      I am a Hindu and I salute Nariman for speaking against Chandrachud’s faulty review of evidence, where DYC read 9/10 reports saying there was no temple, and said it is proved without doubt that the temple existed.     58:05 if law has to be codifed and consistent, then u cant introduce specific cases in the law. Which means the law cannot say, beating someone is bad, except Person A can beat his wife. Therefore places of worship Act, is not fair in the sense of making one exception which is a political exception and codify that exception as the basic structure of the constitution. It also takes away that justice has to be timeless in the sense that, if i was born after 2000, i must also be given the chance to perform a rath yatra and introduce the rath yatra made for another temple as the basic structure of the constitution. Therefore places of worship act can be amended or removed, and a law that makes exceptions cannot be codified as the basic structure, and if people see that there are other temples where peoples emotions exist, the codification cannot take away the freedom of someone to go to the court. The courts can then conduct the case, declare that this temple was raised down, but in adherence to places of worship act we will not hand it over to one side. And whenever places of worship Act is removed, the courts can then revisit their judgement and say "it was already proven that this temple was raised down, but in adherence of places of worship Act it was not handed over to one party, now the places of worship Act is removed, we will hand it over"

      But wouldn't trying to determine the historical/religious nature of a relegious premise by decree of a court instigate further violence ? The solution has to be more nuanced than such a generalised one , the fundamental question that should be asked by the court while reviewing such petitions is the intention of inspection/survey of such premises.

    He talks about the separation of church and state, mentioning that when Mormons wanted polygamy, the Supreme Court of the USA dismissed it because you can practice your religion freely, but wanting polygamy is like religion interfering with the state's authority, so it is not valid. He used this argument to criticize the Ayodhya judgment. However, will he criticize why Muslims in our secular country have their own religious laws?

    It's amazes me that, Courts didn't find Places of Worship Act unconstitutional!!
    Having said that, asking for justice through court of law is being termed as Hydra heads,
    imagine the judges found hindu sides as Hydra, we think they are objective in interpreting law of the land.
    If BJP loose power in center we are going to see another wave of "why Hinduism is bad"
    I hope BJP doesn't play this trust of Hindus by being another Congress in ruling the country.
    Because there is no party who can be more pro hindu than BJP.

Such marriages are forbidden but still done , certainly there should be laws governing it , but it is very rare in india unlike our neighbour . All india muslim councils oppose both the practices. Coming to justice Nariman speaking about banned practises , it was important for him to talk about banned practices to infer the genealogy of our morals . The majoritarions was scrutinized because majoritarian organisations are harming the secular nature of the country not the majority itself.

      All india muslim councils have opposed nikah halala and muta , and have been long outlawed , in the islamic way of life marriage is a lifelong commitment unless circumstances prevail against so , marriage only for short term pleasure is a sin since the inception of Islam . And nowhere do muslim personal laws of india protect nikah-halala . Justice Nariman talked about the right wing majoritarians not the majority itself .

      Waqf can only acquire land that was promised to waqf , a muslim relegious site is not by definition a property of the waqf . Waqf properties are those which were willfully endowed to the purpose of social welfare and worship, waqf can only claim properties they have documents for , they don't have the power to haphazardly grab property.

      If the same argument is used , it can also be claimed that many Buddhist monasteries and temples were broken down in east india in the present day states of Madhya Pradesh , bihar , bengal , jharkhand and the northeast . At some point a red line has to be drawn for claiming religious sites otherwise our country will spiral down into a dark rabbit hole .

That is why you don't find temples, vihars existed today in that area. Constantly being under attack by invedors, buddhists population ran away to Malaysia, Indonesia, Nepal, ladaq area . We have no history of Hindu temples built on vihars. But Buddhist people tried to install buddhas idol in Hindu temple ankor vat of Thailand. If Buddhist have proof they should claim their vihar. But in reality they don't have any proof.

    Such ridiculous and irresponsible arguments denigrating the ayodhya judgment. When 100s of acres of land is occupied every day in India under the draconian waqf act brought on some ludicrous claims of the Islamic philosophy this person says Hindus must not claim what is rightfully theirs. If you have the guts ask how come waqf is in possession of such laks of acres of property in India and its basis even after they took 1/3rd of our country in the name of their religion. How churches are still controlling the properties even after British left. No you will not ask. You have the time to lecture Hindus to practice secularism but not to others.

Sthal toh hame politician ne bataya jinko dharm mei pramaan nahi mana jayega. Iska matlab jo hamare dharm se pramanith nahi aur koi bhi manusya ke paas ye authority nahi pramanith karne ka. Iska matlab ham ek fake sthal ko pooj rahe hai, dharm ki manyata mei milawat kar rahe hai.

    Intellectual dishonesty at its highest level. The Indian Constitution is another convoluted and contradictory document. One article proclaims that all citizens have equal rights, yet there are special laws based on religion. From the discussion, it appears the speaker is not open-minded. He referenced only one case, while there are thousands of cases from before 1993 still pending due to Supreme Court negligence. India is the only country where the Supreme Court selects its own judges, yet this speaker casts aspersions on the judgments of colleagues that contradict his own viewpoint. Shameless. Less on facts and more on rhetoric. Secularism doesn't mean some one surrenders his basic rights . If he feels judgement was wrong , he would vehemently opposed and appealed just like they challenged NJAC which was passed by Parliament . Striking down the NJAC is a travesty of justice.

    Nariman after recusing himself from the Ayodha case n now blabbering only shows their ulterior motive. We have the Narimans, isn't Sr Nariman the one of who argued in favour of Union Carbide who killed n paralysed thousands in Bhopal. Now this Jr.Nariman in similar mode.
