You're correct in saying the ute has to give way when entering under the _Transport Operations (Road Use Management-Road Rules) Regulation 2009, s114(1)._ However, the qualification attached to that is "entering" the driver of the ute had already been in the roundabout for around 4-5 seconds. So they've already entered. What's happened now is the DC has attempted to execute a lane change without properly signalling, and has just expected another road user to read their mind. Let's not forget that it is also a requirement to signal left when exiting under _s118(1)_ and carries the same penalty as failing to give way. At worst, blame would be assigned equally to both parties. But either way, this speaks volumes as to the importance of indicating to exit a roundabout.

One time I drove East in the morning, fog, ski season, dickheads in expensive cars hurrying to chairlifts, no lights on, overtaking towards me. Gave them the full spotlights. Made no difference.

It's the mindset of people who believe that they have the right of way. That's one of the reasons why there is no such thing as a right of way on Australian roads. There are other instances of people believing in things that don't exist that cause problems, up to and including death.

You're correct in saying the ute has to give way when entering under the _Transport Operations (Road Use Management-Road Rules) Regulation 2009, s114(1)._ However, the qualification attached to that is "entering" the driver of the ute had already been in the roundabout for around 4-5 seconds. So they've already entered. What's happened now is the DC has attempted to execute a lane change without properly signalling, and has just expected another road user to read their mind. Let's not forget that it is also a requirement to signal left when exiting under _s118(1)_ and carries the same penalty as failing to give way. At worst, blame would be assigned equally to both parties. But either way, this speaks volumes as to the importance of indicating to exit a roundabout.
