No Rent, No Evictions, No Mercy For Landlords!

  • Landlords Get Ready to Bear the Financial Burden of Tenant Welfare for the next 6-12 Months!
    Last week the Judicial Council of California enacted a NO EVICTION POLICY which prohibits tenant evictions for any reason starting from today, until 90 Days from AFTER the Governor determines to end the stay at home order that is currently in place. (read the full article here: bit.ly/2VHe5FD). Meaning, if our Governor lifts the stay at home order on May 1st, NO Evictions will be processed until September 1st!
    If that was not bad enough there currently is a proposed assembly bill, AB 828 (read the full bill here: bit.ly/2XLrEqc) which would allow judges to demand you lower your rental rates by 25%.

    I had to work 60 hours a week to pay my mortgage that was normally covered by the rent my deadbeat tenants refused to pay. There was NO moratoruum on my loan payments, taxes, utilities, and insurance.

      That is ludicrous. A landlord should be business savvy or he could not have gotten any loans to buy rental properties. Renters usually do not have much income and landlords are usually not forgiving nor charitable plus they are not keen to do repairs and where upkeep is lacking renters generally do not treat the property with care. Landlords could have evicted for any lease violation this whole time and they know it so stop boo-hooing for the businessman you butt-kisser.

      Tenants are no obligated to pay your properties you probably lied on your loan applications to get the properties saying you had more income then you had.
      You took a high risk and spent well beyond your means and didn't bother to save any of the over priced rents you collected and now are crying.
      You can always sell your properties and get a job.

      @@winning3329 Tenants agree to pay the Monthly Rental Amount as signed and agreed upon in the Rental Contract. Refusing to Pay Rent when it is due is a willful violation of the Rental Agreement and a Breach of Contract resulting in the termination of the Business Relationship between the Tenant and Landlord: The Tenant must honor the agreement by vacating the Rental Unit and the Landlord must honor the agreement by not requiring the Tenant to pay the Monthly Rental Amount. It's that simple.

    Why are some people assuming that landlords are greedy, uncaring mean spirited ? People go into real estate and property management or being a landlord because it can be a nice livelihood. It’s a people business and if you don’t like dealing with people do something else for a living.
    Good landlords do proper upkeep on their property and are fair with their tenants. Most are not slum lords. They have the right to earn a living.
    If you are truly having difficulties work it out with your landlord. Don’t just screw them because you can. They have families to feed and bills to pay too.

    Well I've been paying rent throughout the corona pandemic and my landlord sent me a notice of increased rent and I told him that I would pay but he needed to addressed all of my issues inside of my unit and he told me to get out so what do one do when a landlord does not want to fix your unit. And sends you a eviction notice? I live in Miami, FLA

      In your case, moving is your best bet. Landlords are required to fix some things while others are discretionary.

      Your rental has to be habitable. If it is not don't pay rent, stay put and wait for your Forcible Entry and Detainer (eviction summons) and file to contest it at the courthouse before the court date. The judge will then decide. Be prepared and be concise. Bring an attorney if you can afford one.

      The landlord and the Judge are Masonic brothers and I Lost the case, I don't feel bad because this universe has a way of taking care of all of us. The judge put the eviction on my name and I Don't Care what the universe put on him and the landlord, karma is real I didn't deserve this. I just wanted to live in a clean and decent environment.

    MY Castro Valley tenant...who works for attorney, drives a E-CLASS Mercedes...has not PAID RENT SINCE JUNE........
    WHAT ABOUT THE PROPERTY OWNER WHO OWNS ...ONLY 1 HOUSE......... AND I CAN'T GET THEM OUT FOR ANY REASON.

      Give them a 30 day notice and send them a judgment for unpaid rent, bills and damages. Document everything, including work place, cars

    The was I see it, the moratorium is a taking from the government: Some States like California, Oregon and Nevada to name a few tell you that you need to let the tenant stay, even though he/she is receiving unemployment +600/week while meanwhile there is no assistance from the government. Landlords seem to be the easiest targets and a lot of mom and pop landlords don’t have months to carry costs without income coming.

      Miss Kitty I definitely have a nest egg and can weather the storm if thats what you are wondering. The point that you are missing is that landlords have been places in an unfair position by power of the government where they can choose not to pay even if they haven’t lost their jobs. I have a tenant that bought a $30k Harley and still wanted a discount on his rent to preserve cash. Another one that didn’t loose his job and is simply not paying. You see the issue?

    Only LANDLORDS that doesn't except GOVERNMENT GRANTS can EVICT a TENANT! Alot of people got it messed up. Don't be mad PAY your RENT & you will not have anything to worry about getting KICKED OUT! I live in NEW YORK 😁!

    The government should’ve never done this for such an extended period of time. This non-eviction clause was put in before most people were even out of work. A deadbeat tenant is just that. Most landlords would be willing to work with a decent hard working tenant let’s tell the truth.
    In my own example I was in the process of closing & didn’t even want the hoarding deadbeat tenant in there and now I receive nothing and have to pay the mortgage & since the deadbeat is damaging the property I have to make serious repairs.
    And now I’m too understand that there’s a 2nd hero’s package coming that extends the no eviction clause for an entire year. And in good old Connecticut has extended theirs already for an additional month leading past August.

