Yes, she knows that he has a gf, but the bf never set any boundaries for her to not cross. He just allowed every behavior she displayed. And he did cheat. Someone kisses you, your reaction will either be to immediately push away or shock, then immediately push away once realized what happened. He realized what had happen but he just stood there. He might not have kissed her back, but neither did he make an effort to move or push her back. He practically waited for his then gf to show up and only when he SAW her there, did he make the SLIGHTEST bit of effort. Then later he tried justifying what had happen. That Is CHEATING. Look idk where you are from but for most of the world, that is cheating. You are free to have your own opinions and I'm free to have mine. Let's end this conversation here.
