    What I hate most about Robert in this is that even if this wasnt valid as a will, he still had the power to include Mary and make her heir. He still had the power to respect Mathew' s last wishes, but he was too power hungry. Glad Mary had Carson for a supportive father figure

    Robert had the benefit of Cora's and Mathew's money but didn't want them to have a say in the running of the place. Without Mathew and Tom, and later on, Mary, he would have taken it down the same path as when he lost all the money and needed Mathew to bail him out.

    • @SnowdropWood
      @SnowdropWood 5 лет назад +73

      Yup. And even after he lost Cora's fortune, he was still banging on about how knowledgeable he was about investments and business. Same thing with the poker game, total confidence, telling everyone he was a dab hand at poker, even after he got thrashed by the card sharp! I suppose being raised the way he was, told he was an empire builder and master of the universe at every turn, it was almost impossible for him to conceive that he was inept at anything, even when he was genuinely sorry for the consequences.

    As if Robert’s stunning business acumen wasn’t the reason Matthew had to bail him out and become co-owner of the estate in the first place. Furthermore, it is entirely his fault Mary doesn’t know anything about the running of it. Even though she was meant to marry the heir (either Patrick or Matthew) he didn’t feel it was worthwhile to teach her anything about it, despite there being a chance of exactly what happened- young widowhood. He’s absolutely insufferable at times.

    I think she at first she has her personal reasons for hoping the letter is invalid, which prompts her dinner statement. This is why Mary is surprised at Lady Violet's apparent shift in position. However, what no one seems to credit is the Dowager's ability to rapidly adjust to a situation. As she says elsewhere, she is a good sailor.
    Further, she knows that her son has a point, though Mary has missed it in the emotion of the moment, which is that she knows little to nothing of what it means to run the estate. So believing that Mary has the right of primogeniture, she arranges for her to rapidly gain the education that will be necessary, especially as it does appear that she wishes she herself had known more, though now she is quite content to let others be stressed about such things.

      It does make one wonder how she (Violet)had such insight into specific personality peculiarities in both of her children, evidenced in future episodes and crises where she dispenses deep insights into both their character strengths and weaknesses further on in the series...:)

She was there for Edith with Marigold and when her fiance walked out on her, she was there for Mary when the Pamuk scandle happened(carried a dead body!) and she stood up for Mary at the dinner, and she went beyond the call of duty for Sybil, so much so I can't list them all. One of the things that always bugged me about this story line is that Matthew's claim to the Estate was only ever as an heir. He did not legally own the Estate, as far as I ever saw. Sure, Lord Grantham said he was half owner, but there was probably never a recorded transfer, because that risks breaking up the Estate. So, when Matthew died, he had nothing to pass legally as heir to anyone. Dead heirs got nothing in life, and can pass nothing. Upon Matthew's death, George the baby is the heir, through Matthew not Mary, of the Lord. Now, the term heir may be wrong, as in the U.S. an heir gets when there is no will, not when there is one. If there is a will, the term I have heard is legatee, not heir. So, legally, I do not think Matthew could will that which he did not own, the Estate, and George could be his heir, but that does not matter, for the passing of the Estate, it only matters who the Lord's heir is at the time of the Lord's death.

    • @MandieTerrier
      @MandieTerrier 3 года назад +2

      You are correct. Matthew couldn't pass on the title. He could leave Mary the money he inherited through Reggie Swire.

    • @Mary-wt7fk
      @Mary-wt7fk 2 года назад +7

      With Swire’s money, Matthew bought a share for 50% ownership of the estate. So then Robert owned half and Matthew owned half. With that ownership, Matthew was free to do whatever he liked with his share: sell it it, leave it to someone, etc. Then Matthew died and left his 50% to Mary, so then Mary owned half and Robert owned half. If he had not left his share to Mary, then it would have passed directly to George and so George would have owned half and Robert would have owned half

    • @danmc7815
      @danmc7815 2 года назад +1

      @@Mary-wt7fk The thing is there is a big inconsistency in the series. The series begins with the death of heirs on the Titanic, AND the drama is about what will happen to Downton and Mary. Robert will not fight the entail. The entail has tied up the estate with all of its money so that is goes to the heir of Robert. The heir cannot be denied and gets this, and Robert cannot give it away by a Will or otherwise. He can give some money away, and he can sell some land of the estate. But, the whole of Downton and its money go to the heir, whoever that is when Robert dies. Matthew is until his death the presumptive heir, and then George becomes it. Until a person dies, that person does not have an heir. But, Robert cannot will the estate to Mary, and that is the drama.
      So, how can Matthew will it? It is the same estate. How can one man will it, but not the other?

While I have done legal research, not much of it was English law and not much was on such property rights. Further arguing without the research is kind of pointless. So, good luck. Hopefully, we all enjoy the new movie.

Had George inherited directly the family would have saved thousands and Mary as his mother would have had a say and controlled his interests for 21 years until George became of age. Always practical not emotional - the same outcome in effect for less cost.
