    I was walking on the right side of the road my way to work in early September and I was hit from the back by car, I was on the hood, then she turned off and I rolled off in the ditch...
    The lady that hit me took me to the Emergency Room, gave me 20$ and left, I done a police report, and was out the hospital and was able to go to work, I went to a lawyer the next day and she started processing my accident... I been going to treatment 2 days a week ever since, they sent me to an MRI and a surgeon recently, and scheduled for another appointment Jan 29th. After seeing the surgeon, they dropped me to 1 day a week at the treatment place...

    I was just in a t bone accident the other driver was at fault he hit me on the driver fender door area and pushed me head on into a utility poll and my wife was taken in a ambulance to the hospital and i went to the hospital after the car was towed we are both in pain my wife is lower back and knee and mine is kneck and lower back all tissue damage no breaks or cuts but my car is totalled. Im contacting attorney's tomorrow is that the best thing to do

    I was T boned by a drunk driver, and it was a hit and run. The police caught the guy, thank God. And the person had insurance, as did I. I was taken to the ER for back pain and have been in Physical Therapy for about 3 months. About 12-15 sessions. My medical bills have been about $6000. I can perform my exercises but have been told not to jog or run yet. I used to go to the gym 3-4 a week. I can't lift heavy anymore or jog. How much do you think I will get?

    I dont know what to do i had a car accident i was rear ended i was transported to the hospital i was pregnant at the time with twin i went into early labor i had vaginal bleeding a placenta abruption and a bulging disk and complications in labor i developed preeclampsia and /hemorrhaging so i have a case ?     I was rear-ended by a driver in CA and had vehicle damage over 1K($1400) and have been going to a health clinic 2-3x week for about 2.5 months. The other parties' insurance co. has just contacted me but I already have an attourney. Does it hurt to call their insurance co and see what kind of settlement I can get?     i`m wondering what my settlement will be...uhaul truck pulled out in front of me..the guys insurance doesnt want to take responsibility, and the driver didnt report accident to uhaul. the other driver was cited. my car estimate is over $2300...i had to go to chiropractor for 8 weeks for whiplash and shoulder pain...chiro said i`m not getting worse but i`m not getting better. the lawyer has just received the paperwork from chiropractor. i`m wondering who is going to be responsible, uhaul or other drivers insurance, or driver himself?

    I've got $30,000 in medical bills from a car accident. I was not the at fault driver. I have done 18 months of chiropractic and physical therapy treatments combined. Also had 2 back injections.     Was in a crash that was the other drivers fault pulling out while on cell phone n crossed 4 lanes basically went to have mri and revealed nothing while still having pain . Got cortisone shot n went to therapy and still nothing. Got 2nd opinion and he said I needed surgery . Found out I had a torn rotator and crushed tendons been out 5 months and physical therapy. I’ve now been diagnosed with depression with all this , thankfully it was on job so I am getting workmens comp but do I have strong case and if lowballed offer comes to me what do u think is a fair offer?

    I was in an accident Friday. I felt a scrap on my back but I didn't think it was a big deal and I was more worried about my sports car. I told the EMS that I was fine. Later that day my back and right side started to hurt. It's still hurts today. It's saturday. I'm planning to call my doctor on Monday. Is that too late? I'm not trying to get billed for doctor visits that I don't need.

    Hi Kelly team, so I was t bone in an accident last year my car was totaled and the insurance company paid for the car but I still don't know how much my case is worth,my medical records are as follows,right after the accident I had both left and right knee arthroscopy, I also had a terrible neck and bark pain after the accident so I had to get 2 injections on my neck, and about my bark pain I had 5 injections but the injections didn't work so the Doctor had to do disectomy but the disectomy didn't work either so finally the doctor had to do a procedure call spinal fusion,which have help me a little, I still go for physical therapy but how much is my case worth.Thank you..

      It sounds like your injuries were significant. Given that you had a spinal fusion, you likely will have long term impairment. These types of injuries often result in very large settlements. However, you will need to first make sure that you have established liability in the accident. Secondly, you will want to know how much insurance coverage is available. Often, people with very serious injuries are forced to settle for smaller amounts because the person that hit them had low insurance coverage. I would want to know if you have underinsured motorist coverage in your policy. Depending on what state this occurred, there may be other insurance coverage for you. What are your total medical expenses? These are just a few of the factors that I would want to look at before telling you what your case is worth.       Very Easy , get a pen and paper and add all your Medical Bills , your lost wage, and you pain and suffering if not fix correctly might take two to ten more operation , and this might take 2 to 3 years to add it all up , my opinion , remember when you sign up that Attorney to all those number , it will cost you dearly and no way out , he will turn on you next .

