A car accident caused by someone else is terrible. The injury is an issue, but there are other inconveniences and that are just as traumatic. My accident changed my entire Summer. Everything should be factored in, including trauma, interrupted life, etc. I have not been the same ever since that accident even after going to therapy.
I was in an accident I'm Maine, I am an out of stater gave the insurance company a detailed spreadsheet listing my time spent on this claim. Some of the listing my time on emails, phone calls, travel back to the state to clear out the vehicle, insurance I paid while my car was disabled...btw the totaled the vehicle 6 weeks after the accident would I be able recover my time, labor, travel fuel..etc...
Hi sorry for the delay responding. What's happened since you posted this? You can try and recover for time etc. May be tough to get them to bite though. What has their response been?
I was in a car accident and suffered broken ribs and was determined to be not at fault. My medical bills only totaled $1,200 but my lost wages from having to refrain from a very physical job while I healed were 39K . Does pain and suffering a reflection total economic damages or only medical losses.
@@LawFull to clarify, I am trying to determine how much to ask for pain and suffering . And wasn’t sure if I’m going off of just medical bills or (medical bills and lost wages) I did have quite a lot of pain and was So limited in my activity for 2 months.
@@jilllittle3065 I see. Well, I would not include your lost wages as part of your pain and suffering. But how much you should ask for, that is impossible for me to know. It depends on where you are, your meds, your diagnosis, permanency of injury and other factors. I'm sorry I can't be more specific on this one. It's a hard question to answer.
Hi Ken, when you say stacking what are you referring to? Because when I use the word stacking I'm referring to taking your own under insured motorist policy and putting it on top of the policy of the defendant so that you can maximize your recovery.

I’m 22 and been doing injections and physical therapy for 7 months now they are saying surgery is the next step I hope there is something else they can do
My daughters were involved in a rear end collision in Indiana they’re both minors. I took them to emergency room the next day and they did X-ray but no broken bones. The doctor said my oldest daughter had muscle spasms in lower back and my other daughter had neck sprain and strains. I followed up with their primary care doctor and they determined my oldest daughter had low back muscle spasms and my other daughter had cervical spasms and had a minor concussion. I took them to a chiropractor and they did X-ray and determined my oldest daughter had 2 tears in her vertebrae in her back and her spine was out of adjustment and my other daughter has tear in her muscles in her neck. They’re seeing a chiropractor 3 times a week. What would be a decent number for pain and suffering?
Hi, I really couldn't say with just this info. Also, value of cases is reallly a very local issue. You'd be better served speaking with a local attorney to get info like this. I'm sorry I can't be more help on this one but a local person would be a much better resource.
Hello. A friend of mine was in a car wreck and she had no damage to her car. She waited two and a half months after her car wreck to seek medical treatment for the car wreck. Can she still sue for pain and suffering?
I’m currently in the middle of a claim, progressive (fault party) called the day after the accident to offer $950 foot pain and suffering. We were both like “we don’t even know what injuries and pain will be experienced” so I’m trying to research what’s reasonable. Our car, which was paid off, is totaled and we have to buy another vehicle, so I’m trying to find out if that’s something to factor in on trying to get more than a measly 950.
Typical insurance company tactic - quick money up front. But regardless, you'll still get lowballed. Watch my video on why insurance companies low ball EVERYONE. If you have a real injury, I would strongly recommend us getting on the phone and talking about this. I'm an open book and happy to help. hello , i when to the doctor and took a couple of xrays, and give me a week supply of antibiotics and some pain and muscle pills, so i received a call from the car insurance and offered a $1000 dls for pain and suffering. is that the right amount? i still have to go back and get therapy for my shoulder. for unknown time. so should i accept that offer?
Question. I had a accident and I can no longer drive for Uber and make extra money because my back hurts when I drive and my vision is blurred. Can I get compensated for part time Uber gig?
Hi, you can definitely try... I would at least. I would consult with a local attorney about this if I were you. The laws in your state may dictate what you can and cannot recover for.
Hello, thank you for this video it is very insightful. I have one question, Can insurance agents legally withhold money for bills paid by Medicaid related to the accident, even without them having any claim or lien from Medicaid? I thought it was my duty to notify and repay medicaid after the settlement is completed.
Hi, to be honest I've never had a sitaution like that. You sure they haven't been put on notice by Medicaid. Also, sounds like this may be a state law situation where they may have an obligation to withhold etc etc. But I'm just speculating again as I've never seen this situation before....
Mine was totaled. Lost my job due to pain because I had back surgery before the accident. I had healed up and the accident fired everything back up. Over a year later and they make a low offer. The guy pulled out in front of me. The. He lied. They put me through hell.
Hi. Two things here: your case and your health. I always tell people to focus on your health and don't worry about your case per se. If you've got something wrong with your wrist, that would be my priority. If you know what I mean.

What’s the difference between chronic pain from an injury and permanent injury? Same? How can I get paid to go to the chiropractor regularly due to chronic pain?
Hi, when I say permanent injury I mean someone walking with a limp. True chronic pain like in your back theoretically could be permanent I guess. But how to get an insurance company to pay for indefinite number of chiro treatments - you got me. I am very skeptical that anything close to that would ever happen.
@@LawFull okay, I understand now. Yes, I have chronic pain that’s been present since my car accident in March. Is it fair for a person like me with chronic pain from back injury and bad headaches to get more pain and suffering compared to someone who had back injury that’s no longer in pain?

Punitive damages can be recovered in cases where the driver’s negligence is deemed “gross negligence”
