  • 1. Decide which county to file in, usually the one you live in. You can file in any county (if you are both in agreement), which can be convenient as some counties are harder to file in than others. Though filing where you live is usually better as it’s conveniently close by.
    2. Get the divorce forms (for free) from courts.wa.gov or WashingtonLawHelp.org if you want to file without an attorney. However, you can hire an attorney to handle gathering all the needed documents.
    3. Fill out the essential documents like the petition and summons as well as a Case cover Sheet and a Confidential Information Form. Include additional documents if necessary, such as a proposed parenting plan and child support worksheets if children are involved.
    4. File the documents with the court and pay the filing fee (currently $314). Keep at least two copies for yourself (Filing Fees may be waived only if you fall below the poverty line).
    5. Get your file copies stamped by the Clerk so you have your own conformed (exact copies) files.
    6. Serve the documents to your spouse using someone over 18 who is not a party to the divorce (Avoid using adult children). Have the person serving the documents complete a proof of service form and then file it with the court.
    7. Monitor the case for status conferences and court dates and show up for them (as missing them will force you to restart the process).