    I was hit by a car walking in a bike lane, the lady who hit me wasn't paying attention I sustained a head concussion, factured ankle, contussion on my head, contusion on my foot and permanent scarring , bone bruise on my knee and common fibula nerve dysfunion and mylgia in my leg my attorney said they only have 250,000 and my med bills are over 61,000. I have a doctor saying I can no longer go back to a normal job standing or walking. after all this is said and done I will receive pennies and I'm annoyed and don't want to be screwed. my attorney had to file suit because they didn't want to offer anything. the police report and the person who hit me clearly said its was their fault, and the insurance did say they were at fault. so now I don't know whats going to happen. I did not have med insurance or car insurance.

      If your attorney filed a lawsuit, it means that they are pursing your case and trying to get you a resolution that is fair. Litigation can take a long time and there is a lot of work that is involved for your lawyer. You may want to ask your attorney what goals they have for your claim. Are they looking to take your case to trial? Do they have a plan to get the case settled? What was the hold up to settlement? There are too many questions for an online forum. I'd advise to sit down with your lawyer and really go through case strategy so that you completely understand what to expect.

    Worked on a 1000 acres ranch when I was 19 , I’m 20 now. 99% of my transportation time was spent in a Polaris ranger with no doors. Got t boned by a car going 50mph. I was ejected and flew through their windshield and ended up in their backseat. I died and came back to life. Head split wide open, brain was bleeding, internal organs were bleeding. Only got 50k which everyone I knew said wasn’t enough but the lady was so poor that suing would have made no difference. The opposing insurance only agreed to 50k. At least I got something it’s all in mutual funds now but damn my Brain hurts everyday I feel like I was owed more idk.

    My wife was sitting at a red light when a guy hit her from the back really hard, and she was a car length away from the car in front and managed to damage that car in the process in total it was 5 cars. She had two kids 2-6 and her brother age 14 in the car, my kids are scared to be in the car and my son has nightmares about it. What can I do? The guy that hit her worked for Uber , I'm trying to find out if he was on the clock. He showed no signs of stopping not even skid marks .

      You will first want to try to obtain the police reports from the accident. This should give you the information of the person that rear ended your wife. Most reports include the adverse name, vehicle, date of birth, and insurance information. If he was on the clock for Uber, you will want to contact them and open a claim with them to get an adjuster from Uber as you will be able to recover from them. I would recommend reaching out to a personal injury attorney in your area as with multiple claimants and vehicles involved, these cases can get complicated.

    I’ve been stressing and have been in pain from my wreck on February 9th 2021 with my cousin. FedEx ran. A stop and yeild sign and flipped us 4-5 times and a year later nearly I barely hear from my attorney and my three herniated discs are killing me and I am pretty sure my hip is dislocated cause it grinds and pops all the time am I going to get enough back to get my hip fixed?

      Individuals can be sued beyond the amount they are insured. Typically, they the party bringing the lawsuit would need to take the case to court and get a judgement. Whether they can collect on the judgement is determined by the assets of the person being sued. If the person being sued has no money, it is often very difficult to collect anything from them.

    lawyers get too much money 1/3 for doing nothing , meanwhile you are out of work , nobody pay your bills , hospital bill , chiropractor bills , back spine doctors bill , injection bill, at the end the lawyer are getting more then you will get , meanwhile , go ask the lawyer for a loan or to speak to him , never in , you only get to talk to some young pretty case worker on the phone with no law degree, good luck with all your future pain and lawyers coming after you to collect .

    At what point in your settlement are you informed of any liens weather it be medicare , or child support etc?

      Liens can be discovered throughout the process. Many providers will have you sign a lien and provide you a copy. With medicare and child support their is a process you follow to check the lien amount. You can reach out to any of the entities to find out if there is a lien. Additionally, the county recorders office will typically have a list of perfected liens. Note that it will be the patients responsibility to know if there is a lien. So it may be a good idea to have a lawyer do a lien check for you.

      You will want to make a claim against the adverse driver for your injuries. I would recommend reaching out to a personal injury attorney. I say this because your injuries are serious, and you likely have hospital bills and future treatment. Dealing with health insurance, liens, medical bills and the adverse insurance company can be complicated. Particularly when there are multiple parties injured.

      My lawyer said that if the persons at fault insurance policy is 25,000/50,000 than 50,000 split between me and 3 passengers is the most that their insurance can pay us for the medical bills. Also the person at fault hit 2 cars, one of them is us. So is the 50k split between 2 cars?

