Watching this 9 damn years later, I still think it's one of the best animated comedy shorts ever made. The "do that" bit at the beginning is something I literally always quote, and the whole Star Spangled Bastard story is incredibly funny, smart and, unfortunately, still very accurate. Beyound from the narrative precpective as to why Batman doesn't kill the Joker there is a moral dilemma. Namely while Batman is a vilgelante he doesn't think of himself as an absolute authority. If the people of Gothem or the government decided to execute the Joker through due process he wouldn't stop them. He's just worried if he murders the Joker or anyone really, it will set him down a path of extreme violence, even against people who don't desearve it.
