As someone diagnosed with Aspergers, I disavow. Even though in DSM 5 Aspergers doesn't even exist anymore. I hate it when people try to justify their crappy actions using their mental illness, it makes the rest of us look bad. I hope they do counter sue this guy, he's clearly been trying to scam people for years, but none of the people he tried to scam took him seriously, so he didn't get as much of a consequence as he deserved. I don't feel sorry for this guy one bit, honestly he sounds like a really horrible person.

This lawsuit isn’t anything to truly be concerned about. Acerthorn is just some guy throwing a whole bunch of BS at the wall thinking the legal system isn’t a comprehensive process that will just accidentally authorize something dumb. People like him aren’t anything to worry about, he didn’t get any traction and his actions didn’t stop anybody.
However one thing that the system needs (especially in America) is a comprehensive federal level Anti-SLAPP legislation
Probably not, but pulling someone into a lawsuit, regardless of whether it's legitimate or not, has the potential to ruin that person's channel/career/life, depending on the allegations and who is doing the suing. While this particular case probably won't amount to anything, it could still potentially do damage to the channels being sued.
Not to mention with his history of making up false charges, or baseless ones, and assaulting his on father, he has no ground to stand on to even get it started.
Definitely. People want to abuse DMCA or the legal system, they pay the price. After a few malicious actors get some jail time, pay some big fines (maybe both), the rest back off.

These aren't false lawsuits, they are civil suits. What he is doing isn't illegal unfortunately, at least under American laws. He can make as many as these as he wants, so long as he has the money to pay for a lawyer and court costs. A false suit would be, say, suing a jobsite for not paying you for a year for working when they have been. His suits are just opinion based civil claims that must be seen in court and requires both parties to be present with their own lawyers.
Someone like that deserves to be kept away from the rest of society. An absolute menace.

Acer dropped the suit against RUclips but kept the other creators. RUclips then partitioned the court to have the whole case thrown out as they're an effected party. RUclips actually did the right thing for once.

Acerthorn files these lawsuits en forma paiperus so he doesn't have to spend money on the filings.
He is also filing pro se so he doesn't need a lawyer.
These laws alow poor people access to the court system. By filing this way he is also giving judges wide discretion to throw out the cases without having to hear from the defendants.
We live in an era where people with very serious, destructive mental illnesses get tons of attention on the internet, when what they really need is therapy, psychiatry and serious support. I mean, see Chris Chan, Creep Show, etc.
This Acerthorn guy is just another drop in the ocean of "people who clearly need therapy spending their time getting attention on the internet instead."
It doesn't feel like an attention grab, but rather what they need help with unfortunately shows up in a public forum. Institutions need to be in place for people who have violent mannerisms as a result of their mental disability, but there aren't. Unfortunately what is likely to happen is that they will end up in jail eventually. I don't think this is a good answer, but its the only one that seems to be coming. Hopefully they will have a moment of clarity and seek help and get it.
Problem really is you can’t force people to get therapy.

@@goofyahdemoman1134 you can be forced to go to therapy. usually its for prisoners or people on parole or suicide watch but you can be court mandated to show up to therapy for example anger management classes, and if you miss they have the cops come look for you to see if you have a valid reason for not showing up and it has to be pretty serious, like being in the hospital or witnessing a death, or they can arrest you
also some people need more than just therapy, medication, and support, some are violent no matter how much help is given like chris chan and what he did to his mother/sister(i dont remember which) was not redeemable and he should have been put in prison for life or a special place for violent people with mental illness, the same should be done with convicted pedophiles. there is no treatment for them and even physical or chemical castration doesnt make them stop abusing children yet we let them roam free as soon as their jail time is over with them able to live right next door to children and also able to have their own children which may be abused. the only thing they have to do is tell their neighbors theyre a disgusting criminal and stay away from schools and parks but nothing else. if something that major is allowed then likely nothing will be done with acerthorn even tho he is violent and abusive to his own father other than some mandated anger management classes