    I was in a bad car accident on August 23 where I broke my humerus bone and now I’m in therapy 2 times a week starting next week it’s 3 days a week we are trying to get my elbow and arm movement back and the pain is off and on sometimes strong pain and I’m 24 and it’s no fun the person ran a stop sign

      I understand your concerns with the pain and rehab can be difficult. It doesn't hurt you to try to get a large amount for a serious accident.

    My little brother was in a car accident last night (he was not at fault) he had done a police report and told the firemen that he wasn't in any pain (bc of adrenaline) so they didn't really check on him (yes not the paramedics) he didn't get much information on the guy at fault but his license plate number. He is now saying he is having major neck and chest pains, his left knee and left elbow are swollen and has a hard time walking. my question is because he doesn't have health insurance, is there anything we can do to try to get a settlement?

      You will be able to get a settlement regardless of whether you have health insurance. You should get a copy of the police report and open a claim with the other drivers insurance. You will likely want to discuss this with a personal injury attorney in your area and they will be able to get your little brother some medical treatment. Many attorneys know doctors that will treat people without payment from health insurance. They will often wait until the claim is settled to get paid.

    hey, I was in a motor scooter accident due to a non visible speed bump(the slim ones) in a apartment comp. there was no yellow strip or sign that warned(also at 3am so it's pitch black Tallahassee,Fl.) it was black along with the ground. I broke both wrist/hands. recked my cousin scooter. all right before going to MEPS for the navy to enlist. worst pain of EVER IN MY 22 YEARS OF LIVING. after surgery and therapy cost it($80,000-$85,000 maybe more) what's a ball park range settlement you think I'll be Looking at. please and thank

      Hi bobby, you clearly have very significant injuries that could warrant a large settlement. I wouldn't be able to tell you how much your case is worth without looking through everything very closely. I think the biggest issue you may have is proving that the speed bump was negligently placed there. You may need and expert that would say that the driveway construction was inherently dangerous. I would make sure to contact an attorney there in Florida to review your case with you to make sure you can establish liability.

      Hi Bobby, your damages could be very large with the injuries you described. I would want to review your records before saying what the claim is worth but I'd imagine you have some permanent injuries that could warrant an impairment rating. Have you been in contact with the insurance provider for the apartment complex. In your situation, I would be more concerned about establishing liability on the part of the apartment complex.

    what happens when your medical bills are over( 100 thousand)greater than the 30 thousand cap they have in their insurance. if the accident happend in Texas and the person who caused the accident lives in Arizona?

      If the medical bills far exceed the insurance limits, the attorney handling your case will need to do their best to get as many reductions in the valid liens that the medical providers have. Typically, medical providers will agree to accept a much lower amount from what is billed. You then would need to use your own insurance and see if there is any underinsured motorist coverage. I do not practice in Texas, so you will want to reach out to a local TX attorney and make sure you are getting the most updated and accurate information.

      you should be able to ask for a copy of your file from your attorney. It should include a copy of the check that went to your lawyer's firm, and a breakdown and copies of any checks that went out on your case.

    Hi my name is ivan and 2 weeks ago i was rear ended by a drunk driver and he flipped over and killed his passenger. Me on the other hand got rear ended and my back still hurts i want to go to a doctor but cant afford it and i called the other guys insurance company and they said that there only gonna give me 500 dolars which is my deductable but yet my life was jeopardized have a bad back and im only getting 500 bucks for my deductible im not sure what to do?       I think you have good reason to call an attorney. Typically there will be a policy limit that you will be able to receive from the adverse insurance company. I find it very hard to believe there would only be $500 available to you. Your attorney may be able to get you some treatment on a lien so you have no out of pocket and get a copy of the policy declaration page.

      It sounds like you have very serious injuries that could amount to a very large settlement. You will want to make sure you get a doctors report that gives you an idea of how you will heal long term. If the doctor believes you will have future medical costs and impairments, you will likely want to talk to your lawyer about getting an impairment rating. Some of this also depends on what insurance is involved and how solvent the defendant is with assets. I highly recommend calling an attorney in your area for a more complete evaluation.

      Personal injury attorneys often settle for policy limits and do not pursue the defendant individually when there is a low likelihood of actually recovering from the defendant. You have a couple of options to check into what happened with your mother's case. You can request the complete file from her attorney and have it reviewed by another lawyer to see if the work that was claimed was actually done, or you could contact your state bar and have them take a look at whether the attorney actually lied to you.

      First you need to make sure that she gets treatment if needed. She should also know that she does not need to give a statement to the insurance company. You may want to track down the police report from the incident so that you have the insurance information of the party that hit her. You will need to notify the adverse insurance company and your mother's insurance about the accident. It would be best to consult an attorney in the state that you live to talk over your next steps to ensure you are handling things the right way.

