      @@FourthDimensionalHillBilly No camera can fit on an officer that is small enough to be viable that can last 16 hours of non stop recording without dying. Battery technology is not there yet. Even the best ones out there can barely go for 12 hours.
      Plus, what about privacy concerns? Using the bathroom? Personal conversations? Wiretapping laws? Assault victim statements? Confidential informants?

      Should be right? But it's not. They can claim qualified immunity. Which should be removed from city state and government. All the way up too the president and all surrounding fda, doctors, pharmacist, all who are allowed this privilege.

      Qualified immunity wouldnt mean its not a civil rights violation. All that means is the officer cant be sued personally unless there is similar established case law, which there is. Even if granted qualified immunity, he could still sue the department and city for civil rights violations, which has a larger payout anyway.

      Had they asked to search the car off the get go and he denied; cops can have a k9 come while the stop is still carried on. The charges that were nolle prosequi were some good drug charges and a carrying concealed weapon. That would explain his refusal for the search. They only found these things from what's called fruit of the poisonous tree. I'm a LEO and if i come in contact with you and I use my training and see that a k9 is needed I call then. Not after the stop is over and violate your rights by holding you longer than it would take for me to conduct my initial investigation ie citation or warning

      That's right! According to SCOTUS an officer may only detain you on a traffic stop for the amount of time it takes to issue a citation! A vehicle search would be longer and therefore ILLEGAL!!!

      It's not supposed to be, however most courts side with the cop. While I was being beaten by police, after not breaking any law, or even being suspected of breaking a law. The fact that I put my arms in front in front of my face in an attempt to deflect the punches to my face, was resisting arrest. I didn't resist anything, I was complying, however after they started punching me in the face, I tried to deflect the blows. What was never answered for me at the time of my conviction was, how did I resist arrest if they had nothing to arrest me for?

      @Veedo Capone Naturalized US citizen and 18 year LEO in Texas, once the warning was given then the traffic stop is done, now if they wanted to search the vehicle they could ask for consent, or they could arrest the driver for the traffic violation and do an inventory of the vehicle for a tow and what ever you find during the inventory of the vehicle is good to go, now they could call for a K9 if the K9 sits then is PC, but this 2 idiots messed up big.

      This judge would have given those officers a pat on the back for getting a law abiding citizen off the streets had there not been a video. And then the judge gives the officers who violated this mans rights get a slap on the wrist. These judges are just as much of a problem as the police are. Their refusal to hold police accountable leads to all the law breaking and harassment that cops do to us.

    In our country, the Netherlands, we see very few police officers, only when there are problems. But I was stopped on a completely empty highway where 120 km is allowed and I drove 160 km on Sunday morning at 700 am. We talked and the nice cop gave me a lesson instead of a ticket. I was very impressed. The nice cop said; now I wish you a safe return home.
    Say hello from me to your husband and your 2 small children. I replied Thank you. And now after 40 years I have never forgotten that lesson.

    I just had a second incident with Daytona PD where WE called them to report something. Both non petty things. Horrible experience both times and the second one honestly and sadly changed the way I feel about police. They even had my wife in tears because of how they were talking to us. Pretty taxing having someone talking to you like you're a complete piece of s**t and telling you to shut up and you will go to jail if you simply question them. Be silent and bow to the gods.🙄

      Hold on! Where was this judge when a man was sitting in jail for a year? Why didn't he do that on his first appearance? There is other things involved. They realize they could not send him to jail because it would be in violation of his constitutional rights which would attract severe reprimand from the feds! I believe the judge was protecting is paycheck more than anything else.

      Agreed. Courts have ruled numerous times that there is no such thing as a small injury when someone is deprived of their Constitutional rights even momentarily. Everything that followed is on their heads. "No, you can't search" is the END of the discussion; not a pretext to yank someone out of the car and search anyway.

    I commend the judge that upheld this man's constitutional rights. We need more judges that actually obey the law in the same manner. Both the cops should have been criminally charged, not reprimanded. That part is disgusting and just proves the wide spread and endemic corruption present in our law enforcement agencies in this country.

      The only criticism I have for the judge is not calling out the DA for pursuing the charges for 1 year instead of dropping the charges. The man languished in jail with no bond when the DA saw the body camera and knew he didn't do anything wrong. And then when the judge point blank said the guy did nothing wrong and the cops did something ILLEGAL I don't see any charges against the cops from the DA.

