Carolyn never told Rusty about her son. That was a surprise to Rusty to find out she had a teenage son after her death.

Crazy theory: I believe it was the ME. A main theme of the show is corruption in the criminal justice system - concealing evidence, witness tampering, immoral prosecutors - and the character who detests this the most is him. Both the corruption itself and the prosecutors who treat him poorly.
Carolyn, a woman who will stop at nothing to advance her career, might’ve taken advantage of him. I suspect she formed a relationship with him and made him feel like he wasn’t an outcast in the office so she could manipulate lab results, close cases rapidly, and subsequently get promoted…he could’ve been the other unidentified sample found on her and the man she feared at work.
An example of this would be that she concealed evidence in the Bunny Davis case, likely to close it with Liam Reynolds and advance her career. At this point, the ME might’ve realized he was being used and sought to send a message to the office and system…
Bunny Davis and Carolyn were murdered quite similarly on the same day of different years. If it was the ME, he not only exacted poetic revenge on a lover who used him, but exposed the office’s corruption by framing Rusty. You can even see him enjoying the chaos in court! Everyone who tormented him and violated his values at work are shown as “bad apples” in the public’s eye.
He killed Carolyn, got Raymond out of office, destroyed Rusty’s reputation, and then left the murder weapon with a note - written much in the voice of the ME - in Tommy’s house to get back at him too. Further, the ME knows all of the details of the Bunny Davis case, how to clean a crime scene, and “snaps” in a calculated manner. Remember when it was said he was a horrible person to testify in court? Perhaps he solves his vendettas on the stand and Carolyn’s betrayal radicalized him.
This is probably totally off, but I thought it was worth throwing that theory out there.

hey guys! here's my theory on the fire poker ( i haven't read through the comments, so apologies if someone else already shared the same theory) : i think whoever trashed tommy's place found it there, they knew he had it and that it had the DNA of the real killer (not rusty), and tommy hid it so that he could frame rusty out of jealousy, competition, etc. i think the note on the weapon is another way of saying 'you're not as smart as you think you are!'
tommy may not have killed her, but i think he was in on it (maybe even after the fact) just to see rusty go down. however, somehow he pissed off the real killer and the home invasion and leaving the fire poker out in plain sigh is their response.

Am I the only one who realised the only time the murder weapon was specified other than when the forensic expert referred to it as a thin blunt metal object was when Tommy announced it when cross examining Rusty, The actual weapon used was never specified or found????

@@Kitohru Rusty appeared stunned by Tommy’s cross exam, “Did you kill her with the poker?”, but this may have snapped Rusty out of his death spiral and launched him into full-attack mode, off the treadmill and into Tommy’s house. Curious what Rusty found. Tommy’s case strategy notes to himself like a diary?

That ending shot sets up the finale perfectly.

Go rewatch it knowing the ending and none of it makes any sense. Jake spent 7 episodes chasing down the "killer" when he knew all along who it was (in his mind).
It was Rustys son who did it. And Rusty and Barbara are trying to protect him. Rusty tied up the body afterwards and wanted to pin it on Bunny's murderer and sweep it under the rug.
But then the photo of his son at the scene came out and everything chnaged. There are many hints: when his wife if cleaning the bike, rusty says "i dont think he's a SUSPECT" (not i dont think he did it). His son asking him, "why dont you take manslaughter, 8 years" and Rusty cries in consideration to protect his son. The first episode shows the son throwing "curve balls" (hint!). Barbara washing the bike, Rusty asks his wife, "why do you stay" and she says, "the same reason you do". Rusty yells at Barbara and say, "at some point you need to take responsibility for this!". Rusty interrogates his son to see how he would react on the witness stand. The whole show is about a family trying to protect their son. The rest is ALL a red herring. Knowing this, when watching all the family scenes, it makes sence if you know Rusty and Barbara are just trying to protect their son. Rustys brilliance is he's using tommy's hatred to get his focus away from his son and onto Rusty!

