Did you mention you used Canva to design your logo? If so I just wanted to let you know that I did reach out to Canva and asked them if their logos were able to be trademarked and they did reply back saying it could be
You can register the trademark for a Canva logo that you created yourself or uploaded (that someone else created). You cannot register the copyright for the ones that are considered stock content in Canva. So this logo wouldn't be eligible for registration because I used a Canva stock image.
What does it mean when it says abandoned or dead? Also, what about if I want to search for a particular item, such as a flag, which certain colors and designs? Do I use the same steps as shown here?
It is abandoned or dead, it means that the registration was either canceled, or the application never made it to registration. If you want to search for a particular item, you can search for the design (as instructed here). No need to search for the colors because in some cases, the applicants do not claim specific colors.
Why pay an attorney $500/search (whether it comes back viable or not) and another $1,500 to apply for a trademark? It only costs $200-$300 to file for a trademark? It appears that, after searching as best as possible, it would be better and more cost effective to apply pro se for several trademarks and hope to get one. If the attorney's search comes up clean and the USPTO rejects the trademark does the client get their attorney fees reimbursed? The risk/reward for the attorney fees appears very dismal. Please comment. It would be great for subscribers to know your thoughts on this.
You could search and file on your own. But would you know what to look for to ensure that you have a smooth path to registration? My fees are based on my experience in this area. The risk/reward you speak of is payment for a service that comes with significant value and benefit. I do not file applications for trademarks that I know have no chance of being registered. I also let my clients know the risks if they decide to move forward anyway. An attorney can also help with strategy for your brand and business.
Hi Nicole, it's always exciting to watch your videos, they are filled with information. My question is did you do a video on word art search, if yes can you share it with me, please

It can be, just the premade ones i think are the ones that can't! so if you made your logo from scratch or put stuff together then you're fine!

Yes, seems like it.

What does it mean what nothing is listed under design search code
Interesting question. Do you mean nothing listed during the search, or that the code wasn't available for the design?

Oh, thank you (a year later)! :)
I have not done one on word art. I'll add that to the list!
If my logo has different designs in it , should I search multiple design codes at once or do it one at a time?
Looks like you can search multiple ones at a time or one by one.
Yes, you can search multiple design codes at once!