    (back/neck whiplash injury).

      This depends somewhat on the state in which you reside, but generally you should be able to get a recovery from the insurance of the party who hit you. All states require drivers to have at least some insurance. Did you get the insurance information of the other driver from the police? If so, you will want to reach out to that company. It will be a good idea to at least speak with an attorney before you do.

      You will want to start by getting a copy of the full police report. Remember, that it is possible the other driver does not have valid insurance, which means you may need to use your own insurance and make an uninsured motorist claim. You will possibly also have a claim for punitive damages because the other driver was driving under the influence. I would want to follow the criminal case and get a copy of any convictions. Finally, always at least reach out to an attorney in your area and talk the case over with them. You need to be aware of any statute of limitations that you will have in the case.     I was in the motorcycle accident last Friday. the car next to my bike decided to change lane and next thing i know is that i am flying and landed on another car bumper.       In your situation, I would recommend seeking a personal injury attorney for a consultation. Many will offer a consultation for free. Often times when you are in an auto accident it can be difficult to find the right doctor. If you need to see a specialist, it can be difficult to find one nearby that takes your insurance and is a good doctor. Some doctors will work on a lien, meaning they will wait to get paid from an injury settlement. This does have advantages, but comes with some disadvantages which you will want to discuss with a lawyer.

      Motorcycle accidents have the tendency to have more serious injuries. It is often advisable to at least speak with a lawyer about your injuries and the insurance that may be involved. My questions would be: Who was the driver of the vehicle next to you? Did you get their information? Is there a police report? Is there insurance listed for the other driver? Do you have under/uninsured motorist coverage? After getting this information, I would be able to direct you about what the next steps would be to help you recover and get the treatment you need.

      If you were the at fault party, you will not be able to obtain a settlement from the person who was not at fault for the accident. You may want to see if your policy has any medical payments money that is 'no fault' money, meaning it doesn't matter if you were at fault for the accident, your insurance would still pay you a set amount for your injuries. I would call your agent and ask them to send you the declarations page from your policy. This will tell you all the overages that you have. You can then call a personal injury attorney in your city to go over it with you to see what your options are.

    I drive a commercial vehicle and was hit by a SUV. No serious injury, they took me to work comp Dr. He had me follow up a couple of times and he prescribed me a med that interacted with a med I was already on, I got so sick I went to emergency they kept me over night running test, mostly for my heart (past heart attacks)
    W.C. seems to be doing what they should but but I want to file a claim against the other vehicle but dont know what figure is fair to start from, my main injuries were spasms on one side and my hip having a weakness that caused a little limp, it's gone now, but I still get the spasms. But I have been released from the jobs doctor. What's a figure I should be shooting for? PS. My vehicle had cameras, and the man said he just wanted to eat his sandwich from Wendy's

      I appreciate the detailed question. My understanding is that you were hurt while on the job and currently have a workers compensation claim, but would like to consider making a third party claim. Unfortunately, I would have several other questions before I could begin to speak to you about figures to shoot for. It sounds like liability will not be a problem, the question will become what your damages and pain and suffering amount to. You will want to call a personal injury attorney that works in your specific area because the settlement will depend on the norms of the area you are in and several other factors that a detailed consultation with a good attorney should help clarify for you.

      Hi Carmelo, I would need to know if you have any permanency to your injuries. If you were treating for typical whiplash type symptoms, I would want to know what other inconveniences you have had to go through because of the accident. Often times we start with asking at least 3 times your medical expenses, however this will very greatly depending on who the insurance company is, what adjuster we are working with, what other incidentals you have, what state you are in, and others.     how much is a case normally worth if you have gotten in a 5 car wreck all vehicles were totaled by the teenage driver on her cell phone and I have just had to have a microfracture surgery along with meniscus tear and cartilage after almost two years of therapy cortisone shots and gel shots and nothing worked I also have a tear on my other kneecap that was not there before so one knee that had bothered me two years before the wreck but I had lost 150 pounds and my left knee never hurt anymore and have records were I had not been to the Dr in a year before wreck when I used to go every 3 months for shots I'm saying this because I know previous injuries matter or do they so this is what happened hit dash I was passenger with both knees had huge hematoma on right knee I was the passenger in vehicle 2 that got hit from behind then we were shoved thru fence after Flying in air and hit and totaled 3 more vehicles I've been out of work 10 weeks all together and still not released to go back right knee the one I had to have surgery on not any previous problems at all left knee was well had been well for a year my bills so fat are 45000 plus missing 500. a week work thank you sorry so long