I understand your “interrogation” reading, but the scenes leading up to it suggest Rusty being surprised.
Or perhaps was he was surprised/frustrated there was a witness to tie Kyle on the night of. Hmm…

I like the Eugenia angle. She’s under the radar just enough to be a good call for the showrunners. However, I like to think they’re smarter than that & will deliver a multi-party twist next week (one killer, another tie-er up person. Fully planned and will make sense based on callbacks from episodes 1-3) - also I have no real idea 😂

I’m thinking Eugenia did it. I believe she was having a fling with Carolyn and became upset that Carolyn was more into Rusty.
I think that whole exchange with Rusty was a reaction to realizing Carolyn have been a drug, and Rusty may have been obsessed…but killing Carolyn didn’t keep him from desiring her, or loving her. I mean, you kill your crushes mistress in an effort to 1) try and get some attention in the office (Carolyn WAS Rusty’s #2, AND mistress) and 2) to protect your crush…only for them to continue to pine after their relationship??? How disappointing lol. That whole conversation seemed less about accusing Rusty than trying to comprehend why he was so in love with Carolyn (“Did I get it all wrong?”). Carolyn wasn’t forcing Rusty to cheat, or to shit where he eats, and now that she’s dead it’s very clear he was and still is in love and obsessed with her. Lol I’d be pissed if I committed murder for nothing too, Eugenia!

I thought it was interesting he mentioned the rope from the cat tower… in the first episode I believe, the forensics mentioned carpet fibers being found on Carolyn’s body, in the color Scottish malt. I’ve been trying to find something of that description in the episodes. Perhaps from the cat tower!??
After last night my new theory is that Tommy and the Hr lady are in on ot together. That first interaction with them felt weird. What if she called him an A-hole because he knew they both were in on it and she wasn't expecting him to put her up there. She was in love with rusty and Tommy was obsessed with Carolyn. They both had reasons to put it on Rusty. When the fire poker shows up, that note sounded like the hr lady!

I like wild ideas, so here are a few of em…
1) Michael seems like he was coached on the stand. He kept repeating himself; just a feeling.
2) Raymond’s wife is HELLA involved in the goings on of this case. I get that she and Barbara are “friends” but even so.
3) the fire poker in Tommy’s apartment is the first blatant evidence we’ve seen, which makes me think it might end up being a total nothing burger - just one more thing to throw us off.
Seriously, this series has made me rethink everything I thought I knew about drama series and I LOVE IT.

#3: the poker: nobody knows but I think you’re right about it being a nothing burger. UNLESS Tommy is involved and knows it’s a frustrated co-conspirator. But my gut says no, because Tommy is a little too obvious during the course of the series, given that he is a grade-A jerk etc
What if Barbara or his son killed Carolyn and Rusty witnessed it, then set it up to look like the previous murder to protect his family?
The writers are definitely baseball fans, we’ve seen nothing but curveballs. Rusty strikes out on the stand but doesn’t snap; Raymond shuts his eyes fearing defeat; Tommy is pitching a perfect game except Rusty gets one more at bat. So he pops a few pills, sends Tommy a GFY-poker message (you have no evidence but I do) and he’ll take his best swing in the final inning.

My first guess was that Barbara was involved. I just don’t see why she would stay with him after all this.
17:59 I don’t think Rusty wrote the texts. The texts felt more important to Barbara as the most damaging part of the case. Which seems like she wrote them. But I still feel like one Rusty’s kids and Barbara were involved.
The only one that could have placed the poker was Raymond when he got out the hospital. Or maybe the other lawyer lady. But Eugenia is a great angle that none of us would have thought could kill Carolyn. Great hide by the writers

Yeah she seems close enough to the scene to throw shade at Tommy PLUS it’s the same night due to the rain. She left Rusty’s car & went to Tommy’s to cause a stir in Carolyn & Rustie’s defense… BUT she had just speculated that Rusty knew about the baby… conundrum

I think the ex-husband and son did it. They left the poker because they had a deal with Tommy to cover this up. They are anger that son took stand. That is why the "F" you note.

Considering the symbolism of the Bollo tie: Tommy wore the Bollo at Carolyn’s first win, that’s when he fell in love with her. Recall, she dodged his kiss at the tie-cutting ceremony probably the first of many rejections that ate at him. Tommy denied to Delay that he hates Rusty but putting Carolyn’s lover in jail is his vengeance for having been spurned. Ripping Carolyn’s victory-tie off the 1st-trial-win corkboard and emphatically grabbing his victory Bolo is Tommy’s home-run trot, his way of ridding himself from her hold on, Himself, the great Tommy Molto.
The scene with Tommy on the subway was a flashback it wasn’t him on his way home from court after the “snap” trial speech. He’s wearing a regular tie on the subway and not the bolo, which he wore in court and when he got home to the find the fire poker. So why put that scene THERE? Why take Carolyn’s win/tie earlier in the episode? Smells like a clue to me…

