    All pretty disingenuous stuff. Trying to pretend that it was a ruling 'for the ages' when the reason they weighed in is because of the behaviour of DT when in office.

      More like the behavior of the Biden White house. We would not be talking about this at all if Biden's DOJ were not pursuing Trump for political reasons. Everything the democrats have done have backfired and this is one of those things.

    I’m worried this ruling will have unintended consequences consequences. In general I’d favor weakening the executive rather than strengthening it. I think this analysis was pretty fair and balanced.

    Both sides should agree: this is the worst thing in modern american politics. The entirety of American history has been about avoiding a king/dictator

      Both sides should agree: this ruling changes nothing and simply reaffirms the separation of powers laid out in the constitution. The executive branch, led by the president, is independent of the judiciary and the legislature, and the president can not be punished or censured for exercising his authority.

      @@CedarHunt the presumption that any action is offiicial and taking intent and other context out of the decision is very significant.
      Intent is almost always used in trials, in order to be found guilty of many crimes they have to be able to show intent, other times it differentiates the severity such as manslaughter vs first degree murder.
      Under this ruling if Biden had trumps lack of morality he could declare Trump a terrorist, seal teal six him, and arrest anyone who protests. And it would be entirely legal because those were orders from the official capacity of the president. It would require a house and senate impeachment to then hold him accountable. Nobody is above the law, nobody should be unfettered.

      @@CedarHunt No. The current SCOTUS is an activist body. The overturning of Roe, their slow-walking of this ruling to undermine the DC case against Trump's insurrection, and now this all point in to an inescapable fact. This is an activist court which has abandoned originalism, textualism, and even precedent to further a novel and un-American world view. They rule against women's rights, voting rights, and from the bench they have now legislated a broad new presidential presumption of immunity, AND actual immunity. They have set us up for a future of dictators. One waiting in the wings right now for November.

    On the topic of "punishing disabled, victims of trafficking, victims of domestic violence, foster youth, elderly and families with children" this law induces a stress response, fight or flight, through fear conditioning, with the constant threat of being criminalized for not having a place to retreat to. It will indefinitely cause PTSD, mental anguish, anxiety, stress, and depression. States can and should be sued for intentionally inflicting fear conditioning it is unethical and inhumane

      I think Trump will order the removal of Sottomayor, Kagan, and Brown from the Court at his earliest convenience, and he will use every power in his new dictatorial toolkit -- including to Seal Team 6 -- to do it. He will politicize the DOJ, and make it a tool of the President to enact revenge. He will try Liz Cheney for treason, and many others. If Roberts crosses him, he'll be out too. He will suspend the next election after he drums up a panic, and when he loses an election ... well, you already know the playbook . If you REALLY want to know what is going to happen under a next Trump presidency with this broadened immunity, you must now sit down and study how dictators rule.

    Glad they ruled this way as it should be, executive branch is a co-equal division of government and is elected by the citizenry. So this does a good job of defining the roles. Only OFFICIAL acts (acts in the official capacity of the office) are excused. If they did not do this, it would turn the US into a complete banana republic where each administrative change of opinion would end up jailing/prosecuting previous office holders. Just look at history for the last 4000+ years to see how well THAT has done.

      I suspect that just about any act a President takes, perhaps even including taking a dump, will be reframed by legal staff into OFFICIAL acts. I suggest you read the Sotomayer dissent.

      This is exactly what I learned in Constitutional Law in College and in my Masters. And it's not even hard to understand. There is official business that a person only understands because they are part of the government, a president. They make Treaties, Seek Trade Agreements, Strong Arm other governments, and so on. In those most of the time SECERT conversations with world leaders need always to be protected.
      Anyways there are other actions that aren't official, they are not protected like if I murder my wife.

      I wish you would quit stating a lie. The only person who died that day was one of the protestors who was shot and killed by one of the Police protecting Congress. There was one Officer who died several days later from a stroke which happened during the Riot. You should concentrate on the dozens of people who are shot and killed each week in Chicago, Washington DC and many other large cities in this country, which is a real tragedy.

      Trump promised to try Liz Cheney for treason. He will empty the DOJ and we will see a wave of political prosecutions to serve a man whose concept of power derives from dictators.