Also, if this accident happened in Arizona, you only have 2 years from the accident to bring a claim so you may need to act fast.       Hi Tracie, although previous injuries matter, they will not preclude you from a fair recovery. The defendant takes the victim as they are and will need to compensate you for any aggravations of previous injuries. You have significant injuries and a complicated accident. The fact of the matter is that you have no fault for the accident as a passenger and likely have a claim against multiple insurance policies. With so much going on, it will be very difficult for me to give you a number that you should be expecting for a settlement. I practice in Arizona, but different states have different laws that will make a multiple car accidents outcomes differ. You will need to contact an attorney in the state in which the accident occurred if you haven't already. Keep in mind that with a lot going on, such as your case, it can be difficult for your own attorney who has been working the case to always predict what kind of settlement you will get. There is some amount of uncertainty that we deal with, but if you have a strong advocate on your side, you can at least know you are doing all you can to maximize your potential for a fair recovery.

      You should always address this with a tax attorney. Some forms of settlement are tax exempt and others technically are taxable. We generally have not seen the IRS come after injury settlements, but you need to make sure you are complying with your state tax laws. It would be a good idea to discuss this further with the attorney who helped you obtain the settlement, or at least call a tax lawyer in your state.

      This is a common question that is unfortunately difficult to pinpoint without all the information. It is very difficult to say how much your settlement will be as each case has unique factors. You will want to speak with your California attorney and request that they give you an idea of what to expect. Most attorneys will be able to get you a range of possible settlement amounts based on the jurisdiction, insurance involved, doctors notes from treatment, your other damages which would include pain and suffering and lost wages.

      There are protections that you may have for this type of situation. If the person who hit you has no insurance, or too little, often your own insurance can help, however you need to have the right coverage. You will want to see if you have uninsured motorist coverage in your vehicle policy. If you do, you will be able to make a claim for your damages through your own insurance company.

    I was driving last week on a Tuesday I was in the middle lane and as I was passing by this hotel this girl had just came out of this hotel stops in the middle of the road and tries to uturn but she can’t because of traffic here I come i couldn’t move to the right because there was a car on the side of me so I put the break as hard and quick as I could and I end up hitting her..the airbag knocks me and my brother (who’s a minor)out..my brother gains his consciousness back he thought I was dead he said I was laying on the airbag so he shakes me to wake up thank god I was able to snap out of it omg I heard bells in my ears seen stars ..This is my first accident ever I was so shook scared terrified and so broken hearted because my little brother had a few cuts and bruises..The other driver she had no feeling she didn’t say not one word she even had the audacity to ask some random guy watching is my car fixable their like no because that car is a late model and that they no longer make those cars anymore..She got a ticket for failure to yield and we checked ourselves in the hospital..Oh and my car is not fixable it’s totaled..do you think I can have a case should I take legal action?

      In that case check with a local lawyer. NO I repete NO TV LAWYER. They charge too much 40% vs 33%. Do your research . Research the lawyers on the internet. Insurance companies have their own lawyers for a reason . That's to give you as little as possible. It's called the swoop and settle move. They try and settle with you as quickly as possible before you discover real problems that will cost them more.
      After a hurricane or bad storm ...ie...flood...ect.. They come in do a quick look at damages and offer you some quick money... don't take ... because once they write the check and you sign for it.... you have a open roof .... and now it starts raining for a week it's going to take 3 weeks before you can get anybody to do the work and by then the damage in the house has almost trippled from the rain and weather and the insurance company makes you feel like you were bent over and violated by a prison full of inmates. Ask anybody and do your research. They have dozens of lawyers on their payroll.... and you can't compete with that....

Am I entitled to receiving loss of use even if I have a rental. I have a sports car and the rental rate per day for the rental they put me in is significantly less than it would be to rent a car like mine.     I was recently in a car accident with my husband and daughter in the car and my car was considered "total loss" after 3 months of financing this car. They offered $10,000 for my Nissan Sentra 2013. Initially, I put $2,000 down and financed for $15,000. Should I negotiate more, and will that delay me from getting a new car?       Hello Sherrod. There isn’t a specific formula to follow for neck or back pain from a car accident. Assuming the other party is proven to be at fault; generally speaking the amount of money is based on historical norms for cases in your area; whereby the person has similar injuries. If you are in Arizona feel free to give my office a call and we can see if we can help. If you are not I’d recommend at least calling a personal injury lawyer in your area. This does not mean you will need to hire one; but after you provide details of your case they should be able to give you a general idea of the value of similar cases in your area.       Hi Dominick. It is very common for an insurance company to make low ball offers. The question is what you do with that offer to get it up to something reasonable. You may want to ask for specifics from your attorney to see why the offer is low. It may be that you just need to provide more documentation regarding your rotator cuff issues.

