  • Fellow Legends, welcome! Today we dive into quite the interesting video in regard to Nintendo and their continued war against all things emulation. Nintendo is an interesting company that has a right to protect their intellectual properties. However, sometimes some of their decisions raise a few eyebrows.     I firmly believe that for copyright to be respected by the public companies should have legal obligation to conserve games and maintain availability. If they consider any particular game becomes too much of a burden to keep available then it MUST forfeit copyright protection then make it public domain. The current law is trash that serves no social or cultural benefit.

    Didn't Gabe Newell state that Piracy is a Service problem?
    And if there's this piracy about these older games, 10, 20, 40 years old...

    Game preservation is pretty important considering how quickly everything is going with games, once a new one comes out it's not very often older games in the series get a rerelease outside of a digital rom that a company (usually Nintendo) licenses from their shop. One that's bugged me for ages is the fact that out of all the versions of Symphony of the Night that have been ported over the years they've NEVER ported the Sega Saturn version of the game....one that allows you to play as Richter with his longcoat instead of his basic sprite from Rondo of Blood/Dracula X, and also has two entire stages that are exclusive to that version. The version on the PSP Dracula X Chronicles? Playstation version only...yeah that makes sense but even the versions ported to Xbox 360 and Ios/Android were the Playstation version...if you want to play the Sega Saturn version you have to 1) Buy a Sega Saturn that plays Japanese games, 2) Buy the actual Japanese copy of the game because it was never released in the US for Sega Saturn.
    The other option is a ROM...those are your only two options to play that game and for some games it's like that as well where they were ONLY released in Japan and so your options are to buy a console that is either Region Free and can play games from Japan, mod your system to play games from Japan, or buy a Japanese console and then buy the games....or use ROMs. There HAS to be a middle ground somewhere for ROMs that aren't controlled by a company like Nintendo...what about all those games from companies that are no longer around and nobody has the rights to anymore? Games like that, that will just rot and be forgotten about without someone uploading a ROM somewhere so people can see the game existed and can play it. I get wanting to protect IP and all that but letting old games just fade away is doing a disservice to the history of gaming, not to mention all the work put into those games by their creators of the time.

      That's sadly the way. When there is contention between two versions, one is biting the dust. And in this case, the Saturn was just technically too weird of a console to make the version count for consideration.

    Emulator sites are the Hydra of the internet. You're never going to stamp them out completely.

    26:40 it's called Zelda 64: Recompiled, it works with Majora's Mask and soon, Ocarina of Time. Honestly its amazing, it works with various resolutions and aspect ratio, smooth 60 fps, you can map the right thumbstick to move the camera like normal games, the D-Pad is mapped to the main 4 transformation masks, and while using the ocarina, the D-Pad works like the C buttons, and when you quit the game it autosaves at the owl. You have to provide your own ROM though, but it's an easy setup.
    The main downside is that the 2D UI is low resolution. but it will eventually support mods for that sort of stuff. I wonder if it will be possible to replace the N64 button UI with xbox button UI

    You can file legal action, but it depends on the area/state. Short hand, yes, you can, but it may cost in lawyer/attorney fees.

    Nintendo could make bank selling an emulator for 50$ and then letting you buy ported Pokémon Ruby (for example) for say 10$. Rinse, repeat, profit. If they did that I would go in hard and have every Pokémon game that exists. How many people would do that for say Mario or I'm Zelda or whatever.

    So, I do agree for the majority with the fact that Nintendo does feel like it's dropping the ball on a lot of this, because they are. And honestly Nintendo is actively kidding themselves if they think they could wipe out roms and emulation more determined and wealthy companies have tried this and it never seems to stick.
    I wholeheartedly agree that Nintendo is actively acting sketchy with their history, and a lot of it is probably due to some greasy boardroom executives wanting to hoard all the money in the world or whatever.
    I also agree the ongoing war against archival / roms honestly makes me worry about the idea of 'ownership' in the gaming sphere, and the chance that it could spread to other forms of media is rather daunting.
    The only part I have a problem with is his talk about the E-shop in general, because a lot of the games that were on those old consoles don't only belong to Nintendo or have music that couldn't be claimed for copyright currently but if re-released they could. And if I remember correctly they did get in trouble with it over a couple of games during the Wii's lifetime (I might be misremembering that, it's been a while).

