    I was going for a walk one night. I was wearing a reflective vest and carrying a flashlight. A cop stopped me and asked me what I was doing. " I'm going for a walk." He acted like I was acting suspicious. Yes, if I am up to no good, I'm going to be carrying a flash light and a reflective vest so I can attract as much attention to myself while I'm acting suspicious.

      Wouldn't that actually give police enough to lawfully detain someone? If somebody runs up to the police and tells them you just sexually assaulted them the police would be able to detain you wouldn't they? So if that is true then any crime someone else alleges you committed would be enough for police to detain you right?

      I have been arrested 6 times because of a restraining order they had video of me doing the exact opposite and I was charged with driving by my ex's house which is 2 blocks over I didnt get arrested for the "driving on her moms" road not hers not the one on paper it was said I made eye contact also was told I waved I would have definitely given another signal I see woman battered and abused I've never touched a woman nor would I ever and as soon as judge found out she is using it as a sword instead of shield.. finally judge got what is going on now i have full custody but only because 1 good public servant negated all of the other officers and let's just say she was crying after judge freaked on her sorry guys for the rant but something's i need off my chest

      @Michael Crouch I'm not 100% sure you're correct that they are LEGALLY required to identify themselves. They might be, but from everything i'm reading, it seems more like each police department gets to decide on specific policy. Also, in a # of jurisdictions, they don't even have to tell you why they stopped you until arraignment.

    One opportunity auditors miss: When a police officer says "we're detaining you for suspicion because someone reported you [blah blah blah]" the auditor needs to point out that the officer is required by the 14th Amendment to give the auditor equal protection. Assuming the auditor is guilty because another person said so, without probable cause to conclude that they are likely to have committed a crime, is therefore a 14th Amendment violation.

      Any where outside the wall even on the grass can be accessed by the public. The guy has the right of way to walk up to that gate just not threw the gate unless cleared to do so. This camera man could have even climbed the wall and looked over but not gone over. Anywhere up to that wall or fence between the side walk and fence can be accessed by the public.

    The burden of proof is on the accuser always. The blue line thugs should have never talked to you until they confirmed the caller statement. The one officer was fishing for anything that he could arrest or cite you for. Be safe.

      if you're working and someone suddenly comes up with a camera live streaming you, I bet you are going to act a little different and be especially careful you are doing everything exactly right. That's what people do bud, they get more careful when they know they are being watched, especially if they are being recorded. That's literally the reason so many areas around the world are creating cctv networks and putting cameras everywhere... b/c it's human nature to behave better when you know you are being observed, that's why the majority of serial killers choose poverty stricken areas to pick their victims(that's why prostitutes are the majority of their victims) less chance of being observed and noticed. That's why when people go into stores to petty theft the first thing they do is look around to see where the cameras are and then avoid them. I can go on and on but you get the point.

      Yeah, this exactly. The burden of proof lies with the facility staff, and it was immediately clear that they did not have any substantial evidence to back up their claim. We supposedly don't assume guilt in this country, but a majority of this video shows quite the opposite.

      It sounds like the pigs fabricated the claim that he was on the fence.. that's why I said FOIA the call. If they said he was "at their gate" and then the pigs changed the story for a reason for detainment. Cops bend the law to enforce their will. This is sad. All of these cops knew the entire time that he never went on their fence/gate.

      She didn't need to go for one or the other, for all you know the miscommunication occurred between two or more people at the plant, e.g. one worker reported something to someone else, and that person made the call to the police. That's why police officers conduct investigations after receiving reports, to ascertain the truth. I'm sure you expect to be given the benefit of the doubt, yet here you want the police to immediately assume there was a criminal conspiracy among the plant workers, when there's likely no evidence to suggest that it was anything other than a simple mistake.

There so- called trespassing was heresay in other words they lied to make up a charge so bad enough to answer the call. If they said the photographer was just on the side walk then the company might think the police wouldn’t come. So they lie about trespassing so the cops would have to respond to the call. In essence this was intentional false report made. And that alone can be a charge in itself against the company. It’s either the company’s wrong or they dispatcher got it wrong, possible more training to get it right, not causing a waste of resources. And wasting the Auditors time...Stupid POC Officers.

I don't know the trespass statute in AZ but even if you were trespassing at one point you had already vacated the property, therefore there is no crime they could even site you for, most places you can only be criminally trespassed if you refuse to leave after given an opportunity to do so! 💯 you did amazing! They had absolutely no grounds for anything beyond consensual contact!

If you just hop the fence but don't enter a dwelling (again depending on the place and statutes and how they are worded) then it is still only trespassing, I take it you don't know much about law and how it works.....but please instead of just making a statement without providing evidence for your claim, do tell what other crimes it would be and I will explain why or why they wouldn't fit.....

    Wait a minute let's roll the tape back. 13:02 The cop said he is LAWFULLY detained because the complainant said he had trespassed, without any proof and just hearsay. But even if he was on the property at any point he would still have to be given a warning to leave and then a reasonable time to leave, none of which was even discussed by the investigating officers that they had asked that very important question to the complainant. Trespass is only a valid crime if you were asked to leave and didn't. No crime so not a lawful detention or a reason to ID.

Still I think that their very first steps should have been to talk to the complainant on the phone and ask if they asked him to leave, where he was, do they have video proof, etc., before they arrived and detained him.       I don't think you understand what hearsay is. If a person calls the police and says they witnessed this man on the fence...that is not hearsay. That is an eyewitness, which can be used in a court of law.

      Actually that would be considered a false statement. Would be subject to criminalize penalties for false information to a 911 dispatcher. Because the eyewitness you're talking about was unwilling to sign on the dotted line. For his false statement I don't think you know what you're talkin about. If the eyewitness is unwilling to sign on the dotted line it's nothing more than hearsay which is inadmissible in a court of law.

      @Squeek Tate You see it as harassment, but I have had many conversations with officers that I have walked up to while carrying my Glock and guess what? if you don't shout insults at them they leave you alone because they now know you are not the threat... when you start coming at them looking to cause an argument damn right they have to cover their asses and find out who the idiots are that just started arguing for no reason! I have had over a dozen encounters/pulled over/etc this year alone with police and not a single ticket (they don't even take my firearm from my hip!)... Respect! give to get! (can't assume everyone is bad or they will do the same to you!)

      It might be legal but come on now when someone is standing around for 1 1/2 hours taking a video of a water treatment facility and taking videos of people coming and going, ya people are gonna start asking questions, you look extremely suspicious and a water treatment facility is vital to millions of residents in the area, if nobody investigated this guy and something actually happened you same people would be all over the cops for "not doing anything to prevent this". Hell he even could have been a disgruntled ex employee who fired 6 months ago and he was waiting for his old boss at the gates to confront with a weapon. Again you same people would be all over the police for not investigating someone standing around at the exit of the facility on a hot day in the desert for 1.5 hours. Police can't win with some of you no matter what they do and you KNOW it's true. Look for any little thing to complain about.
