At least Bucky got off easy with the government recognizing that his assassinations were not of his own will, but the thought of Zemo having to pay $102.00 in addition to his other offenses just makes me laugh.
Some of Red Skull's crimes could be considered "legal" due to it being war time, such as the imprisonment. However, he could have been charged for violating the Geneva Convention's rules for ethical treatment of POW's. His mass murder charge against the American soldiers should not have counted, it was active combat. Him trying to kill Cap while captured should have been another Geneva Conventions violation for attempting to execute a surrendering enemy, although Cap could potentially be charged himself for a false surrender. Owning weapons of mass destruction during WW2 was not a crime. His attempt to bomb the US during wartime technically is not criminal as well. Not to mention that in real life (presumably in the MCU as well) the Allies firebombed Tokyo and Dresden, among other cities, and the US literally nuked Hiroshima and Nagasaki. All four cities were primarily citizen targets. Of course, the Nazi's also bombed London and Stalingrad, among others, so both sides were targeting civilians. War is a nasty thing. Attempted murder of Cap in the plane should not count, it was active combat.

Other than the few instances where he's killing his allies and at the beginning of the film when he kills two men that aren't part of an enemy faction, any death that occurs as a result of his actions is considered to be on behalf of a military at war. You don't charge other generals in wars with mass murder when they kill people on the other side, or with false imprisonment when they capture POWs. Although Red Skull commits treason at one point, he remains a soldier until relieved of duty and it would seem that doesn't happen. The war crimes and things like the treason charge still stand as they are independent of the war.
