- Scotland’s First Minister has insisted he is “very proud” of new hate crimes laws which have just come into force, as author JK Rowling warned the legislation is “wide open to abuse”.
The Harry Potter author, who has become a fierce critic of the Scottish Government’s stance on transgender rights, has been one of the highest profile critics of the legislation.
The Hate Crime and Public Order (Scotland) Act came into effect on Monday, consolidating existing hate crime legislation and creating a new offence of stirring up hatred against protected characteristics.
However, women have not been given protection under the law, with the Scottish Government instead promising to bring forward legislation to tackle misogyny.
Director of Advocacy at Sex Matters, Helen Joyce, joins TalkTV Julia-Hartley Brewer to discuss this further.

As a rape survivor with cptsd, I now use the disabled toilet to ensure my safety. Without disabled toilets I would not be able to go shopping or anywhere else for that matter

I've been misgendered most of my adult life. I have a deep voice and don't have the curves in all the right places as most women do. I'm a woman, born a woman, given birth to 4 children and will die a women. It seems I could get many people arrested under this new law, because I live in Scotland. I could get airport workers arrested, taxi drivers, shop workers, you name it I'm misgendered whenever I go anywhere. Yes it's annoying but it's not the end of the world and I wouldn't dream of pursuing criminal charges but some people will.

We will see what the true calibre of people in Scotland is when the next elections come around. I've cancelled my Green Party membership and written to the party to explain that it is being too gung-ho on this issue that's put me off. They won't. It may not even come to a single case in court. But after each investigation the person who has been investigated will go on a list. That list is to be consulted when people apply for a large range of jobs or promotions. It is IMO important that every case of someone's name going onto such a blacklist is contested.
I’m a teacher of 20 or so years experience and I am worried. There is no plurality of thought in our education system. We must guide the young towards critical thinking and not push one ideology.

Luckily in Ireland they would need a referendum before they could bring in laws like this and it would be soundly beaten. We already had 2 votes on the issue of what defines a family and we voted a big NO to changing the definition.
I find it offensive that a man insists he’s a woman when he’s not. When was his last smear test? When was his period? Can he carry a baby? He’ll never go through what we go through.