      Rosalie Thomson I talked to my evictions attorney and was told originally that my problem fell under the nuisance statutes. However later I was told that they’re only hearing threats/ violence cases concerning evictions. So I wish I knew what the story is; b/c to me someone damaging your property like I described falls under vandalism and should be charged as a crime. And pics don’t even tell the story of how the place looks

    I'm curious if you can start the eviction process so that it completes when the eviction restriction is lifted?
    Or are you not even allowed to start the process until after the restriction is removed?

      Mirela Friedman this video and this channel appears to be for California landlords so, to answer the question no, you cannot serve a summons until 90 days after the state of emergency has been lifted. You can file but that would be quite a waste of time and money if for instance you can't serve until January or February 2021.

      David Jacques as it stands in the state of California you can file but you cannot receive a summons to serve on the tenant. The eviction moratorium has been extended until September 30 so say for instance the governor decides to remove the state of emergency October 1 the soonest that you could get a summons would be January 1 the next business day of course

    Added to all my new leases,......rental insurance. If I don't get my rent, I collect it from the insurance company. The tenant buys the policy and I am the beneficiary. Cost: $1,100 a year. If the tenant doesn't buy the policy, they do not get a lease from me. Hard ? Yep.

    My tenant has not paid me since last 9 months already. She have a hold over case as we have them notice to quit. Some squatters has been allowed to camp in my property by my tenant, and they slam things on the floor above us (we live in first while they on second floor). I have no way of taking these squatters out thanks to govt for occupying and giving away my property. They say housing is our right, so eating is our more imp right will these fkrs let some homeless squatters to go and eat what ever they find in Walmart.

      @@annle5521 I guess you are very correct. My property is still under occupation of these unknown squatters (at least 5 people) along with my rogue tenant who is collecting from these ppl. Last Tuesday when I called courts, they are still unsure when will the court resume and they don't know when the case will be called, his best guess was "months into late next year". I can't explain how depressed and hopeless and helpless I feel right now.

      @@xxSweetStrangerxx I believe dec 31 is when moretorium ends, but gov can still extend it. well when this is all over, file a 30 day notice and judgment. To
      recover money during a tenant eviction, you must request a money judgment in your initial eviction complaint. If the judge awards you with this money judgment, the tenant is legally required to pay you all the money that is owed plus interest. This way, even if the tenant fails to pay, you can file have his wages or bank accounts garnished until the money is paid in full.
      Once a money judgment is official, it can be submitted to collection agencies and reported on the tenant’s credit report. From here, you must decide whether or not to continue paying a collection agency to pursue the tenant for your money. Make sure to document and take photos of your complaints

    I have always paid my rent and kept my apartment in good shape but I also live in a low income housing and I have a fix income but my rent got raise the property manager was here when I had my apartment inspection and she didn't see anything wrong and I passed my inspection too ) if this is a low income housing why do we get our rent raised I couldn't pay a high rent and I applied for low income housing)

    Anybody that thinks that an eviction moratorium means they don’t have to pay rent is financially illiterate. The are receiving service that is costing the service provider money, that needs to be paid the provider with a reasonable profit and funds for major maintenance😊

    The laws and government are always on the side of the unpaying tenant. Never mind the landlord that is now facing bankruptcy because the tenant is not paying rent. And aren't tenants more like burglars who don't pay the landlord rent? I am so glad I do not own any rental at this point in my life.. Thank God I sold them all. Yah!!!!!!

    Where I live the property manager and the assistant manager are so terrible we have alot of cameras and when people who don't live here come around to visit and they cause problems they don't get in trouble but my brother gets blame for something he didn't do and his their target since they can" t find the person who did wrong

    Question: I have 2 tenants on the Rental Agreement. I just served one tenant on behalf of both (i.e., the 3 Day Notice had both their names on it)
    Now I'm told I need to serve them both. Is that right? Does each notice have to have both names or only the tenant I served?

      @@TheApartmentDealer it's a very terrible situation we small land lords facing in this terribly ruled state of NYS. My rogue tenant has rented off my apartment to unknown people and getting money while paying us nothing at all. The notice to vacate was given in February this year. No rent, no communication, multiple unknown people, yelling, harassment and these shameless governor and authorities keep increasing moratorium. What kind of crooks who are throwing their responsibilities off their shoulders.

In reality, tenants don't pick up the phone, don't answer email, don't respond to regular mail, don't respond to notices on the door, barricade themselves in whenever you knock at the door....and this guy thinks you can have a conversation with tenants?     I have a land lord who i have paid up until this point the month of June and I have found a charity to pay the rent but he's not willing to discuss or even negotiate with me. He dose not even answer the phone. I need him to sign because the form so the charity can pay him the rent he just want to evict, can i sue him.

      Why does a Landlord need to sign a form so that a charity can pay him the rent? The Charity should be having you sign a form so that they can write a check to your Landlord on your behalf. I don't think the Landlord cares about who's paying your Rent, but they do care about signing forms that could potentially include undesirable clauses and agreements. You should have the Charity just deposit the Rent money into your Bank Account, then you can pay the Landlord.

      The moratorium is until may 2021 now. What a shameless new york state govt. What a joke. My rogue tenant and squatters have free pass. She is making money off my property and I can't do anything due to this moratorium.