I feel like it’s Raymond. I think you found out that Rusty was bonking Carolyn and got jealous because he was too.
So at first I thought that Carolyn's weird son did it because poor me mommy doesn't want me kinda thing. But now I'm looking closely at Eugenia. So maybe Eugenia has been with the firm for quite awhile, way before Carolyn and at some point Rusty and her had a thing perhaps just sexual. (Rusty is such an egotistical dog lol) Then fabulous Carolyn comes along with her kick ass lawyer self, also easy on the eyes and Rusty falls hard for her and totally ignores Eugenia. I mean I'm sure for Rusty Eugenia was just a smash and dash and it was over long ago but Eugenia just can't stand it. After all, her morals and values went out the window when she got with him in the first place. So she wanted Carolyn out of the way because maybe, just maybe Rusty will see the light and go back with her. Delusional=crime of passion. Ok This mystery has me focused on theories like Rusty Sabich jacked up on Ritalin!
I've had numerous theories but I go back and I find some evidence to debunk it.
My final theory is Luke and Carolyns kid did it.
We know her kid used to watch her on different occasions. His attitude changed drastically when Rusty interrogated him and became quite defensive.
When Rusty interrogated Luke about the bike he tells Rusty he wants to talk to his mom. We then learn that he had rode past her house a couple times.
The one thing that bugs me about that is why would Carolyns kid show Tommy picture of Luke driving by on his bike. Unless he wanted to screw them all.
As for Tommy I think he just blinded by jealously and can't see anyone else

Hmm, for the first time, my suspect changed. Is it Raymond? Was that the poker in his Tommy's house? I mean, the man didn't really have an heart attack per se. It seems like on last episode, he realized he still has the poker, and pulls that off. LoL, Im laughing at how that sounds crazy. Also, I feel like we overlooking someone.
Interesting that they called out Ritalin and made a big deal of it - I believe Ritalin sometimes can activate psychotic symptoms in schizophrenics.
I really hope rusty didn’t do it & he’s not schizophrenic after all lol I just can’t think of any other reason why they’d bring up the Ritalin piece so much.

Retracing Rusty’s character at E7, he has definitely displayed dual personality behaviors. His use of Rigo to find exculpatory evidence, sane. His use of Rigo to strong arm Reynolds in prison, insane. His visit to Ratzer w/Rigo was sane. His creeping around Ratzer’s house, insane. Defending Jaden from a pissed off Ratzer, sane. Beating Ratzer to a pulp, insane. He lives happily with his wife and kids, sane. He wants to live the rest of his life with his true love Carolyn, insane. He’s kind and gentle, sane. He manhandles his wife, insane. He insists on his presumption of innocence, sane. But in his darkest hour, he refuses a manslaughter plea and a mistrial, insane. He shaves two versions of himself in the mirror; he takes on a full prosecutorial team solo; floats out-of-body in the courtroom; manhandles the ME; kicks his ally Eugenia out of his car into the rain. Rusty spirals in and out of reality and Barbara keeps him medicated and sane. But did the duality of the Bunny Davis murder trial w/Carolyn twist his mind irretrievably into insanity? I’ve given Rusty a presumption of sanity which I don’t think he deserves.

Doesn’t Apple have an agreement with the film and tv industry that the villain can’t use Apple products? If so, Tommy uses an Acer Laptop. We see Apple products throughout Rusty’s house. I also think Michael has an Android.
Maybe Michael did it, Tommy shows up (to drop in on his crush Carolyn-unwanted but also maybe for “work” or using that as an excuse) and tries to help him cover it up because he relates to being rebuffed and ignored by Carolyn? Tommy and Michael tell michaels dad, and Tommy comes up with the plan to frame Rusty. It would explain why michaels dad was so pissed. It would explain the fire poker. Maybe michaels dad put it back in Tommy’s place as a point that he didn’t protect Michael. Hm…
Great episode!! Tommy killed rusty on the stand! Until the end. Who put that there? U would assume the guy rusty beat up but who knows. I’m still holding on to my prediction though. Will be a crazy finale

I don’t think fire-poker at the end was the actual murder weapon, i think it was more like someone knows Tommy was involved and is gonna throw him under the bus, or if it is the husband like you guys were saying, he might have had the murder weapon but planted it in Tommy’s house and left that new looking one with the message to make it clear the murder weapon is now some where waiting for someone to find it and set up Tommy for the whole thing

I think it was Michael’s dad, but it was more about being pissed at how he was handling the case than about the murder itself.

