Best friend interviews best friend regarding issue involving both of them.
It seems that JNandez's big issue is that joeingram1 made 25% by being an affiliate, whereas JNandez made 25% (net of the affiliate commission) by being the content creator.
It's so baffling Doug. You give a guy 25% then let affiliates take even more. I'm so confused as to why he was upset lol

27:21 - August 4, when fernando admitted to launching other product and said "that was a stupid idea" or "that was very dumb" it's very hard to buy it and suggests everything was premeditated
31:27 - Oct 23, "heard you guys had impt meeting last night anything impt you wanna talk abt?" pretty clear that doug did try to reach out to fernando and fernando had intentionally avoided bringing up topic of quitting upswing. it was good opportunity for him to fernando to express to doug he wasnt happy with the current business deal.
32:51 - Dec 27, doug replied fernando's christmas wishes with "everything good with you lately?" distinctly shows both had no spoken during this period of time, falsifying fernando's claim that there was alot of heated exchanges between the two.
imo, given fernando's meticulous character, he could easily have posted and rebutted dougs claim that both of them had not spoken during this period by posting skype calls between the two to show doug was lying instead of going thru the trouble of showing posting his estimated earnings and that doug was bullying him over skype calls(if i rmb correctly). if this event was a lie, wine incident at dougs house might be false too.
i did feel rly bad for fernando when he posted the video, but right not it seems that quitting from RIO in 2015 and upswing in 2017 before launching his own product seems like no coincidence. also feels like doug may be hated by some but hes well liked by all of the ppl he had business dealings with, while fernando seems to have problems with most of his business partners(scarf incident). These are facts and unless theres something more concrete from fernando instead of a boxing match to redeem himself, i would clearly go with doug's story.
They should do a video on skype going thru the numbers and posting it in public, and doug could get someone like educa (another contractor who probably isnt as close to him as someone like joey as a fair third party) to describe his personal experience dealing with doug.
not rly sure abt how compensation for indepedent coaching goes in poker training industry, but doug could only be accused for talking fernando into a bad business deal, while fernando is probably guilty for smth way worse, even from a business standpoint (attempting to steal clients from both upswing and Rio). dougs claims are all systematically suppported with facts while fernando's are merely opinions it's hard for doug not to crush him here

Doug says he doesn't even like poker anymore. HUGE contrast with Galfond just a few days ago where he literally said he LOVES poker and misses it a lot; even wishes he could play MORE

If you don’t want to wade through all this mess then here’s the cliff notes.
Jnandez
1. Naive and sensitive
2. Made some very poor business decisions because of those qualities
3. Got butt hurt because Doug took an aggressive business approach and then used an oversight in his contract to quit and start a competing business which isn’t illegal but is pretty shitty
4. Now wants to make broad accusations that he might not have been paid enough which doesn’t seem to be true from the eyeball test.
Doug
1. Being classic Doug, he beat a dead horse by creating a provocative video about a subject that had nothing to do with him just because he thrives off of attention
2. Seems to keep at least reasonable records for his business by my estimation seems to have paid what is owed.
3. He did nothing more than set what he thought was a fair price for Jnandez’s services and Jnandez agreed to it so what is there to say?
4. Doug seems to be guilty of nothing more than coming off a little douchey in some interaction with Jnandez but who is really surprised by that? We don’t watch Doug because we think our mother’s would find him a respectable young man.
Final verdict:
From the legal side of things, Doug seems to be in the clear and did nothing more than some solid, aggressive business. Jnandez shouldn’t sign contracts he doesn’t agree with and he’s a big boy, he should know that. From the human side, Doug quit being such an instigator, it’s not a good look. You’re good on camera and people respect your poker, you don’t need to throw other people under the bus in your videos to get views, it’s not worth it. Jnandez, don’t be a bitch.

What exactly was promised that wasn’t fulfilled? And I would never find myself in this situation because I would never sign a contract that I didn’t agree with.
HHP Nic he signed and resigned. Nothing wrong according to what he said, the contract didn't have a term where he wasn't allowed to quit. Remeber the beginning of this fight: jnandez was quiet despite it all, he just responded to what he thought it was unethical after Dog started to talk shit about him and try to destroy his reputation like he's used to do.

Swiss people believe in greeting everyone. Not in a nutty super social type of way at all (they're not wild social people), but just as a courtesy. It's actually considered an obligation there. So the jnandez "big timing" thing is probably a cultural gap.