      @@ariefraiser140 you are correct. I somehow failed to realize that part and the reality is that it's probably the biggest scandal of all. The collusion between law enforcement and the prosecutorial team and the mutual attempts at cover up between them. Unfortunately I failed to recognize the same situation exists between prosecutors and judges. How rare it is to hear about either one holding the other accountable. Tbh why would they? They both are employed and funded by the state and the unfortunately reality is they both have 0% oversight and are 100% protected against the citizens holding them accountable. How can we expect justice when there is no way to secure punishment for corrupt officials?

    Jarvis twice stated no when they asked for consent to search his vehicle. After the first request police “KNOW” that in order to search a vehicle with consent a warrant would be necessary. At no time did either officer state they had a reason to search, probable cause meaning they did not see anything illegally in plain view. It is refreshing to see a Judge act in the manner she did.

    The punishment for "illegal activity" depends on what costume you're wearing. If you're a peon and do nothing wrong you get a year in jail. If you're wearing a costume they don't even slap your wrist

    Years ago I got pulled over in Daytona driving a rental car while I was there for a work convention I even showed the convention pass. The officers said it matched the description of a stolen vehicle.
    I showed the rental agreement and my Ontario driver's license.
    They demanded to search the vehicle. I assured them that I don't have a gun and i have never done drugs.
    They told me because I was Canadian they have a right to search anything they wanted.

      The constitution applies and protects anyone legally in the United States. Plus a bunch of miscellaneous acts and such as a Canadian. Including the 1949 Geneva convention, which includes drivers license validity between countries so an international drivers license is not required

    This is exactly why we have to get rid of qualified immunity and replace it with professional malpractice insurance paid by each LEO. The insurance company will drop them if they have too many payouts for violating rights and or not adhering to SOP's. Every person with a car MUST have auto insurance, Doctors will not practice medicine without it.

      I've been saying almost this exact same thing for YEARS. Abolish qualified immunity, make LEOS be bonded and insured, but the insurance has to be paid from their own pocket. If they cost insurers too much in settlements (whether it's lots of little settlements, or one or two big ones), eventually they will be uninsurable & can no longer work as LEO. The problem solves itself.

    As soon as the officer gave the driver the written warning and handed back his paperwork, the traffic stop is over. The cops then asked him if they could search his vehicle. the driver is no long detained, and does not have to give consent. Criminal cops, which is going to cost the taxpayers a lot of money.

They were introduced voluntarily in 2005 and most (80%) of the highly funded PDs covering metropolitan areas adopted them. In the 7 states where it is mandated, there was no resistance. In some places budget is still an issue, but they are slowly getting the funding approved by the city/county/state, because it leaves a window open for a lawyer to get a case thrown out.

    Officers also found heroin and knives in his car, so Jarvis was also charged with trafficking in a controlled substance (heroin/fentanyl), possession of THC oil, resisting arrest with violence, possession of drug paraphernalia and unlicensed carrying of concealed weapons.

    I've seen a lot of these videos and the driver starts arguing and eventually turns into a use of force because they were resisting.
    This guy was professional, respectful, and conducted himself well until they violated his 4th Amendment rights, wanting to search his vehicle without probable cause or consent.
    I'm glad the judge dropped all charges and I hope he wins his settlement.
    I know there are bad apples in every profession but the majority of cops are good. Just my thoughts.

    Volusia County must be a very slow town where police have time for all this and give a warning ticket. But then escalate by asking to search the car for no reason, and then when there commands are not meet. Something wrong with there hiring process. The officers do not have common sense. Sue them big time.

    If the officers asked to search the vehicle prior to telling him he was getting a warning there may have been some merit to those charges. But they needed reasonable suspicious he had something in his vehicle. I hope this man never has to work and gets a huge settlement and these officers has to pay out of their own pockets. Further more they should be facing jail time as well

    Once the ticket is handed to a driver the stop is over they MUST let you go. They Can't call a drug or do anything else to impede the driver. This well established law. These cops are criminals. They should spend at least as much time in jail as he did.

    I love the way the judge handled this case... More judges prosecutors police officers should take a lesson from this judge...     I remember the days when you rolled thru a stop sign or got caught a few mph over the speed limit, you pulled over, handed over your credentials. Got your citation and went on your way. Now its become a get out of the car, searched, detained or any other thing they can try and get revenue from you. Tickets are no longer the reason for the stop. Unless you are an illegal immigrant, no license, no insurance, then they just let you go to become the next county or cities problem.

    I hope he sues to have that arrest record expunged otherwise every time a cop runs his plates he will see the charges and never see the dismissal by the Judge. He will be presumed dangerous by every cop out there.

    "We don't know..." is not grounds for a search. The phrases, "We don't know", and "We got a phone call" are not grounds for suspension of the Constitution.
