The delete accounts that aren’t active is sad. One of my friends died and their account is memory to me and when it’s deactivated it will be sad for me to think about it

If Niantic hadn’t lucked into the pokemon licensing no one would even know this company exists. They don’t care about their users, or the gameplay experience. They are a data selling company that just happens to use a game as a means to harvest that data.

I've studied law: They cannot legally remove your right to a trial against them if they are found of wrongdoing in the trial. It would be like a company making you sign an agreement that says you can't sue them, then they're literally just not paying you once every 3 weeks for no reason. If you sue them and prove they did wrong: They would still be required to compensate you and any action against you would be considered legal retaliation.
People regularly get this information wrong. I had someone try to argue that you need to look over the contract cause they can do that, then broke down, in detail: How they couldn't.
Maybe the opt out is their work around, but they have to put stuff like that in.
It’s a lot like the “void warranty” stickers on products we paid for and had every right to repair ourselves, it doesn’t hold up in court.
Okay, so what would advise be for somebody who put their name into a class action lawsuits? I literally got an update today saying I just need to submit proof of some purchases I made and now I'm weary because I really don't want to lose my account lol
You can absolutely waive your right to a jury trial and overall they can absolutely require to you agree to dispute resolution on certain terms and/or in certain venues
Yeah, a total waiver of any dispute resolution method would likely be deemed unconscionable and unenforceable, but that's not what this is
It simply makes it more difficult, especially for smaller things. You're right, doesn't matter what you sign if they are guilty of negligence. There's a lot of things though that aren't negligent that it would prevent you from suing. Say they have been collecting data for the past year and finally get caught, you can't sue them. There was a bug with an event, you can't sue them. If you bought coins and there's a bug and it's gone, you can't sue them. It's basically reiterating that you can't sue them for things you are agreeing too. Which are all normally illegal. That's why a lot of the time they are FORCE to give refunds. You can't go around charging people for something and then not delivering it. That's theft. Now if you agree to allow them to commit theft on you and commit to not sue them. You're gonna be in a difficult position, even if they clearly broke the law. You would have to prove they were negligent, and all tech has bugs, you'll never prove in court that a glitch/bug is negligence.
@@okpoptart They are not required to grant you access to their service and could technically remove everyone for no real reason, so they could remove your account. But if the claims are legitimate, that's really the worst they could do.
What really sucks and makes me sad is that my dad and I used to play and then he passed away. All his stuff could go away if they decide to delete his account for inactivity. All those memories gone 😞
Take a video or screenshot of the account if you can and try to get on it and keep it active if possible.
Them adding the ability to use software to check your phone for anything they want is the most concerning one.
Especially with us starting down the barrel of the worldwide end of liberty.
They are just telling you what most Apps are already doing. If you want that to stop you need to go back to and old style Nokia phone.

Hopefully the EU laws making these TOS illegal are some of the many laws the UK hasn't given up since Brexit.

Them deactivating unused accounts hits me because I have a friend who passed away in 2021 and I do look at his profile every so often and reminisce. Seems I'm gonna have to get a screen recording of his profile before it gets removed. Sucks his account would be removed.
This hits a few of us players. Our community lost a local player some years ago and I know a few people still keep him on their friends list 😢
I also have a friend who passed that I met through a local event and I always check on their buddy 😢
I think I would recommend IF YOU CAN to transfer at least some of the pokemon to the mainline games via home.
Saw this and thought - well, I should log back in to my dead mum's account to make sure the account doesn't get deleted because that would be like losing her all over again, seeing as it was something we did together. I miss her every day and now have this to add to my mental and emotional load. Didn't think there was a reason to hate this scumbag company more. They've been a textbook case of how to mismanage one of, if not the world's biggest IPs for a long time but this is unnecessarily painful

5:00 mark. My wife was a very high level in Candy Crush, to the point that she took a break, because it was becoming addictive. When she came back to the game, ALL of her power ups were gone. She emailed the makers of Candy Crush, and they essentially said that since she wasn't active, they just took it all away. She never got them back, and never played the game again.

