RAW: Reprimand recommended for Kim Gardner for how she handled Greitens case

  • There was a major development this week in the story of what kind of punishment St. Louis Circuit Attorney Kim Gardner will face for her conduct during the former Gov. Eric Greitens investigation - but it isn’t over yet.
    Missouri’s Office of Chief Disciplinary Counsel and Gardner’s attorneys filed what’s known as a joint stipulation - or a mutually agreed upon set of facts.
    It negated the need for any arguments before the state’s disciplinary panel about whether Gardner violated the rules of discovery during the Greitens investigation -- but the panel still got to question Gardner during a hearing.
    Gardner’s office charged Greitens in 2018 with invasion of privacy for allegedly taking a compromising photo of his mistress without her permission.
    The stipulation also suggested the disciplinary panel recommend to the Missouri Supreme Court that a reprimand be issued, in part because Gardner’s conduct during the investigation was, “negligent or perhaps reckless, but not intentional.”
    But the stipulation is just that.
    A recommendation.
    The panel doesn’t have to agree with it, nor does the ultimate authority in disciplinary cases - the Missouri Supreme Court.
    It could take months before we really know whether a reprimand is what Gardner will get for violating the rules of discovery in the Greitens case.
    That's because the panelists who got to question Gardner under oath this week have to issue a report.
    Gardner and the Office of Chief Disciplinary Counsel need time to accept or reject it.
    And the Missouri Supreme Court needs time to make the final say.
    Here are a few tidbits that caught my attention within the 40-page stipulation of facts, a timeline of what's next and some background about the panelists who must agree - or disagree - with the recommendation for a reprimand.

    Let's not play this little game she knew what she was doing these little mistakes weren't accidents or malfunctions but they are now that she got caught, she was trying to ruin a man's career, and it backfired. She needs to be gone this isn't the first thing that she's f***** up. There is an alleged murderer who hasn't had his case go to trial because the prosecutor from her office didn't show up for court. There's too much at stake to have this office run by somebody that's incompetent and malicious.

      Sometimes ‘INTENT’ shouldn’t even matter when it puts a defendant under that type of investigation in danger of losing their case because of the prosecution incompetence. It is happening WAY TOO OFTEN in the past few years and NO ONE is being held accountable. They are put there in order to not prosecute ACTUAL CRIMES while going all hands on deck after stupid cases like a politician taking a picture of his mistress! They are using the judicial system to go after political opponents and it’s disgusting especially since it’s only being done to those politicians on a particular side of the aisle.

      @@FLo-jc7ig well, he's innocent until proven guilty........ His case hasn't gone to trial obviously that's why I'm talking about it . However his name is Jonathan Jones. And it isn't just about his case. It's about a pattern for her office of f***** up cases. People deserve justice. They didn't hire her not to get cases done. She's terrible at managing her staff. They can't even retain staff there. It's so bad. You know if you actually followed the news yourself or look stuff up, you might actually learn something and you should always try to do that before making a comment because when you don't do that and you comment on things you have no idea about. It becomes obvious and it makes you look really stupid and like you don't know how to think critically or find information for yourself.

      Typical George Soros backed lawperson, contempt of laws and rules when applied to themselves but weaponise them when applying to their political opponents. They believe in pushing an alternative justice, based on ideology. Hence, high ranking positions like DIstrict or Circuit Attorney are sought. The ppl deserve a Circuit Attorney whom applies the law as written. She should be removed. But, replaced by whom? The body politic in that State would ensure yet another Soros backed candidate gets “elected”. Rinse and repeat

      Absolutely: All law enforcement should be considered _aiding and abetting_ crimes that happen while they are on duty. This includes beat cops, but also detectives, prosecutors, district attorneys, and attorneys general. Unsolved crimes or crimes that result do not produce a successful verdict should be considered _obstructed_ by all levels of the justice system. Effectively, any judge who finds a defendant not guilty should simultaneously move for charges of obstruction on themselves and declare themselves in contempt. Police should also take the judge into custody (after arresting themselves, of course).

      The governor doesn’t have authority to unilaterally remove her. The Missouri Attorney General has filed to remove her and she is entitled to due process in that proceeding. I’m not a Gardner supporter by any means, but let things be handled properly.

    A weak reprimand makes it more likely such behavior will be repeated by others.

    My first thought was call in the head of the IT department (information technology) put him under oath and ask him about the disk. The bottom line is she seems not remember everything not in her favor which leads me to believe she is lying under oath to a judge.

    I am surprised by how poorly Kim Gardner presents her perspective. She speaks with unclear and not fully processed communication style. It comes off hedging - not transparent. It also comes off very unprofessional. I would think that in a matter as important as being accused of not handling legal proceedings / discovery properly that a person in her position would have studied well and prepared well for this question and answer. She also has a distinct annoyed - put off attitude toward being questioned. I am shocked by her lack of sincerity and lack of decorum in this hearing.

    Based on the evidence presented, it appears that the lady in question is not capable of performing her job duties to a satisfactory level. Her inability to answer questions and go above and beyond are clear indicators of this. Furthermore, her request for gratitude at the end of her performance is not appropriate and only serves to reinforce her lack of competence. It is recommended that appropriate action be taken to ensure that the job is performed at a higher level of quality.

    Many people have been real, rolled through the system when district attorneys held onto discovery, which was racist and discriminating, and shouldn’t be tolerated under any condition. Then you’re dealing with people and people put trust in the system that is broken a hold in peoples accountable The corruption should not be tolerated. Many people are crushed over prosecutors behavior when they fail to do their job, but want to blame others

    Unfortunately, they won’t remove her. She is an elected official.
    How these people voted her back in is beyond me it’s gonna be very hard to remove her because she will scream racism and so will her followers. It’s a darn shame that there isn’t someone in there who cares more about the victims.