It was Raymond. The one character who isn’t painted as being a scumbag (and your commentary on how much you all love him proves that). Also his nightmares and heart attack are signs of guilt. Carolyn probably found out he was burying evidence and threatened to come forward
my theory is the show does a fake out. The case plays out in tommy's mind of him getting convicted before the final piece to the case is actually revealed. Or another scenario just to satisfy one of our theories lol

I'm going WILD with my Theory! You guys know me, and think about a couple of things;
Whats the first thing you do when you enter your house, discover it's been broken into via breaking a window to enter? You pick up the phone, call the police UNLESS you have something to hide. Tommy has a lot to hide. I believe she found the fire poker searching his house. There was no search warrant, it couldn't be submitted for evidence! Those ties on the wall symbolized a tradition in that office, Tommy took more than one off that wall, why?
Jada learns about DID in class, Rusty checks all of the boxes as Jada notices, confronts Rusty during their bedtime chat. Rusty tells her his memory is fine, yet he has a lot of " blanks" (missing memories),. Then, when The Judge offers a Mistrial, oh, no, Rusty won't stand for "walking" on these murder charges. He refused the Mistrial, he's so stupid he needs to be incarcerated for being so fucking stupid!
Michael is a lying weirdo, having met Rusty AFTER he had taken that video with NO thoughts of Rusty killing his mother initially ~ think about it! What if he went into his mom's house after Rusty left, his dad goes looking for him, whoops, he's already shoved his mother from behind and it's all bloody, so his father stays behind to clean up after Michaels mess, ties Carolyn up like Bunny?
That one dude who had sperm inside of Bunny when the old dude went down for it? Was Tommy there, Three (pun on "too"!)? That dude didn't want to EVER talk to the Police, now he's all over the news for his wife and 4 kids to hear about. Prominent DA's, Judges, other Officers of the Court don't make their addresses public knowledge & any news coverage by law have to blur out address, tags, etc. by law especially the NEWS to ensure the families safety! Tommy knew that dude from Bunny's, sent him over to beat hard on Rusty's door knowing Rusty would flip out and beat him down to protect his family, then so certain he would NEVER go to the cops, visited him the next day showing him a picture of the dude in jail for Bunny's demise. He called Tommy and said they had a problem as Rusty showed him a picture of the dude who Hog tied Bunny. Then he and Tommy had sex with her only Carolyn disposes Tommy's sperm sample, hiding it from Rusty as Tommy threatens to report her & Rusty to HR, then tell Barbara about the affair and pending child.
Think about it, there was NO skin of Rusty's under Carolyn's nail, ONLY Skin CELLS, Raymond was debunking that wheelchair dudes testimony by calling in an exam Expert witness to explain the difference between skin and skin cells in Episode 6!
Sorry about the Saga, you I'm right. The day DELAY told Tommy there was no solid proof or evidence against Rusty, Tommy said: " there will be", then that SAME day, Exam Dr hands over a report of Rusty's Skin being under Carolyn's nail, he even asked Tommy why it wasn't in the initial report! Then after the reexamine by the States Dr he said he found Rusty SKIN Cells, not Skunk, Raymond questions wheelchair dude if he knew the difference, recall? I'll leave you with The Queens quite from The Gentlemen: "

Yeah I’m very curious about why Carolyn messed with the dna results. So that’s an interesting theory. The forensic dr was sus to me, like him and Tommy were homies. I thought maybe they worked together, the dr would be able to tell him how to cover his tracks to make sure no dna was left behind. They said the crime scene was wiped clean
I think Euginia was in on the kill. She wanted Rusty for herself and she went to Carolyn's after Rusty left. they spoke, she found out she was pregnant and killed her. She didnt think rusty would get blamed. then she went to Tommy's to see if she could find any information to help rusty. lastly she left the note because she was angry at how Tommy did in court.
The message on the fire poker is typed on a Post-It note, not randomly scribbled! This has to have been was prepared before that person put it on his table. Also, it wasn't wet and it was pouring rain outside so to me, that looks like it was carried inside something to keep it dry. Maybe a purse? I'm thinking this was done by Eugenia, because of how perfectly the words were spaced. Remember that Eugenia said "Go f**k yourself" to Tommy when he questioned her about whether or not she had ever kissed Rusty!
The other person who I think could have done this so meticulously might have been the ME. He said , "Go F**k yourself" a few times, as well!
Also thinking that whoever was searching Tommy's house might have found the poker there and is letting Tommy know that they're onto him, if indeed he is the killer. The look on Tommy's face was of a certain terror! If it was Tommy, I think he could've done the whole thing himself but I do like the idea that he and Eugenia did this together!

In the movie Presumed Innocent, it was the wife that committed the crime. I. The end she confesses only to her husband and gets away with it. The show deviates from the movie but I can’t help but think it could’ve been the wife or Tommy!

He’s wearing a regular tie on the subway and not the bolo, which he wore in court and when he got home to the find the fire poker. So why put that scene THERE? Why take Carolyn’s win/tie earlier in the episode? Smells like a clue to me…