I believe Discord also updated their TOS for certain countries a few months ago to waive participation in class action lawsuits as well - kinda weird to see so many of the apps I use do this
They realised that just cause they're a rich company doesn't mean that they can't be sued so they thought of a legal way to avoid that happening to them
It only really affects US players and users as these adjustments to terms are illegal just about everywhere else. So it doesn't really matter to a lot of people.
Guys we need to have a petition or something for the new terms to be removed this is not acceptable we as a community NEED to do something about this.

Terms of service aren't even 100% legally binding because there is no proof you were the one that accepted the terms of service. Anyone in your house could accept them even a child. so, therefore, there is no way to prove that you understood or were even the one that accepted them in the first place thats why contracts have witnesses when you sign them.
Yeah. Also, children can’t actually sign contracts or be legally held to them. They’re not a legal adult, so they cannot agree to legal terms. Any child who has an account and agrees to these TOS is technically also exempt 😂

I quit in 2017-2018 and started playing again I 2023, and if I came back and I had nothing and had to start over again, I probably wouldn't have even started playing again.

@belly818 for sure, that or in my case being unable to play because my phone could no longer handle the game. I have a good phone now, and I get that's a "me problem" but even after the latest graphical update I had 2 buddies "quit" because the game became unplayable on their older phones.. not everyone buys a new phone every year. They should offer some kind of "bad graphics mode" for lack of a better term. You'd be surprised how many people stop playing due to being updated out of playing.
I played since back in 2016.. but back then there were only the 151 pokemon from the 1 gen. And since I live in rural area, the only things I got was ratata and smogon ._. .. also I only had one pokestop at my village.
And then I started studying back in 2020 and when I first started going to university in 2021 (cause I had two online semester) I only found my friend group through pokemon go, so I started playing again.
It would have crushed my heart to see all my old pokemon get deleted :(
Regarding the no compensation for cancelled events.... you enter into a purchase contract with Niantic when you pay real money for a specific event. If they violate that agreement by canceling the event they most definitely have to refund you because the purchasing contract was not fulfilled
They are LITERALLY DESTROYING our favourite game.
The fact that one of their lead game engineers has basically stopped playing and left his role, says it all.

@@BearKub13 you can opt-out only to a certain extent. However, even in the US this won't fly. Removing a right given by the constitution will not hold up in any court whatsoever. Which is why many lawyers made videos on the subject when COD had a similar ToS.
This is only to scare the uninformed into thinking "damn, they own me".

The most frustrating thing is there was no advance warning that this TOS was even coming. They forced in upon players in a mandatory update.

Any judge who isn't bought off would laugh Niantic out of the court with that "waiving of rights". They can put whatever they want in their TOS, but if it goes against our constitution, it doesn't make it legally binding.
And these changes are illegal in almost every other country, so cannot be enforced.
Your first 6 words are the problem, in the US at least. We'll have to wait for the EU courts to take up the case on behalf of the world. They were the ones to knock crapple down a peg, now hopefully they do niansht as well.
This is scary for me. I used to spoof many years ago and probably still have some trace of it on my device. I hope that they can’t see that history and ban me when I haven’t used it in years.

This new TOS is pathetic. They can do BASICALLY anything to you if you accept the TOS. And if you don’t, you’re allowed to play. It’s either be a cash farm for Niantic or not play. If anything, Niantic doing this makes it more likely that TPC Japan takes full control over Pokémon Go. And as we are seeing, Japan is making better decisions in gaming than western countries

I’m not a lawyer but I know enough not a lot of these rules will hold up in court. They just there to scare you from trying to maybe ending in an out of court settlement if you try going to court.

You are right and these terms are already illegal across most of the world, not just bits of Europe.
Not refunding a cancelled event is illegal. I mean they can cancel the event purposely as a scam (which I doubt they'll do but still a possibility) but generally they are not providing the service promised. That's like saying "Oh if our icecream machine breaks down while we're making your icecream order we won't give you back the money". Just because you got someone to sign terms of service doesn't make theft legal. It's not like you can get someone to sign that you're allowed to murder them and then go murder the player. They are required to refund you if the goods were not provided.
Just my $.02 (seek an attorney) #1 Terms and Conditions contracts are considered a “contract of adhesion” making the writer of the contract having the hardest burden of proof. #2 13.1 of the arbitration agreement specifically mentions remedies that either party may take with violation of IP (intellectual Property). So in theory if they injure you financially from using your IP say your likeness you may have grounds to bring forth an argument.
What I really personally disliked was 13.8. Many arbitration agreements have a clause that the writer of the arbitration pays for it. This agreement has both parties paying. Out of everything in the T&Cs that is what personally stood out to me being the worst part.

