  • There is something many disabled veterans do not know: Even if one is working or capable of working, eligibility for VA disability compensation is still possible. You can receive VA benefits regardless of your employment status or ability to work for many VA claims. The VA does not even consider it in its evaluation of the condition. It is important for veterans to apply for benefits regardless of whether they are able to work. Instead, disabled veterans should familiarize themselves with the rating requirements for the conditions at issue.

    Does “work from home” qualify for this ?
    It’s a sheltered work environment but it’s a W2 gig. Please explain. Thanx.

    SMC-S is also a minefield; If you're truly housebound then you better not, but if you're 100+60 then it's implied that it's in your "best interest" not to work. At least imo/experience

      I respectfully disagree. There are two parts to SMC-S. The first one being housebound. The second being rated SMC-S based on the rating criteria. You can still work.

      How does one obtain a “sheltered work environment” if you’re 100% TDIU without losing your VA benefits? Do you suggest I obtain an attorney (H&P) to do this? Please 🙏🏻 advise. Thank you 🙏🏻

    If I play in sport tournaments and get paid is that considered working. I play as self therapy for PTSD. Can this be considered sheltered?

    How do you know if youre TDIU or P&T?

      Well, to start, you would have to have applied for TDIU. If you didn’t apply directly for it, you don’t have it. One way to tell if you’re P&T is if you start getting paperwork in the mail about education benefits.

      IT SHOULD SAY IN YOUR AWARD LETTER FROM THE VBA. YOU CAN BE BOTH. AND MOST WITH TDIU ARE ALSO P@T.

      Sheltered just means it doesn’t exist in a normal competitive job market.
      It could be for any disability that prevents you from having substantially gainful employment.

    I have a 70% rating but received at letter after a C&P exam that I have t&p with unemploybility at 100%. Due to my mental health issues. I have been told by a friend to try being a narrator for audible books because some will allow me to work when I can in my house. Would this be considered a sheltered work environment?

      Be very careful. If you are W2 employee they will reduce you.

      @matt_spencer_photos4102 before I got t&p my rating is 70% tdiu. My last C&P exam letter came back that I still have tdiu but with t&p now.

      For the purpose of VA disability applications, sheltered employment means that your employer knows about your service-connected disability and makes accommodations that allow you to continue working. Often, sheltered work environments involve working for a family member or a close personal friend.

      You’re good… as long as you’re not on TDIU, I really wouldn’t stress about it. You can pretty much work as much as you want.
