  • The International Court of Justice (ICJ), the principal judicial organ of the United Nations, is holding public hearings from 19 to 26 February 2024 on the request for an advisory opinion regarding the Legal Consequences arising from the Policies and Practices of Israel in the Occupied Palestinian Territory, including East Jerusalem. These hearings are taking place at the Peace Palace in The Hague, the seat of the Court, under the presidency of Judge Nawaf Salam, President of the Court. In this session, we heard from Colombia, Cuba, Egypt, United Arab Emirates and United States of America.

    This case is not about a ceasefire. Its about clarification on the if the occupation of Palestine, by Israel is STILL considered illegal. They are trying to get that reestablished, because the USA, UK are trying to refute that which was already declared, by saying the current situation changed (via the language of the definitions) that. which is the bulk of the previous case decisions they are presenting. The ICJ decision will impact whether what's being done to Palestine (the occupation itself) is a legal action. This case impacts ALL nations.

    The court has not only an advisory role. How can you apply different rule for ICJ and civil courts. Shouldn't we be all affected by binding rulings as all civilians are. In the end civilians are the first and last who are affected by wars.

    Yes!!! The UAE making the point about International Law not being an Al A Carte Menu, but needing to apply to all is the root of the issue, and has always been the root of the issue! Israel has contravened International Law continuously! If it does not _recognise_ the authority of the UN then it needs to accept, by the same token, the UN can't have had the authority to Partition Palestine in the first place - meaning Israel doesn't legally exist!!!     This a sham. The ICJ already ruled on the question of the occupation, that paved the way to the Oslo agreement. Namely, that framework for ending the occupation shall be through negotiations between the parties, and that it shall not be unilateral. In fact, a unilateral or court ordered end to the occupation cannot in good faith end the conflict and would indeed harm chances for true agreement. There exist no prohibitive ruling or international law over the settlement of temporary occupied land, as long as the annexation of land is not make official. Israel never incorporated the occupied territory or moved the lines. Moving the population in the case of an agreement is not unprecedented. India and Pakistan had exchanged millions of citizens, Israel pulled out of the entire Sinai desert and Gaza. As for the Palestinians negotiation claims. In the international stage they claim Israel is not negotiating in good faith, always making excuses not to come and deliberate. The real reason they don't come is that they are scared that their population will not like negotiating with Israel and support for Hamas and other alternatives will raise. Palestinians need a stable, unified government that can make those tough decisions with the backing of their people. This ICJ case and similar efforts and rehitoric strive to undercut the previous ruling, skip negotiations, and get a new contradictory ruling, perhaps leveraging the global sympathy as a result of the catastrophe playing out in Gaza. But remember. The only way to arrive to peace is for both sides to take responsibility, both sides to stop inciting hate, both sides to stop spreading lies, and start working for a common goal.

    All aid, both currently commited by the US or planned in the future, to be given to Israel should be directly applied to the assistance of Palestinian people - infrastructre, shelter, hospitals, schools, food, etc... And all illegal settlements on Palestinian land should be vacated and turned over to the Palestian people for immediate and permanent housing to begin restitution for all that has been destroyed and stolen from them over the years.

    The United States argument sounds hollow because they have been the supporter of Israel and the obstacle to the Palestinians aspirations. The financial interests of American citizens in Israel plays a big role in denying the existence of a Palestinian state. The state of Palestine should be established right away/immediately and let the honest Israeli citizens work with the Palestinians people to rebuild their country. This will reduce the tensions and hostilities between the two nations, and bonds and trust will be strengthened and friendship formed between the countries and peoples. Trying the same dishonesty that the US is promoting is not going to lead anywhere except to war and violence against the people of Israel and Palestine. We have been down this crazy street for decades.

      There is no legal State of Palestine. That's the problem with those who don't know the legality and when speaking of "rule of law". They may be a palestinian people just like a Jew living in another area but they aren't a state unto themselves. Independent politically and economicaly with defined borders.