    To most bussinesses: If they DONT uphold their IP laws, they can just get straight ARRESTED for being irresponsibile with thrir financial responsibility to Copyright law.
    Nintendos legal claim: "We literally DONT have a choice here. Doesnt mstter if we arent prpfitting off old IPs, theyre still OUR legal property"

      This is not true in the US, if it is true for Japanese business why does no other Japanese company go as hard a Nintendo does?
      If they really wanted to stop fight piracy in the easiest way they just need to give a better alternative what they have been doing recently.

      @@jameskarg3240 There will always be people trying to get stuff for free but a lot just want to play these one the platform they want.
      Imagine the insane money Nintendo would make if they just released all their pre gamecube games on steam. Even just for a few bucks, they would make hundreds of millions easily.

      @@jameskarg3240 For stuff they literally never release again? If there was some sort of honorcode that they won't take down games they are not actively selling, then several sites would be willing to establish a counter-honor code to only provide those games. But since they do not discriminate, everyone just takes everything. No point differenciating.

    Nintendo just can't handle being out performed by dedicated fans that make better software with their superior emulators. Also Nintendo is trying to gate keep retro games. This is just a theory but their older games being emulated they see it as de-valuing the market price of hard copies like you said some go for 200 bucks when it's not needed to go that high but Nintendo wants them to go that high due to how rare a game is and collectors. Which I think some of Nintendo employees are some of these collectors. It's old so just forget about it and play our modern stuff. but trying to fabricate a problem of piracy to games you no longer make and no longer sell yourselves, to me that's not piracy, Artificially inflating the retro gaming of hard copies by saying ROMs' de-value the hard copies when the money doesn't even go to you Nintendo when these hard copies are sold to collectors. Some Collectors I doubt even play the games they buy, to them it's a conversational piece rather than true nostalgia.

      i'm not so sure if they're protecting the hard copy value for collectors.
      collectors must recognize that popularity of the game = more value for the copy. people freely playing the game makes it more popular.
      without roms, old games would not be relevant. they bring old games to young audiences, increases popularity & value.
      i think Nintendo is removing competition where they can. gamers playing roms aren't playing their new games. fewer options = greater chance they'll make new revenue on selling (downloads) of a game, which will become outdated/unplayable in their own way eventually.

    Cause those companies are in other countries where us law can't reach. Check the ones they did take down. They were all us based.

    imo, anything not actively supported would be considered abandonware and would become public domain. Anything older than 25 years old will become public domain BUT cannot be monetized

    Maybe if people hadn't kept trying to mod the switch (y'know a system still receiving support) maybe they wouldn't look so badly on modding. They don't give shiza about 3ds and older moddable devices.

    Nintendo doesn't understand that people are more than willing to buy their old games if they were to be rereleased. However, Nintendo doesn't rerelease them at all, and when they do, the service they offer is actually sub-par compared to what pirates are offering.

      Nintendo understands, it just doesn't care at all, they want a perpetual revenue stream. They know they can get some money on re releases but thy rather you own nothing and pay for the same games over and over, forever. The already tried it with the virtual console on the Wii and WiiU people didn't liked rebuying and transferring the previous library from the Wii as painful as possible. They are happy with the NSO subscription. You keep paying and when they decide to close the service you owned nothing.

      @@alexisrivera200xable In that case, Nintendo is actively being goofy. There is literally no way to stop us from just modding our switches to keep using NSO. The only thing stopping unmodded users is a singular check on the home menu for a valid sub, which also does not require being online. You don't even have to patch that out, just somehow spoof it to always return true and you are golden.

      @@lpfan4491 That the thing friend, we live in the real world. Meanwhile Nintendo lives in the modern corporate world's obsession with rent seeking subscription schemes and ever bigger quarterly profit margins.
      They have some been this litigious for a couple decades at this point.

      There are, it's called don't redistribute and don't sell those copies you made for money. Most of the recent issues of nintendo taking things down involves the person making a profit from it.
      Most of the people complaining about this stuff aren't complaining because of history being erased, their complaining cause their free games are getting erased, people who actually care about history being saved probably already has all of this stuff downloaded.

      @@TheGelatinousSnake Preservation is also generally non profit, and rom sites tend to host ads which give profit. The recent take downs I've seen is because of stupidity of the people looking for profit.
      r/roms has an amazing non profit roms site that as far as I know has never been touched by nintendo.
      Nintendo hardly ever goes after places that aren't making money. And when they do there is usually some exceptions behind the scenes we will never really know honestly.

      @@zackrose6261 I have zero issue paying for the games but they won't sell the games is the issue. they will either lock it behind a subscription service on on platform or just not even have it available. I have bought dozen of retro games/collections on steam, but they aren't all on steam.
