to both filipino parents while other citizenship is acquired thru application but it doesnt mean you lose your loyalty to country. Its like marriage u marry and vow to each other to be together for better or for worse but it doesnt mean you totally disregard to abandon or disrespect your original family. Deep in your heart as filipinos we always have that loyalty to our heritage as FILIPINOS.