Sometimes life gets too busy for extended periods of time. I have taken year or two year long breaks from the game multiple times, and right now I haven't played in a long while. If I were to log in and see my account gone, I would definitely never be back

I used a remote raid pass and it skipped the bonus at the end, they wouldn't refund me even after explaining what happened twice. I guess they thought I bought the raid pass and did the raid for fun but no I wanted to catch the legendary at the end obviously. garbage company.

a huge majority of companies already farm data and know your location, it isnt that big of a deal honestly. yeah its a little concerning theyre farming all this data, but the companies who know your location wont care a single bit about your location and rather the money they get from selling it off

I played from day 1. Got to level 50 and stopped playing last October. This game can't get out of its own way. If it were to delete my account, I would freak out. I have spent thousands of dollars on this game.

The inactivity one kills me. I had a serious spinal injury and didn’t play for about 1 1/2 years. I would have been so sad if my accounts had been deactivated during that time.

John Hanke is a pretty awful CEO. The amount of money they wasted building their “platform”, and watching Harry Potter burn out was pitiful. They have spent even more on AR, which is still years away from being viable.
But pokemon go? The one thing that makes them money? They abuse the players, ignore the bugs, and create as many ways to monetize the game in ever increasingly shady methods.
My only hope is, niantic loses the license to another developer. Nintendo and game freak are still ultimately in control.

Just because they put that you can't be part of a class action lawsuit against them doesn't mean you can't be part of a class action lawsuit. If there is negligence, fraud, or any other illegal activity on Niantics part you can absolutely still sue as part of a class action suit no matter what they had you sign

If my Pokémon account gets spoofed because of the new ToS, I have no other Pokémon game to save all of them.
All my Mega's and my Max heart shiny Garchomp I cn mega evolve will be gone, like I genuine have a cool bond with it and refuse to switch buddys because I love my shiny Garchomp so much 😭
Pokemon home. Transfer what you really want to keep (not everything can be transferred ie costumed pokemon like the mask pikachus). That way if they do delete it youre not out all that time and effort. They wont be identical stat or move wise but at least youll know they are special. Pokemon home is free but you can only hold up to 30 pokemon before you have to pay for extra storage.

It won't be a problem if they deleted inactive accounts as long as they send you an e-mail 1 month before they schedule deletion so you have time to reinstall/play again.
but to do so you would have to agree to those new terms of service.

The inactivity thing is to keep players from quitting the game, like you said there is plenty of people who leave and come back once there is something interesting going on, I got many friends who don't play regularly and only play big events or stop for like a year or semester and come back, myself and my brother were about to stop playing after the Fest but might be after the raid day and bonuses, and there has been a lot of people in general that stopped playing in the last few years. They want to fix the consequences of their bad decisions with more bad decisions.

I have gotten more scam calls and scam mail since they updated TOS. They don’t say who they are selling your information to. Lately to deal with the scammers, I turn their call into a crank call.
I’m done with Niantic. I already planned to take a break after go fest. This just confirms my decision. Only thing that changes is that I’m prolly not coming back now. It’s a trip how every thing that I take an interest in whether its for fun or not, it gets ruined by greed corporations. From sports, to concerts, to video games , to amusement parks EVERYTHING!!!