      The value of your claim is very difficult for me to assess without reviewing your medical records, the police report, the insurance coverage, and other related documents. It sounds like you have relatively serious injuries, but I have no way of telling you if you will be able to get $30,000 in an injury settlement without looking at everything closely. You may want to get an appointment with your lawyer and have them explain everything in detail to you so you know what to expect.

    Is it possible to win some but not all of the financial damages you are seeking in small claims court? For example: I'm seeking $3600. $1000 of that will be easy to prove liability & damages. The rest of the $3600, won't be so easy. Might a judge award me the $1000, but not the full $3600? Does going after the full $3600 hurt my chances of an overall successful outcome?

      The judge could absolutely award you $1,000 and find the other damages were not proved. I wouldn't say requesting $3,600 sounds unreasonable as long as you have a good argument for why they should be awarded. If you believe the damages are related to the accident, you shouldn't have concerns about hurting your chances.

    Hello, my name is Jason, my 9 month old son Charlie and I were recently involved in an accident involving another car which T-boned my f250 lifted truck in which I have always been fully covered throughout my entire years of being behind the wheel. From what I believe his car was totaled he went through a yellow light leaving the other vehicles next to and right behind him at the light while he gassed excessively speeding well over the 35mph speed limit I saw this happen but I had already started making a left hand turn on my way across the two lane road into another lot area to turn my truck around due to no u-turn available. He then gassed his car going even faster further exceeding the speed limit trying to permit me from going any further then realizing his speed braked skidding 35 yards into the passenger side and rear portion of my truck. Initially I was told it looks like he would be at fault I even provided the skid mark length the tires made(not sure if that was looked at) indicating his excessive speed over the acual speed limit. Then I get a call back later saying it was 51%my fault since I was making a left turn and didn't have the right of way...I would have never turned seeing how far away he was thinking he was at normal speed but he clearly was well over and approached much much faster then expected due to punching the car through the light and again to try and permit my continued forward movement which was him being rude. I going to fight it of course and on the other hand my insurance is now saying they don't want to pay for the damages of my beautiful Truck but I'm not sure they know the details of the truck I believe they just see the year and compare it others in my area and get a figure which is not fair since it is basically a show truck with a fraction of the amount of miles a normal f250 that year would carry. How am I able to move forward with repairs showing them it's worth fixing. It saved my infant son's life by being lifted even after almost direct hits to where he was seated. Also none of my airbags deployed which makes a total loss hard to get. This truck was something purchased from hard work being deployed has never been in an accident it's paid off and has proven it's safety by saving my son's life. I promise if we were in a lower smaller vehicle my baby son would not have the same story I can boast about now we believe it would be quite the opposite. I never wanted another vehicle after I proudly purchased it and don't want them doing minimal work trying to finalize a claim as fast as possible due to what other trucks info aquire. The number I was thrown or heard over the phone from my fiance was like a slap in the face, a joke, and clearly no work or even them seeing the truck took place... I forgot to mention that a police report was made and they had witnesses but none of the information about the witness contacts info was kept nor saved.. so how in the world does that make any of what was written valid if their now impossible to contact bc it was not saved with what was stated. I had one nice gentleman who waited by me to report the other drivers excessive speed who waited by my side until he was able to speak with an officer, his name was Matt. Due our son recently making the great addition to our family I volunteered myself to be the stay at home dad so I don't make the funds except for my disability I receive monthly from my almost decade of active duty. I really just need help all I want is to have my safe truck back, treated fairly, and receive the proper work I made sure I paid for by properly covering my vehicle to permit actions like this if it ever arose God forbid. So lastly, the work done which totaled a little over $5k I have always been fully covered and want the work done properly as well as to be treated fairly... I apologise for rambling but I have been really stressed with how State farm has treated me throughout this ordeal and I'll bring up items a few times over...Please help. Thanks, Jay.

      Insurance rates are typically rising and it is indeed partly because of false claims. Its a good idea to shop rates every 3-5 years to make sure you are not overpaying for your insurance.

