    With home cooking on both sides, it shows more in NC with the judge there and the acc. The judge in NC should've dismissed because of the acc breaking its own bylaws by not getting the votes before suing fsu. At least the judge in FL had the guts to pull the trigger and tell fsu to get their stuff right.

    Judge Cooper ruled in 2009 in NCAA vs Associated Press. NCAA had to turn over records to AP. This should give you some insight into his views on public records in the Sunshine state.

    Big Mountain is probably the best spot for impartial analysis of the ACC/Clemson/FSU battle. Thank you for it. In my opinion, the ACC has to compromise and settle with FSU, otherwise everything ( or almost everything) they want hidden will come out one way or another.

    This whole battle just sped up again. State of Florida (AG Moody) sued the ACC today and made it urgent. We already have a judge posted for the new case.

    and coherent. Interesting that beldsoe allowed acc to cure their dubious filing nunc pro tunc, and didn't even request the acc attach proof the members voted as plead....

      Bledsoe did receive two court affidavits stating the vote took place and the result.

    Moody filed a lawsuit against the ACC in Leon County. They assigned a different judge.
    She wants the ACC to produce all the financial and TV info.

    With the potential of limiting future opportunities for state institutions, my curiosity is if the AG will limit the scope of actions only to implicit waivers of sovereign immunity.

    1. "Dangerous game" sounds like an exact quote of mckenzie lol. And it's complete, hyperbolic BS. If sovereign immunity must be explicitly waived, the obvious solution is to simply add an explicit waiver into the contract's language. PROBLEM SOLVED. The mckenzie apocalypse has been averted. All hail, common sense, objectivity, and rationality!
    That guy is a bum. Full stop.
    2. Cooper added 30 days to the mediation order. Went from 90 to 120 due to FSU's personal jurisdiction redo. My understanding is that will proceed separately from the case and should not slow it down. Clemson will likely add some delay to the acc case in NC

      Mediation will not slow downs the case.
      But FSU redoing their pleading will slow it down.
      Whether or not the Clemson filing has an impact on timeline in NC is yet to be determined.
      While we did 1 ep on some McKenzie reporting, we do not base any of our comments or opinions on his hyperbole or biases.

      ​​@@TheBigMountainPodcastI agree FSU submitting an amended complaint will delay things. I think that's universally understood, which is why I didn't "explicitly" mention the effects of that.
      Maybe it *is* important that FSU didn't "explicitly" waive its sovereign immunity after all? (I have no idea how that will play out but am glad FSU has other compelling arguments it can hopefully rely on regardless.)
      Is the explicit sovereign immunity waiver not a simple contract fix? Maybe I'm missing something
      Oh, and I just have a genuine dislike of mckenzie and his 🗑. You - or anyone - can use him as a resource. And I'll continue to call him out for being a hack 🤝

The old-timer tries to sound like some erudite, sophisticated lawyer but ultimately all his pedantic writing is irrelevant and off topic. What's more he comes off as an angry, arrogant and condescending jerk.
      I am not sure what's funnier that people actually rely on him for legal analysis or his academic and professional background .

    JY, the timeline in the FSU-ACC case in FL is isnt a big deal.
    The case in Leon County, FL case will be well ahead over the Mecklenburg County, NC case.
    You are not factoring in the ACCs filing against Clemson in NC.
    The ACC-Clemson case in NC is well behind the FSU-ACC case in Florida.
    The NC Business Court already hinted at combining both ACC lawsuits.
    That will undoubtedly push the ACC's NC case well behind FSU's FL lawsuit.
    And if I'm not mistaken, Clemson has until late July to respond to the Mecklenburg County, NC.
    Respectfully, you guys gotta do better that the surface commentary.
    It is very easy to regurgitate things you hear in the echo chamber, but at some point, independent thought has to kick in.
    Please dont take this as a dig, but rather constructive criticism from a viewer.

      Filings deadlines are in May.
      Regurgitate? I’m not sure you are listening. The only regurgitation is brining up what Mr. Rohan stated on a previous TBM episode. The opinion on our shows are ours and ours alone.
      You oddly disagree with JY about the timeline but then end with the fact that we don’t “think on our own”. Contradict much?

      @@TheBigMountainPodcast | The regurgitation is reference to the timelines of both cases. Not once did you mention the timeline affects that the Clemson case in NC will have on the FSU case in NC.
      Both case in NC have been assigned to Judge Bledsoe, correct? So essentially, the FSU case can only progress so far until it has to pause for the Clemson case, correct. I think Clemson has until late July to reply in NC. So at best that means the NC is on the same time line as the FSU-ACC case in FL. Adding Clemson to the FSU-ACC case in NC adds to the complexity and naturally extends the timeline.
      I will address my comment about lack of independent thought emanating from your channel. I love college football, as do you. I consume more than my fair share of college football realignment content. Their seems to be an echo chamber that has consumed the college football youtube space. I initially was drawn to this channel because you guys offered insightful and thoughtful commentary on college football topics. Your PAC12 coverage was amazing, as were your PAC12-B12 content.
      But the ACC-FSU content has been exactly opposite of thoughtful and insightful., imo. This is not a dig..but rather an honest opinion from a consistent viewer. Check your comment analytics, I'm a consistent poster on this page because I truly enjoyed your content and I wanted to increase engagement for your channel as i thought i needed to be seen/heard by more sensible college football fans.
      But if you take my critique personally, thats not on me. I've never been disrespectful towards you guys or about you guys in the comment section. I merely offered my critique from my POV. There should be a space on your channel to disagree with your takes but still have a voice. If not, that is and echo chamber sir. And if that is indeed the case, I will see myself to the door.       @@shallojallohrespectfully, what part of their commentary has been poisoned by an echo chamber? What opinions are invalid? So far they have done an excellent job of pointing out the flaws of the FSU logic and the realities of the impact each development has on the overall litigation. Criticism can be valid, but for it to be productive (or warranted) you need to point to specifics where they are not meeting your standards. It just so happens that the recent news has all come out of FL, which is a decidedly pro-FSU jurisdiction. May 2 will take the case back to Mecklenburg Co, where there should be some pro-ACC results.

      FSU sued the ACC in the state of FL...not NC.
      FSU is the defendant in NC
      FSU is the plaintiff in FL

      Timing and their appeal.
      They want to wait until their appeal is heard in NC which will slow down the timing of that lawsuit.
      FSU fully believes any lawsuit between these parties should only be heard in FL and will do anything in their power to delay in NC.