(In reality the product is actually bad, has high sugar etc, take this as an example). I want to say, that all companies do these and even have a right to do so..

if Niantic deletes my Pokemon Go account, I legit will *NEVER* play the game in my life. it took me nearly 5 years to get to level 40. I am not doing that again.
I'm currently taking a break to play Monster Hunter Now(another Niantic game), which in many ways is more consumer-friendly than Pokemon Go. easier to reach endgame. months as opposed to years in Pokemon Go. free raids every 3h *WITH global matchmaking.* today they even introduced global matchmaking to some monsters on the field. I've only been playing since the end of May and I have endgame armor and weapons that are good enough to use against any endgame monster. it's crazy to think that both these games were made by Niantic.

most games dont require acces to location tho. and niantic encourages you to allow access to location 24/7 unlike maybe doordash which only needs it on while apps open

The greed of trying to monetize everything at the cost of people's personal data is brutal. PoGo could be an amazing game if they put us as users/buyers first, instead of maximizing income through shady deals with third parties (As if micro transactions weren't enough). What worries me a lot is my gps location data or behaviour been shared and it ending up in the wrong hands, endangering my life and wellbieng.

I'm a returning player from 2017 as a broke college kid to now at 2024 as a broke adult man. But spending money on this game I never had. If Niantic would of deleted my account, they would of never gotten my income.

arbitration clauses are pretty standard nowadays. Most of the legal grey area surrounding these clauses surrounds the methods and ways the TOS are presented, not things like arbitration clauses or agreements to not bring class actions.

my dad (a pokemon go og, playing since 2016) became quite inactive for about 5 years, last email niantic sent him was back in 2021, his account is terminated and rest in peace to the hundreds of 2016 pokemon he lost...
i must have got lucky then as i stopped playing 2017 and picked the game back up this year and my account was still active.

I don't know how it works in the US, but in most european countries this wouldn't work. Any company can write whatever they want in their terms of service, but at the end of the day national law is sovereign. You can't take overrule the law with your ToS.
I give you an example, many online stores like to have a return policy of giving you back your money in store credit. Now they will have this in their ToS but most countries have consumer rights laws that can force the company to pay you in actual money, so their ToS are just for show and have no actual power when contradicting a law.

I have a number of family, friends, excoworkers.... that have come back to the game, after deleting the app in 2018 etc., when they have kids old enough to get into Pokemon in general. I personally know of 5 or 6 players within my local pogo community that returned because of their 6/7/8... year old kids, and stayed playing because they enjoyed playing again. Don't rush to delete every inactive acct. Maybe send a message or 2 to the linked emails??

I imagine they would still have the data they took prior to you deleting the app, but once its off your phone they cant farm more data
You're being paranoid, nothing bad is going to happen to you even if they did look at the data they are trying to look at. That being said, if it really matters to you and you want to uninstall the app, then they won't be able to do it anymore.
Hypothetically they could attempt to install some malicious software that you can't get rid off by uninstalling the app, but (1) it ain't that easy and security features of your phone and the app store try to prevent that and (2) it would be an absolute nightmare situation for them if they did it and got caught, they could go out of business, they aren't risking it.

Coming from someone who played a lot when the game first dropped, stopped for 7 years and has been playing almost non-stop for a year, if my account was gone when I came back, I wouldn't have continued playing again.
Niantic acquired a few AR companies, and soon, the task of scanning pokestops became a thing. I found scanning annoying and intrusive, so I stopped. A lot of players I know also stopped scanning.
Remote raids were nerfed and got expensive.
Niantic lures us outside with Elite raids, Shadow raids, Routes, 15-minute free incense, etc.
Niantic isn't altruistic to care if we are getting exercise.
It makes sense that an AR company wants to acquire your data.
They closed my account after only a year and a half of inactivity.. had to start a whole new account. And support basically told me to get over it and start over.

There's just no reason to close inactive accounts, unless they are associating a mountain of data for each one, indefinitely.
For gameplay, you could store the entire world's accounts on a single portable hard drive. No need to delete anything.

Hear me out, did you travel a lot when you played? Different cities or states? Cause i quit playing for a while, months at a time, and i still have my account. I did things i wont mention and still have my account. Makes me believe even more that they pick and choose the accounts that are not benefiting them enough to keep them active. Depending on your jurisdiction the clause forbidding participation in a class action isn't enforceable. e.g. the consumer protection act in Ontario expressly prohibits this, so that clause would be immediately invalidated. A few of the other changes fall into a similar bucket.