    Hi, i was rear ended by an 18 wheeler while 6 months pregnant as a result it put me at a high risk pregnancy an the doctor took the baby at 38 weeks. The baby is now 3 months an healthy but I have to go to go to the chiropractor for treatment. Do the baby get an individual settle? Do you think the insurance company will give me a low settlement

      Thanks for the interesting question. You and your child could have separate injury claims. It sounds like you were injured so you will be able to get a settlement or compensation for your injuries. Regarding your child, it depends if the baby was injured in any way because of the accident. Your child will have until they turn 18 to make a claim if the accident happened in Arizona. You will want to open a claim for both yourself and your child and make sure to take your child into the pediatrician if you notice anything unusual about their behavior. It is a good idea to at least consult with an attorney right away if you believe your child may be injured.

      You can make a claim for the baby if there was any signs of injury that can be related to the accident. Most states allow minors extra time for the statute of limitation to make a claim. If you have noticed something that makes you think the baby was injured or affected by the accident, please speak to a lawyer about what your steps are for making a claim.

    Hello I live in Florida and I was hit from the rear while at a traffic light. The vehicle was totaled and I was taken to the hospital by an ambulance. I have a pre- existing injury to my neck from a workplace injury(ongoing workers' comp case) but the MRI I had after the auto accident revealed that I suffered more injury to my neck. I have several herniated/bulging discs and weakness, numbness, and tingling in my neck plus other areas (left forearm extending into my left hand and fingertips.) I have ringing in my ears, invertigo and a pain that is dull(but persistent) in between my chest area, which I never had before this accident. My attorney submitted a demand for $225,000. The insurance offer was $12,995 should I continue to negotiate or sue? Thank you for your response in advance.

      It can be difficult when you have a low offer from an insurance company to decide if you want to settle or proceed with litigation. Understand that your attorney is uniquely qualified to evaluate whether the offer is fair. It does sound like you had a lot of new injuries from your second accident. I would sit down with your lawyer and ask him about each of your new injuries and make sure that he has communicated them to the insurance adjustor. Lawyers who are not careful, can sometimes leave money on the table because they have not done enough to show the adjuster what you have been through. It may be a good idea to write out a detailed explanation of how the new injuries have changed your life. If you can get the adjuster to bring the offer up, you may be able to avoid litigation which can get expensive.

      To determine if you are getting a good offer you need to think about several things. How much do you currently owe on your medical bills? Did the medical care providers take a lien on your personal injury case? If they did, you may be required to reimburse them from the settlement. If they didn't, you will have extra money that can go toward your pain and suffering and future needs. You may want to consult with a local attorney that will be able to tell you if you will owe the medical care providers. I would also want to know what your injuries were and where you treated. Was this a hospital bill or physical therapy? Unfortunately, there are too many questions I still would have for you to be able to give you an idea if you have a fair offer.       I'm from Las Vegas . My insurance took care of all my medical bills .I was covered up to 5000$ , and my bill is just only 4300 . The insurance of the guy that hit us ,offer me 5,850 , then the second offer was 6200 as of now . Again my question to you is , how much will I suppose to get base on this ?       Great to hear that you were able to resolve your claim. There are some fair insurance adjusters out there that will evaluate a claim and pay the injured party what it is worth.

      I just spent three days in the hospital with a soft tissue injury from a MVA. Hospital bill alone was over 66 thousand dollars. Glad I DID hire an attorney.

    Good after noon, My name is Diane I was in a car accident in 1-13-2017. I was a passenger. The attorney that has been handling the case is Lerner&Rowe .last time I talked to them settiemen went from a 100,000 down to 30,000. I told him I could not take that. He told me Then I should have gotten better increases. My increases paid my bills of 48,000. I cant work but 3 to 4 hrs I dont work I dont eat. IM over 60. I don't understand most of what is going on Iv been lied to for the most part. Can you help me at all. Now they will not take my call.

      It doesn't make sense that your settlement offer went down from 100k to 30k. I would suggest calling your attorney and requesting a face to face meeting where you can ask any questions that you have. Often, there is miscommunication when paralegals, legal assistants and others are all speaking with you about the case. If you are not satisfied by what you hear, another attorney can take over your case. You will want to request your file and present it to the new attorney that you are trying to hire.

    : ( i was in my second car within like 3 weeks... This time my car is pretty much destroyed.. some kid drove out into a busy main road in which i was driving on, and slammed straight into my car. I haven't had a crash like this since 2006.. I was a bit shaken up... I have the same attroney for both cases, and now I'm in therapy : (... I'm pretty much screwed... My back hurts all the time, and my shoulder now....UGHHH.. Both accidents i was not at fault thank goodness.