These false arbitration lawsuits are like a kid in an empty classroom declaring "If nobody says anything in the next ten seconds, I graduate with straight A's", staying silent for ten seconds, leaving school, and then getting furious when they don't give him straight A's.
Pretty sure the US Supreme Court has stated outright that none of these "Well I altered the TOS/contract and sent it back" lawsuits will ever, ever hold water. That's not how legally binding agreements work. You can't just take an employee agreement home, write an extra zero on the line where it says what they're going to pay you, and actually expect them to do that. That's not the version of the contract the *company* ever agreed to. The one they wrote and sent to you is the one they agreed to. *Both* parties have to agree to and sign the *amended* contract for that to have any weight.

the thing to note with Acerthorn is that when he files these lawsuits in forma pauperis (In the manner of a pauper. Permission given to a person to sue without payment of court fees on claim of indigence or poverty) as well as pro se (A Latin term meaning "on one's own behalf"; in courts, it refers to persons who present their own cases without lawyers) so these lawsuits don't cost him any thing to file, so unless he is counter sued he wont have to worry about the costs

For some reason I really like this sort of content where a youtuber breaks down a ridiculous situation and talks through everything and you are one of the best I have seen doing it and you do it often so I keep on coming back but this video is above and beyond. You hit everything and hard.

It's not a disease, it's a mental handicap that is way too diverse to even get into. From a young age I had guidance and most people do not notice I have autism untill they know me a little longer. I and many others work hard to adapt, and using autism as an excuse undermines this effort. I learned how to adapt thanks to people telling me how things are and how I should act, not thanks to the people who treated me like I'm special and let me get away with being unreasonable.
Most people with autism like myself are not assholes and being an asshole has nothing to do with having autism. It should not be used as a defense since the guy is an adult who should be capable to tell right from wrong and should have learned by now how to behave around others, like anyone else.
Don't use your autism as an excuse to not become a better person. An ass is an ass, having a mental handicap doesn't make it smell any less like shit.

People like Acerthorn and Quantum TV do not belong on RUclips and RUclips needs to step up and actually do something about this epidemic of scammers and bad faith actors abusing this platform. These latest strings of incidents proves that this system is so unbalanced and ridiculous and change needs to happen not just to RUclips’s system but also copyright laws that are older than my grandpa.
Same thing with FuturisticHub, Ricegum, Onision and Jaystation

As someone with a disability that worked for Walmart for several years, he is absolutely right about the hiring process. They champion hiring everyone from all walks of life, and I’ve seen them turn away able bodied people with mild disabilities just based on prejudice. I can’t say this is what happened here, but I have seen it done in that system. They want a goal of 4-6% Disability hires. These hires are usually ADD (me), door greeters in wheel chairs, and maybe an autoimmune disorder. All of these are disabilities that require accommodations but it doesn’t take much to read between those lines. I wish that something could be done about hiring practices of those who are disabled, but can perform jobs.
I will add that I don’t think our buddy here wouldn’t make it at Walmart, or outside the house it seems.
If that is the case, then Walmart is a really crummy place for its hiring practices.
Though you have to admit, it's safe to guess that Acer said something to the interviewers that made him really unqualified and potentially a risky hire, seeing his activity in suing everything that moves.

But, I will be watching for lawsuits like this with them to keep popping up until it’s finally blown up that it’s a practice that they do. And it’s very sad. If anything I hope people that have actually had problems like this with retailers at least see this and get it taken care of.

@@InMintCondition13 most definitely. There are multiple jobs and multiple shifts that could accommodate many different types of disabilities. It actually made me sick. I have 2 bachelors degrees, I worked there while I went to school. I worked in the same position as bakery/cake decorating area longer than anyone in that store, but was constantly looked over for a manager position. I took all their management test and passed with flying colors. Someone that started 2 months prior with no education and no grocery experience. It was simply because I was open with my disability from the get go.

So I think there is a strong argument for using RUclips downloaders and screen recording software legally. There was a big push after VHS came out from big media to not allow it to record tv. It was ruled that it was legal for viewers of broadcasts to record it for later viewing. Using it, however, in your own video will need to be determined wether or not it's fair use.

I'm a person with Aspergers. I've been through rough times myself with me being physically and mentally hurt one way or another. It took a good long while, but I eventually recovered in a very positive manner. I really hope that this man learns from his mistakes and can move forward.
