In the budget it states that people who haven't been residents in the last 5 years, which would include any foreigner who's never lived in the country before, but the finance ministry has already stated it was a mistake, the law only applies to former residents. So no, it is not a new NHR regime and it doesn't apply to foreigners, only to portuguese emigrants returning. Please provide the correct informations not to confuse the viewers.
The key question to consider is apparently now there is to be an exit tax and when you move out of Portugal it is considered a divestment - can you confirm that?

Since Portugal's tax bracket is at 48% for, say, 75k euros of US pension income, since US taxes at a lower federal tax rate, you probably would not be able to take the full credit for what you paid in tax in Portugal on the US pension income on your US return.

If your citizenship does not tax you based on citizenship (not the U.S.) and you are a tax resident of Portugal, if you hold crypto for one year it is tax free. The NHR is a tax status you can use for other forms of income, from employment for example.

Not 100% sure, but I think you need to average ALL your crypto to find out how much of a gain or a loss you have made. Then you pay tax on the gain. I hope somebody else with more knowledge can confirm this
These reduced tax visas and NHR schemes are set to attract people with money to Portugal, with views to having more money circulating in the country. It however doesn't benefit Portuguese citizens directly (,unless you are a lawyer,). All these foreign people had to break away from their home countries in search of better tax treatment elsewhere. I guess Portuguese people can look at the world tax landscape and see what benefits they may gain by setting up a business in a more tax friendly country. She mentioned Hungary for example.

Because until middle next year, there are other situations that make us stay there too.
I am not sure if I have the answer you seek, but I am from the UK and I am in a similar situation. I have a Portuguese Titulo de Residencia which I need because I am British, but I think the key is your residence certificate if that is what is still issued to Germans moving to Portugal. I think you need to register yourself with a NIF, apply to be a Portuguese tax resident, gather as evidence as possible that your INTENTION is to be a Portuguese resident, and after they have gratefully accepted you as a Portuguese tax resident, you simply apply for the NHR, but very soon. I am paying €540 for a lawyer to do it, not because it is complicated, but just to make sure I get it right, because the benefits are worth more than €540, so I see no value in trying to save a few €'s when my wish is to spend my retirement in Portugal and benefit from the NHR. But the Residence card or certificate and proof of your intentions are the two keys, plus applying to be a Portuguese tax resident, and getting the NHR application in probably in the next 2 or 3 weeks. Good luck! To apply for residence just come to Portugal and go to the Town Hall (Camara) They will give it if you have your NIF and your papers including passport