      The property damage in this situation should likely be covered under the insurance policy that the car dealership has. Your insurance should also be another policy to look at.

    hi my name is Blanca I had an accident on my way from work in the freeway the car hit me and I went spinning to the other side. officer said they didn't find any insurance on him or a license only a Mexican I.d he went to the hospital I didn't I was just shaky and in shock. the next day I went to the urgent care and got x-rays but haven't gotten the results yet. I do have some neck pain but not so much. my insurance called me back saying my car was a total loss and if I want to send it to total loss department I haven't had the chance to speak to him I will today. I was wondering if I should get a lawyer or will my insurance pay off my car I owe around 5,000ish and it's a 2009 ford Explorer xlt. and I don't know if I should g set a lawyer or see if my insurance covers my car thank you Corona CA

      Hi Blanca, It sounds like you are on the right track with working with your insurance company to see if they will fully compensate you for the value of the vehicle. Because your vehicle is a total loss, your insurance company should do a valuation report to estimate the value. Typically they will look at the sale value of similar 2009 Ford Explorers in your area and determine what they are selling for. They will then make an offer to you. This amount is negotiable, so if you don't feel like they have given you full value, you may then want to reach out to an attorney. Understand also that you may have a deductible to pay through your insurance company to get the vehicle replaced. Hopefully the value of the vehicle is more than the amount you owe on the vehicle.

      hi again thank you for replying soon I looked up how much a dealer sells a car like the one I had with around the same mileage and it was selling for 10,000 dollars. I call the adjuster today and she said I had two options 1 keep the car and they will give me 5,000 Ish 2 if they take my car they will give me 7,000 Ish I owe exactly 5,252 to the finance company. I feel like it's not enough for the value of my car. what do you think from the information they given me thank you again.

      Hi Blanca. You will not usually get the full retail value of the vehicle. You will get the amount that another person would be willing to pay you for the vehicle. This is often less than the Kelly Blue Book value. You could ask the adjuster for the valuation report to see what other vehicles they used to compare to yours. If you still think they are offering too little, you may want to reach out to an attorney who could try to pursue a higher amount for you.

      I was hit by a16yr. At the time I was having problems with my back. But it was under control with my doctor. Now I have shots in my back to help with pain, but only a little bit. Pain on left side with pain going down my leg. My car was totaled. I was paid for, but my medical bills will be taken out of my settlement. That is$5,000.lawyers get 30% of the settlement, that my lawyer said I might get only $7,000 that with medical and lawyers fees taken out. Life with nothing

      You may want to try to get the settlement value up in your case so that you have money left over for your pain and suffering. I would suggest, like I did with the last person, to sit down with your lawyer face to face and see why they are not able to get the value of your claim up. It may make sense to litigate the case.

    I recently got into a car accident. This young woman ran through a stop sign the cops showed up and she told them it was her fault. The cop asked only for my insurance name and give me the case number. Now I don't really know what to do next?

      Typically the police will give you an exchange sheet that will provide you with the contact information and insurance provider of the person who you were in the accident with. If you were not given this information, you will want to call the agency and get the police report number. You can just provide them with your name and accident location and time and they should be able to track it down for you. When you have this information, you may want to reach out to an attorney for a consultation.

      You will want to request the full policy information from the person who hit you. They should provide it to you so you can see who the named drivers were on the policy. If the grandson is not on it, you will want to try to find out if the grandson had a separate policy that may cover. I'd advise speaking to an attorney in the state in which the accident occurred if you need help.

      Any time surgery is needed, the value of your claim will go up significantly. There are a lot of variables, but you may want to get an estimate of how much the surgery will cost. You can assume, given there is sufficient insurance coverage and liability has been established that you will be reimbursed for the value of the surgery plus a significant amount of pain and suffering and any rehabilitation cost you have. You will want to reach out to a lawyer in the area where you were injured to get a grasp of the figures. The amount you actually recover will also depend on if you are using health insurance, the cost of the procedure, whether the insurance company agrees that the injury was related to the accident, whether there is enough money in the policy limits to cover the procedure, the recovery time and costs, the amount of pain and suffering you go through, and a number of other factors. As you can see, it is hard to give you numbers without really getting into the details. This is why its important to sit down with your lawyer to get the best estimates.

    Dude, I'm gettng sued for 300k for tapping some guy on a motorcycle, literally below 5mph. You guys are sleazebags, trying to leech money from hardworking individuals for nothing. His attorney claims he is suffering and is in pain, but luckily my insurance company found pictures of this dude in the Bar, Playing Basketball and riding around in his motorcycle still.. Unreal!

      You will want to first open a claim with the insurance company of the person that rear ended you. You may also have additional coverage with underinsured motorist coverage through your own policy and possibly other coverage for your medical bills. You will also need to see if the dealership has additional insurance coverage that applies when you test drive a car. It may be a good idea to speak with an attorney in your state to see if any local rules apply.
