While you are applying for a patent, others won't be infringing on your potential patent rights. However, once you do obtain your patent, then that is when they will be infringing on your patent. You could claw back damages prior to the grant of your patent but it requires a special circumstances. See link below. Up until you obtain the granted patent, you just have priority and a pending application.