Need help! So last night at venetian i was in the 400k guarantee tournament. 21 players left, 19 get paid 10 advance to day 2 sunday. I have 110k in chips. Blinds are 2500-5000 with a 500 ante playing handed. Im utg+1 i have AK spades. I raise to 12k, button (tight reg, good player 100k stack) 3 bets to 27k. Big blind (loose rec in town for convention and very loose with 105k) cold calls. What do you guys do in this spot?

If you play poker and have any ability to read people, you have to be a complete fish to think that Doug Polk is the good guy here. Jnandez is a straightforward and honest guy and Upswing tried to screw him over and over again. I would be mad if an affiliate was making more than the creator of the content as well. It seems like Upswing took care of their "boys" and shafted the outsider.
Shaun Fugate it's a great point you make, but the truth is you don't even need to play poker to read this guy, all you have to do is watch videos, and see that he's very arrogant and self-centered.
How exactly is it “screwing” a guy to offer him a deal for what you think he’s worth in a contract that he signs himself and then uphold that contract? That’s not “screwing” a guy. That’s just doing business. JN is not an owner of the business, he is an employee and therefore has the option to either take the deal that is offered or seek employment elsewhere. Doug is the owner and if he wants to give 99% of his profit to Joey and 1% to JN then he can. If JN thinks it’s a raw deal then he shouldn’t accept it, it’s as simple as that. Doug isn’t exactly Mr. Nice Guy but he’s the owner of the business and can offer his employees whatever the hell he wants at the risk of losing them. He though JN was worth 30% and Joey’s marketing was worth 25% and he’s probably right. A lot of people could make PLO instructional videos but not very many people can market like Joey.
Joey is fine. Joey did nothing wrong. There are 5 (non millionaire) Vloggers that have more subs so to say that Joey is the only one who could do this is pretty naïve. Jnandez attempted to renegotiate the terms and Upswing said no. The "screwing over" had nothing to do with the contract. Jnandez was led to believe that if he took the first shitty deal that the next deal would be substantially better and it was not. He attempted a renegotiation and when it failed, they split ways.
Trust your instincts, dont trust Doug.
Is doug for real?? He runs a poker training site and saying he has lost the passion for the game when he loses because it stings so much?
There's a big discussion about the contract - contract violations, payments, numbers - but we (the audience) can' t validate any of this and we can't say who is right and who is wrong! But as a poker player who likes both youtubers and their excellent content, i dont understand why Doug sometimes blames someone in serious manner as if he is saying that he never makes any mistakes.

why does everyone comment when they dont understand sales? if someone buys a year and pays upfront the revenue is not then counted the next month and the following month and so on... its already been accounted for. so a significant drop is going to be expected especially after a sale the previous month. also id assume not as many people are signing up at Christmas time. probably going to wait till January.

One factor Jnandez might not realize is that Joe Ingram is responsible for many sales that he got zero credit for. I’m an example. It was all the buzz surrounding PLO university that got me to buy it. I saw the content on upswing, the content from Jay Nandez and the content on Big Poppey’s channel. As a matter of fact I probably never would have become aware of Jay Nandez if it wasn’t for Joe Ingram. Anyway - I bought the product directly from upswing without using the affiliate code (sorry Joey). I’m almost certain if it wasn’t for Chicago Joeys content that sale never happens. So Jay Nandez gets the full $250 on that sale and Joey gets none.
I guess the point I’m trying to make is that Chicago Joey made Fernando a lot more money than he probably relaizes

Just watching this podcast.... I just wanted to put my 2 cents in. Doug- thank you for being honest about not loving poker... you should absolutely not care what people think if you are not enjoying poker anymore. I’m sure you’ll get the bug again where you want to play again but if not so be it.

Looks like Doug and his business pals got a bit greedy and started to threaten JNandez. After watching the JNandez Video id say both made several mistakes and acted unprofessional in several situations but in your position Joey i would try to detach from Doug. Also i would never do any business with Doug and his pals in the future unless you have it specifically in written form... even than they would try to find a way out. Very shady... Those guys are clearly not good business partners.

So Fernando said: I accepted the deal for 25% and tought that the upswingpokerteam would give him 50-75% on his next content. This is not the way a real deal is settled. This is a basic business mistake. Always mention this in your contract. Why was he in the beginning ok with the 25%? Because upswing would make him very famous, but he didn’t tought about the fact that the 25% seemed unfair.. I understand both sides and I think neither of them is good or wrong. I have simpathy for Fernando who was trying to set up a deal with his next best friends, and i think Fernando deserved a higher share for his content, but business is business.. See it this way: When you settle a deal with someone and after a few months he wants you to double or triple his payment. What would you think? Hell no!
I think the berkey situation was the one time doug was out of line. Also saying schwartz sold his house to stay in action was kind of low(also jus dumb to embarrass the fish).
